City Council Meeting
City of Butler, Pennsylvania
August 22, 2013
Mayor Stock called the meeting to order at 7:01 PM. Mayor Stock and Council members Scott, Kline, Schontz and Guard were present. The pledge of allegiance to the flag followed an invocation given by Fr. Philip Farrell, Episcopal Vicar of the Diocese of Pittsburgh, Region 4.
PUBLIC HEARING: Mr. Art Cordwell, Executive Director of the Redevelopment Authority of the City of Butler briefed Council and the public on the 2013 Community Development Block Grant (CDBG) application.
PERSONS TO BE HEARD:
- Gordon Kennedy shared concerns about the property at 966 E. Jefferson Street and also shared a letter written by Nikki Mcrea who shared the same concerns.

Motion by CW Guard with second from CW Kline to approve the minutes of the regular City Council meeting of July 25, 2013. All voted aye.

1. Motion for the second reading and adoption of City Ordinance No. 1678; an ordinance of the City of Butler, Butler County, Commonwealth of Pennsylvania, amending Chapter 212; Rental Occupancy Reports; § 212-1. Report of lessees and occupants required. Second by CM Schontz. All voted aye.
2. Motion to approve City Resolution no. 2013-08-22 approving the City’s Community Development Block Grant Application for FY 2013. Second by CW Guard. All voted aye.

3. Motion to approve the conditional hiring of Jonathan Feicht as a full-time Hoseman in the Bureau of Fire. Second by CM Schontz. All voted aye.

4. Motion for the second reading and adoption of City Ordinance No. 1676; an ordinance of the City of Butler amending Chapter 226; Solid Waste; Article 1; Garbage and Rubbish; § 226-10. Violations and Penalties. Second by CW Guard. All voted aye.
5. Motion for the second reading and adoption of City Ordinance No. 1677; An ordinance of the City of Butler, Pennsylvania, formerly adopting Leyland Way as a public street. Second by CW Kline. All voted aye.
6. Motion to approve the promotion of Tom Shuler to Street’s Foremen effective August 10, 2013. Second by CW Guard. All voted aye.
7. Motion to approve the promotion of Clay McAnallen to Street’s Department Skilled Laborer – Category 2, effective August 18, 2013. Second by CW Scott. All voted aye.
8. Motion to accept the bids from the following for the 2013 ARLE Grant:
Contract #1 – Curb Ramp Replacement to Joe Palmieri Construction, Inc. for the amount of $36,537.00.
Contract #2 – Signal Upgrade to Bronder Technical Services, Inc. for the amount of $25,513.05.
Total project construction cost: $62,050.05

9. Motion to install a Stop Sign at the corner of W. Locust Street and Franklin Street on a 90-day trial basis. Second by Mayor Stock. All voted aye.
10. Motion to make payment to Bauer Excavating, Inc. in the amount of $17,180.00 for installing a storm sewer system along both E. Walnut Street and Broad Street upon final inspection and approval by the City Municipal Engineer. LIN 01 430 373 Second by CW Scott. All voted aye.
11. Motion to make payment to Bauer Excavating, Inc. in the amount of $4,380.00 to repair the sink hole on Hansen Avenue upon final inspection and approval by the City Municipal Engineer. LIN 01 430 373 Second by CW Guard. All voted aye.
12. Motion to make payment to Joseph Palmieri Construction in the amount of $9,450.00 for installing a new sidewalk and curb along a section of Morton Avenue upon final inspection and approval by the City Municipal Engineer. LIN 18 430 439

13. Motion to make payment to Uhl Construction in the amount of $38,979.00 as Payment #1 for reconstructing the existing bridge along North 6th Avenue between West Penn Street and Pine Street. LIN 18 427 305 Second by CW Guard. All voted aye.
14. Motion to accept the bid from Wiest Asphalt, Inc. in the amount of $8,500.00 for the overlay on Carbon Street. Second by CW Kline. All voted aye.

15. Motion to enter into an agreement with First Baptist Church to lease Father Marinaro Park for youth soccer practice. Second by CW Scott. All voted aye.

16. Motion to accept the resignation from Joseph Lucas from the Butler Area Sewer Authority effective July 31, 2013. (Term expires December, 2015) Second By CW Kline. All voted aye.
The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for July, 2013.
The City Controller presented bills for payment as follows: from the general fund – $418,437.73; from the capital projects fund – $54,253.22; and, from the liquid fuels tax fund – $4,661.64 for a grand total of $477,352.59. Motion by Mayor Stock with second from CW Kline to approve payment of bills as presented. All voted aye.
