Mayor Smith called the meeting to order at 7:02 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Deacon Jim Shope, All Saints Parish.

Motion by Mayor Smith with a second from CM Bonus to approve the agenda for the regular meeting of August 26, 2021.

Motion by Mayor Smith to add a motion to approve City Resolution No. 2021-08-26A; a resolution authorizing the Butler City Clerk to sign and accept within the Reimbursement Agreement System (RAS), on behalf of the City of Butler, the applicable Reimbursement Agreement between the City of Butler and the Pennsylvania Department of Transportation and have same delivered to the Commonwealth of Pennsylvania. Second by CM Bonus.  All voted aye.

All voted aye.  Agenda approved.

Motion by Mayor Smith with a second from CM Dandoy to approve the minutes of the regular meeting of August 5, 2021.  All voted aye.

Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

MONTHLY BOARDS AND AUTHORITIES LIAISON REPORTS   

Liaisons of the City’s boards and authorities gave a brief report from the board or authority that met in July.

MONTHLY DEPARTMENT REPORTS

Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works, and Parking Department for the month of July. Motion by Mayor Smith. Second by CM Dandoy.  All voted aye.

COUNCIL REPORTS/ACTIONS

Councilman Walter

1.Motion to approve a proposal submitted by Maher Duessel Certified Public Accountants for assistance in administration and general consulting of its American Rescue Plan Act (ARPA) as outlined in their engagement letter of July 13, 2021 with a total cost not to exceed $2,000.00 and to authorize the City Clerk to sign said letter on behalf of City Council. Second by CM Dandoy.  All voted aye.

2.Motion to pay the final installment of the 2020 small borrowing loan to NexTier Bank.  ($142,548.00; $140,000.00 principal and $2,548.00 interest). Second by CM Bonus.  All voted aye.

Councilman Smith

3.Motion to accept the bid from Wiest Asphalt Products & Paving, Inc. in the amount of $39,000.00 for the Ritts Park Pickleball Courts Project in Ritts Park. Second by CM Bonus.  All voted aye.

4.Motion to accept the bid from Joe Gargiulo in the amount of $64,517.52 for the rebuilding / restoration of the Ritts Park Memorial Seating Project in Ritts Park.   Second by Mayor Smith.  All voted aye.

5.Motion to purchase a Z422KWT-60 Zero Turn mower from M&R Equipment for $7,150.06 (Sourcewell contract #031121) from M&R Power Equipment. Second by Mayor Smith.  All voted aye.

Councilman Bonus

7.Motion to award the bid to S & C Trucking & Excavating in the amount of $11,500.00 for the Sullivan Run Stream Cleaning 2021 Project.  LIN 18 427 305.  Second by Mayor Smith.  All voted aye.

8.Motion to approve payment to Wiest Asphalt Products and Paving, Inc. in the amount of $47,327.97 for the 2021 Monroe Street Paving Project.  LIN   35 430 439  Second by CM Walter.  All voted aye.

Councilman Dandoy

9.Motion to approve the promotion of part-time Firefighter Jonathan Smeltzer to the position of full-time Firefighter within the Butler Bureau of Fire as part of the Staffing for Adequate Fire and Emergency Response (SAFER) Grant program, effective September 26, 2021. Second by Mayor Smith.  All voted aye.

10.Motion to accept a Fiscal Year 2020 Assistance to Firefighters Grant in the amount of $52,000.00 for the installation of a source capture vehicle exhaust extraction system in the fire station.  The federal share of the grant is $49,523.81, with a city match of $2,476.19. Second by Mayor Smith.  All voted aye.

Mayor Smith

11.Motion to approve City Resolution No. 2021-08-26; a resolution authorizing the Redevelopment Authority of the City of Butler to file an application for HOME funds for affordable housing activities on behalf of the City with the Department of Community and Economic Development (DCED) Commonwealth of Pennsylvania in the amount of $200,000. Second by CM Bonus.  All voted aye.

12.Motion to approve the Allegheny Health Network Payment in Lieu of Taxes (PILOT) Agreement, subject to the Solicitor’s approval of the Agreement. Second by CM Bonus.  CM Walter, CM Bonus, CM Dandoy and Mayor Smith voted aye.  CM Smith voted no.

13.Motion to approve a request from Patrol Officer Michael Sulerud to apply the provisions of the Pennsylvania Heart & Lung Act for a work-related injury that he sustained on August 24, 2021. Second by CM Walter.  All voted aye.

Announcement:

Michael Wilczynski was appointed to the Shade Tree Commission for a three-year term which expires June 2024.

The City Treasurer presented a Monthly Intake Report for July, 2021.

The City Controller presented bills for payment as follows: from the general fund – $311,957.11; from the parking fund – $27,416.36; from the capital projects fund – $6,848.69 and from the liquid fuels tax fund – $49,901.24; for a grand total of $396,123.40.  Motion by Mayor Smith with second from CM Dandoy to approve payment of bills as presented.  All voted aye.

August Public Announcement – Municipal Separate Storm Sewer System (MS4)

As part of an ongoing education plan, we would like to remind local residents that if you plan to drain your pool, only drain it when your test kit does not detect any chlorine levels. Chlorine is considered toxic to fish and aquatic organisms. Whenever possible, drain the pool or spa into the sanitary sewer system.

Contact your local municipality if you have any questions regarding how to properly drain your pool or spa.
