City Council Meeting
City of Butler, Pennsylvania
July 30, 2020 7pm via Zoom Meeting

Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by by Lay Pastor Kerry M. Dowdy, East Butler Presbyterian Church.

A Public Hearing was held at 7:03 PM for the conditional use at 311-313 Eau Claire Street by Travis Uhl. There was no public comment.

Motion by Mayor Smith with a second from CM Dandoy to approve the agenda for the regular meeting of July 30, 2020.

  1. Motion by CM Walter to amend the agenda as follows:

Motion to add a motion to loan one (1) AED that is surplus from the fire department to the City of Butler Parks, Recreations Grounds & Facilities Authority until December 31, 2021. Second by Mayor Smith.  All voted aye.

  1. Motion by Mayor Smith to amend the agenda as follows:

Motion to add the motion to approve the Conditional Use request at 311-313 Eau Claire Street for Travis Uhl, J & J Technical Electric Contracting with the following conditions:

  1. That Mr. Uhl obtain a permit from the zoning office to install 2 exterior parking spaces on the east side of the building.
  2. That Mr. Uhl install a fence at the rear of the 2 exterior parking spaces, between the parking spaces and the yard of the adjacent property at 236 Second Street.
  3. That Mr. Uhl maintains 4 off-street parking spaces for the business.
  4. That Mr. Uhl complies with the PA UCC when making any changes to the        building.   Second by CM Walter.  All voted aye.

Motion to approve amended agenda by Mayor Smith. Second by CM Dandoy.  All voted aye. Agenda amended.

Motion by Mayor Smith with a second from CM Walter to approve the minutes of the Regular meeting of July 7, 2020.  All voted aye.

Motion by Mayor Smith with a second from CM Bonus to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

MONTHLY & ANNUAL DEPARTMENT REPORTS

Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works and Parking Department for the month of June. Motion by Mayor Smith. Second by CM Walter. All voted aye.

COUNCIL REPORTS/ACTIONS

Councilman Walter

  1. Motion for the introduction and first reading of City Ordinance No. 1787; an ordinance increasing the indebtedness of the City of Butler, Butler County, Pennsylvania by the issue of a General Obligation Note in the amount of $280,000.00 for the purpose of the 2020 Monroe Street Storm Sewer Project. Second by Mayor Smith. All voted aye.
  2. Motion to approve a payment in the amount of $13,293.20 to Wells Fargo Bank for an interest payment for the General Obligation Bond Series of 2005. LIN 01 472 700. Second by CM Bonus.  All voted aye.
  3. Motion to loan one (1) AED that is surplus from the fire department to the City of Butler Parks, Recreations Grounds & Facilities Authority until December 31, 2021. Second by CM Dandoy. All voted aye.

Councilman Smith

  1. Motion to approve a commitment letter for the Butler County Redevelopment DCED Blight Remediation Grant Application. Second by CM Bonus. All voted aye.
  2. Motion for the introduction and first reading of City Ordinance 1788; An ordinance of the City of Butler amending the exemption schedule for new businesses within the City of Butler which would otherwise be subject to the business privilege tax or mercantile tax. Second by Mayor Smith. All voted aye.
  3. Motion to approve the Code Red Agreement. Second by Mayor Smith. All voted aye.

CM Smith recognized Victory Church in Cranberry and Community Alliance Church for their work in Ritts Park.

Councilman Bonus

  1. Motion to accept the bid from Albert T. Stultz for the 2008 Ford F-550 in the amount of $2,000.00. Second by CM Walter.  All voted aye.

Councilman Dandoy

CM Dandoy announced there will be a downtown clean-up on August 8, 2020 from 9AM until noon. All volunteers will meet on Main Street in front of The Venue On Main at 152 N. Main Street.  Volunteers need to bring gloves and tools (a flat head screwdriver).

       City Shade Tree Commission:

  • Lawrence Herndon (replacing Doug Kleeman) for a 3-year term ending June 30, 2023.

The City Treasurer presented a Monthly Intake Report for June, 2020.

The City Controller presented bills for payment as follows: from the general fund – $106,309.94; from the parking fund – $178,291.77; from the capital projects fund – $135,582.42; and from the liquid fuels tax fund – $34,100.25; for a grand total of $454,284.38.  Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.

July Public Announcement – Municipal Separate Storm Sewer System (MS4)

As part of an ongoing education plan, we would like to remind local residents to collect rainwater from rooftops in mosquito proof rain barrels. The water can then be used later to water lawns and garden areas. Do not brush/sweep dirt, leaves, etc. into any storm drain. The purpose of the storm sewers are to direct stormwater runoff to the local streams. If the system is clogged, then localized flooding may occur during a large rainfall event.
