The following actions took place at the City’s Forum Meeting held on December 18, 2012:

City Council, acting as the Board of Health, and under the provisions of the Third Class City Code, Section XXIII, (b) Abatement of Public Nuisances, Section 2321, found the following subject structures detrimental to public health and order their removal by demolition:

  1. Motion for the second reading and adoption of City Ordinance No. 1664, an Ordinance of the City of Butler amending the exemption schedule for businesses within the City of Butler which would otherwise be subject to the business privilege tax or mercantile tax. Second by CW Kline. All voted aye.

 

  1. Motion for the second reading and adoption of City Ordinance No. 1665, an ordinance of the City of Butler fixing the tax rate for Fiscal Year 2013. Second by CM Schontz. All voted aye.

 

  1. Motion for the second reading and adoption of City Ordinance No. 1666, an ordinance of the City of Butler adopting the annual budget and appropriating specific sums estimated to be required for the specific purposes of the City government as set forth therein during Fiscal Year 2013. Second by CM Schontz. All voted aye.
  2. Motion for the second reading and adoption of City Ordinance No. 1667, an ordinance of the City of Butler fixing the wages and salaries of employees of the City in conformance with the budget for Fiscal Year 2013.   Second by Mayor Stock. All voted aye.

 

5.   Motion to accept a proposal submitted by NexTier Bank for a 2013 Tax Revenue Anticipation Note in the amount of $600,000 at an annual interest rate of 1.48% percent per annum. Second by CM Schontz. All voted aye.

 

6.   Motion for the introduction and first reading of City Ordinance No. 1668, an ordinance of the City of Butler amending part three, chapter 57 (firefighter pension plan) of the codified ordinances of the City of Butler to incorporate plan changes resulting from a settlement agreement between the City of Butler and the International Association of Firefighters, Local 114 dated January 25, 2011. Second by CW Kline. All voted aye.

 

7.   Motion to approve City Resolution No. 2012-12-20; granting the Redevelopment Authority of the City of Butler approval for revisions of CDBG grants for 2009, 2010, 2011 and 2012 programs. Second by Mayor Stock. All voted aye.

8.   Motion to switch the City’s telephone service from Consolidated Communications to the Armstrong Group of Companies beginning January, 2013. Second by CW Scott. All voted aye.

     9.   Motion to reappoint John Evans to the Butler Transit Authority for a five year term which expires December 31, 2017. Second by CW Scott. All voted aye.

 

10.  Motion to install 2 stop signs on School Street at the intersection of School and Peach Streets on a 90-day trial basis. Second by CW Scott. All voted aye.

 

11. Motion to reappoint John Mossman to the BAMM Plan for a five year term which expires January 1, 2018. Second by CW Scott. All voted aye.

12.   Motion to reappoint Robert Cupps to the City of Butler Parks, Recreation Grounds & Facilities Authority for a five year term ending January 1, 2018. Second by CW Scott. All voted aye.

 

13.   Motion to accept the resignation from Perry O’Malley from the City of Butler Parks, Recreation Grounds & Facilities Authority whose term expires January 1, 2016. Second by CM Schontz. All voted aye.

 

14. Motion to accept the Act 111 Interest Arbitration Award for the City of Butler   Bureau of Police, Fraternal Order of Police, Lodge #32. Second by CW Kline. All voted aye.

15. Based on recommendation from his chain of command and satisfactory completion of    his probationary period, motion to grant permanent employment status as of December 5, 2012 to Patrol Officer Caleb Forsythe. Second by CM Schontz. All voted aye.

16. Motion to approve City Council’s 2013 meeting schedule, a copy of which will be published in a local newspaper to comply with the Sunshine Act and attached to the minutes of this meeting. Second by CW Scott. All voted aye.

17. Motion to appoint Robert Swartz to the Butler Area Sewer Authority for a five year term which expires December 31, 2017. Second by CW Kline. CW Scott, CW Kline and CM Schontz voted aye. Mayor Stock voted no.

The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for November, 2012.

Beginning January 1, 2013, the monthly parking permits are nonrefundable.

The City Clerk in absence of the City Controller presented bills for payment as follows: from the general fund – $278,198.79 from the capital projects fund – $39,346.83; and, from the liquid fuels tax fund – $27,626.00 for a grand total of $345,171.62. Motion by Mayor Stock with second from CM Schontz to approve payment of bills as presented. All voted aye.
