City Council Meeting
City of Butler, Pennsylvania
May 23, 2013
Mayor Stock called the meeting to order at 7:00PM. Mayor Stock and Council members Scott, Kline, Schontz and Guard were present. The pledge of allegiance to the flag followed an invocation given by Pastor Don Short, from Grace at Calvary Church.

Motion to accept the minutes with correction to motion 16 due to a clerical error. The cooperation agreement with the Farmers’ Market and Butler Downtown will expire on December 31, 2013 not June 23, 2022. Motion by Mayor Stock. Second by CW Kline.
MONTHLY & ANNUAL DEPARTMENT REPORTS
(Note: Department Reports Distributed to Council at Tuesday’s Forum Meeting for Review)
All department reports for the month of April were approved by individual, unanimous votes.
The following actions took place at the City’s Forum Meeting held on May 21, 2013:
• Katie Yates attended the Forum meeting and briefed Council on the audit report for Fiscal Year 2012.
COUNCIL REPORTS/ACTIONS
Councilwoman Scott
1. Motion to approve a payment in the amount of $603,330.00 to NexTier Bank for the 2013 Tax Revenue Anticipation Note. $600,000.00 Principal (LIN 01 472 601) & $3,330.00 Interest (LIN 01 472 600) – payoff date is May 24, 2013. Second by CW Kline. All voted aye.
2. Motion to approve City Resolution No. 2013-05-23; a resolution of the City of Butler appointing Sharon Snyder as an authorized representative to make requests upon and receive any and all tax information and records from Berkheimer, relative to the collection of taxes for the Taxing Authorities within the Butler County Tax Collection District, as directed and deemed necessary, to be used for official purposes only. Second by CM Schontz. All voted aye.

3. Motion to approve payment to Ken Reilly Contracting in the amount of $5,945.00 for demolition of 518 Virginia Avenue upon final inspection and approval of the Code Enforcement Officer. LIN 18 427 221. Second CW Kline. All voted aye.
4. Motion to approve a block party on Peach Street from Cecelia Street to Arthur Way on Sunday, May 26, 2013 from noon to 10:00 PM. Second CW Guard. All voted aye.
5. Motion to approve a block party on Fourth Avenue from Fillmore Street to Pillow Street on Saturday, June 29, 2013 from 10:00 AM to 10:00 PM. Second CW Scott. All voted aye.
6. Motion to direct the city engineer to advertise for bids to repair the Sixth Avenue Street Bridge. Second by CW Scott. All voted aye.

7. Motion to accept the bid from AirVac 911 in the amount of $37,301.00 to replace the exhaust system in the Public Safety Building. Second by CW Kline. All voted aye.
8. Motion to approve the cooperation agreement with the Butler Downtown Group for management of the West New Castle Street Plaza. Second Mayor Stock. All voted aye.

9. Motion to approve the Minority and Women’s Business Enterprise Action Plan in accordance with Executive Orders 11625, 12138 NS 12432; HUD Acquisition Regulation (HUDAR), PAR 2426.70; Title 24 Part 85.36(E); and Code of Federal Regulations. (Compliance Officer: Redevelopment Authority of the City of Butler) Second CW Guard. All voted aye.
10. Motion to reject the bid from Marshall Offstein for the 2008 Chevrolet Impala in the amount of $527.00. Second by CW Scott. All voted aye.
The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for April, 2013.
The City Controller presented bills for payment as follows: from the general fund – $793,634.57; from the capital projects fund – $18,411.25; and, from the liquid fuels tax fund – $5,473.86 for a grand total of $817,519.68. Motion by Mayor Stock with second from CM Schontz to approve payment of bills as presented. All voted aye.
