City Council Meeting

City of Butler, Pennsylvania

March 21, 2013

 

Mayor Stock called the meeting to order at 7:00PM.  Mayor Stock and Council members Kline, Schontz and Guard were present. The pledge of allegiance to the flag followed instrumental performance of “My Country tis of Thee” and an invocation given by Pastor Todd Wentworth, First Baptist Church.

 

PERSONS TO BE HEARD:

 

Shade Tree Commission: 

  • Julie Dandoy gave a brief history of the Shade Tree Commission and its mission.
  • Jill Kraus updated council on several projects.  Business owners in the city must contact the Shade Tree Commission for pruning of the trees in the business district.  The Commission welcomes any volunteers and funds.

 

VOICe: 

  • Becky Rosenbloom was presented a Proclamation for Sexual Abuse Awareness Month in April.        

 

 

Motion by CM Schontz with second from CW Kline to approve the minutes of the regular City Council meeting of February 28, 2013.

 

The following actions took place at the City’s Forum Meeting held on March 19, 2013:

 

1.  City Council, acting as the Board of Health, and under the provisions of the Third Class City Code, Section XXIII, (b) Abatement of Public Nuisances, Section 2321, found the following subject structures detrimental to public health and ordered their removal by demolition:

 

530 ½ Bredin Street

129 Morton Avenue

463 E. Jefferson Street

 

Motion by Mayor Stock.  Second by CM Schontz.   All voted aye.

 

 

 

MONTHLY & ANNUAL DEPARTMENT REPORTS

(Note:  Department Reports Distributed to Council at Tuesday’s Forum Meeting for Review)

 

All department reports for the month of January were approved by individual, unanimous votes.

 

COUNCIL REPORTS/ACTIONS

 

Councilman Schontz

 

1.      Motion for the introduction and first reading of City Ordinance No. 1670; an             ordinance of the City of Butler amending Chapter 260, the zoning ordinance of the          City of Butler, to rezone tax parcel 563-6-227, which is partially in the C-2 zoning district and partially in the R-2 zoning district and partially in the M-1 zoning district        so that said parcel is entirely in the M-1 zoning district. Second by Mayor Stock.     All voted aye.

2.         Motion for the introduction and first reading of City Ordinance No. 1674; an             ordinance of the City of Butler, Pennsylvania amending the City’s traffic control schedule contained in Chapter 245 of the Codified Ordinance of the City of Butler by making permanent experimental regulations previously adopted by City Council          on a 90-day trial basis.  Second by CW Kline.  All voted aye.

 

3.         Motion to approve payment to A.P. Wise Excavating in the amount of $11,740.00    for the demolition of 319 ½ E. Jefferson Street and 112 Garfield Avenue, upon         final inspection and approval of the Code Enforcement Officer.  LIN 18 427 221      Second by Mayor Stock.  All voted aye.

 

4.         Motion to award the demolition of 518 Virginia Avenue to Ken Reilly Contracting in the amount of $5,945.00, based upon the general specifications of the contract            and the release by the City Solicitor.  Second by CW Guard.  All voted aye.

 

Councilwoman Guard

 

 

5.         Motion to appoint William O’Donnell to the City of Butler Parks, Recreation         Grounds & Facilities Authority to fill out the term for Perry O’Malley which            expires on January 1, 2016.  Second by CW Kline.  All voted aye.

 

Mayor Stock

 

6.         Motion to accept the proposal from Frames & Pixels, Inc. in the amount of   $2,550.00 to remove the virus, migrate the data, redesign the site, transition the   old information and provide training for use of the system and thereafter, host the             site for $240.00 annually.  Second by CM Schontz.  All voted aye.

 

7.        Motion for the introduction and first reading of City Ordinance No. 1671; an             ordinance of the City of Butler amending Chapter 226 – Solid Waste; Article II;          Trash Accumulation and Plant Growth; § 226-13; Violations and Penalties.              Second by CW Kline.  All voted aye.

 

8.        Motion for the introduction and first reading of City Ordinance No. 1672; an             ordinance of the City of Butler amending Chapter 232 – Streets and Sidewalks;           Article II; Snow and Ice Removal; § 232-5; Violations and Penalties.  Second by      CW Kline.  All voted aye.

 

9.        Motion for the introduction and first reading of City Ordinance No. 1673; an             ordinance of the City of Butler amending Chapter 248 – Vehicles, Junked; § 248-            7; Violations and Penalties.  Second by CM Schontz.  All voted aye.

 

10.       Motion to accept the bid from Kelly Chevrolet-Cadillac-Oldsmobile, Inc. in the           amount of $47,800.00 for the purchase of (3) three police cruisers.  Second by CW Guard.  All voted aye.

 

 

The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for February, 2013.

  • On March 1, 2013, Sara Pellegrini was appointed as First Deputy Treasurer. 

 

In the absence of the City Controller, the City Clerk presented bills for payment as follows: from the general fund – $182,733.84; from the capital projects fund – $10,201.50; and, from the liquid fuels tax fund – $643.15 for a grand total of $193,578.49. Motion by Mayor Stock with second from CW Kline to approve payment of bills as presented.  All voted aye.
