City Council Meeting
City of Butler, Pennsylvania
February 26, 2015
Mayor Donaldson called the meeting to order at 7:00 PM. Mayor Donaldson and Council members Readie, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by the Reverend Dan Ledford, Westminster Presbyterian Church.
PERSONS TO BE HEARD:
Mark Krenitsky spoke about Allegheny County sending letters to the tax-exempt properties requesting confirmation of their tax exempt status. Mr. Krenitsky also felt that the County should lease the parking spaces in the Quarry Street lot. Also discussed was the need for the city fire department to rely on the township fire department more often.
Motion by CM Schontz with second from CM May to approve the minutes of the Regular meeting of January 22, 2015 and the minutes of the special meeting of January 29, 2015.

COUNCIL REPORTS/ACTIONS
Councilwoman Readie
1. Motion for the second reading and adoption of City Ordinance No. 1707, an ordinance of the City of Butler, Pennsylvania amending the definition of “New Business” found in Chapter 235, section 235-67 of the codified ordinances. Second by CM Schontz. All voted aye.
2. Motion to amend the agreement with the County Prison to lease the five parking spaces in front of the prison to the County of Butler (located on the west side of S. Washington Street and located between Cunningham and Vogely Streets). Second by CM Schontz. All voted aye.

3. Motion for the second reading and adoption of City Ordinance No. 1708, an ordinance of the City of Butler vacating a portion of Birch Street from South Cedar Street to South McKean Street. Second by CW Readie. All voted aye.
4. Motion to recommend that City Council of the City of Butler amend Chapter 260, the Zoning Ordinance of the City of Butler, to add a general regulation confirming the duty for businesses to obtain an occupancy permit for zoning compliance. Second by Mayor Donaldson. All voted aye.
5. Motion to install a “No Parking Here to Corner” sign on North Monroe Street at the corner of North Monroe Street and East Pearl Street on a 90-day trial basis. Second by CW Readie. All voted aye.
6. Motion to award the demolition of 463 East Jefferson Street to A P Wise Excavating in the amount of $4,750.00 based upon the general specifications of the contract and the release by the City Solicitor. Second by CW Readie. All voted aye.
7. Motion to approve payment in the amount of $1,600.00 to A P Wise Excavating for the emergency demolition of the garage at the rear of 215 Howard Street upon final inspection. LIN 01 427 221 Second by CW Readie. All voted aye.

8. Motion to approve City Resolution No. 2015-02-26; the City of Butler agrees to comply with the requirements of the Butler County Parks Renovation Program for the purpose of obtaining grant funds for the renovation of Father Marinaro Park. Second by CM Schontz. All voted aye.
9. Motion to award the contract to Wiest Asphalt Products and Paving, Inc., to install an asphalt basketball court at Rotary Park at a cost of $5,250.00 to be paid with the Spray Park Funds. (LIN 01 489 010) Second by CW Readie. All voted aye.
10. Motion to approve purchase of playground equipment and installation of playground equipment by Jeffrey Associates through the Keystone Purchasing Network (KPN) of Playworld #FUN1493 play unit, Playworld #SWING-SP8 w/2 seats for a total cost of $23,742.00. Purchase is contingent on the release of funds ($20,000.00) by the Butler County Housing Authority per agreement. Balance to be paid with the Spray Park Funds (LIN 01 489 010). Second by CW Readie. All voted aye.
11. Motion to approve the purchase, delivery, and installation of load engineered wood fiber surface (60 yards) from Jeffrey Associates for the purpose of providing safe zone fall area material at Rotary Park for a total cost of $1,134.00 to be paid with the Spray Park Funds (LIN 01 489 010). Second by CW Readie. All voted aye.
12. Motion to approve a cooperation agreement with the Butler Downtown for their events to be held in the West New Castle Street Plaza. Second by CW Readie. All voted aye.

13. Motion for the second reading and adoption of City Ordinance No. 1706; an ordinance of the City of Butler, Butler County, Pennsylvania, establishing a residential parking program; establishing a residential parking area in which commuter parking is prohibited and prescribing penalties for violation of the ordinance. Second by CW Readie. All voted aye.
14. The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for January, 2015. Treasurer Smith thanked Nicole Boldy for her work for the city and wished her good luck in the future.
15. The City Controller, presented bills for payment as follows: from the general fund – $583,502.45; from the capital projects fund – $78,354.75; and from the liquid fuels tax fund – $2,521.00 for a grand total of $664,378.20. Motion by Mayor Donaldson with second from CW Readie to approve payment of bills as presented. All voted aye.
