    Mayor Dandoy called the meeting to order at 7:00 PM.  Mayor Dandoy and Council members Shearer, and Christy were present. The pledge of allegiance to the flag followed an invocation given by Reverend Yurii Bobko, Sts. Peter and Paul Ukrainian Orthodox Church.

    Mayor Dandoy made the following statement prior to introducing Reverend Yurii Bobko:  Quite often events take place in this world that seem distance and of little concern to the residents of this city.  However, it is always important to remember that, although we live in a small town, we are nonetheless members of a global community.  We have neighbors and friends whose lives are greatly impacted by world events.  There are citizens of Butler who trace their heritage and connect their families with the citizens of Ukraine.  With the recent events there in my thoughts, I asked Reverend Yurii Bobko of Sts. Peter and Paul Ukrainian Orthodox Church to offer our invocation tonight as we keep our friends and neighbors and their families in Ukraine in our thoughts and prayers and with our fervent wishes for peace.

    CITY COUNCIL, ACTING AS THE BOARD OF HEALTH, and under the provisions of the Pennsylvania Consolidated Statutes Title 11 Cities; Chapter 123 Public Health; Subchapter B – Public Nuisances Detrimental to Public Health; §12321 Abatement of public nuisances by designated department; finds the following subject structure detrimental to public health and orders its removal by demolition:

    Motion by Mayor Dandoy.  Second by CM Shearer.  All voted aye.

    PRESENTATIONS:

    Mayor Dandoy presented a Proclamation for Retiree John Cyprian, Director of Veterans’ Services and thanked him for his years of service.

    Jim Thompson from Grace @ Calvary Lutheran Church presented the City with a check for $30,000.00 to be designated for parks and recreation children activities.

    Motion by Mayor Dandoy with a second from CM Shearer to approve the agenda for the regular meeting of March 24, 2022.

    Councilman Shearer made a motion to strike motion number 7. Motion to approve the recommendation of our consultant (BidURenergy) and enter into the contract with AEP Energy to be the City’s electrical supplier for a period of 36 months beginning November, 2022 through December, 2025 at a contract rate of $0.06221. (current rate is $0.04936)  (alternate 12 month contract at $0.06765).

    Second by Mayor Dandoy.  All voted aye.

    With above motion stricken, all voted aye to approve the agenda.

    Motion by Mayor Dandoy with a second from CM Shearer to approve the minutes of the regular meeting of February 24, 2022.  All voted aye.

    Motion by Mayor Dandoy with a second from CM Shearer to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works and Parking Department for the month of February. Motion by Mayor Dandoy. Second by CM Christy.  All voted aye.

    Councilman Christy

    1.Motion to install “No Parking Between Signs” at 240 Third Street on a 90-day trial basis. Second by CM Shearer.  All voted aye.

    2.Motion to reappoint John Reddick to the Butler County-City Connoquenessing Creek Flood Control Authority for a four-year term which expires December 31, 2025. Second by Mayor Dandoy.  All voted aye.

    3.Motion to reappoint David Malarkey to the Butler County-City Connoquenessing Creek Flood Control Authority for a four-year term which expires December 31, 2025. Second by Mayor Dandoy.  All voted aye.

    Councilman Shearer

    4.Motion to approve renewing the service agreement for two years from 2Krew Security & Surveillance at a monthly cost of $46.95 for the fire alarm system in the City Building.

    Second by Mayor Dandoy.  All voted aye.

    5.Motion to approve renewing the service agreement for two years from 2Krew Security & Surveillance at a monthly cost of $38.95 for the security alarm system in the Office of the City Treasurer. Second by Mayor Dandoy.  All voted aye.

    6.Motion to re-approve payment to the Shade Tree Commission in the amount of $2,614.39 that represents the adjusted remaining proceeds from the City’s 2021 shade tree tax due to a clerical error. (Total paid to Shade Tree from 2021 tax levy is $6,066.87). LIN 01 455 540. Second by Mayor Dandoy.  All voted aye.

    7.Motion to approve a proposal submitted by Maher Duessel Certified Public Accountants for auditing services for Fiscal Year 2021 through 2023 as outlined in their engagement letter of February 14, 2022, and to authorize the City Clerk to sign said letter on behalf of City Council. Second by Mayor Dandoy.  All voted aye.

    8.Motion to pass City Resolution No. 2022-03-24; authorizing Mayor Dandoy and the City Clerk to sign all documents relating to the Keystone Grant award received by the Butler Area Public Library. Second by CM Christy.  All voted aye.

    9.Motion to approve Joshua A. Carlini’s resignation from the Butler Bureau of Fire effective March 27, 2022.  Second by CM Shearer.  All voted aye.

    10.Motion to reappoint Kerry Dowdy as the city’s Section 504/ADA Officer for 2022.  Second by CM Shearer.  All voted aye.

    11.Motion to reapprove the Residential Anti-Displacement, Acquisition, Demolition and Relocation Assistance Plan applicable to the Community Development Block Grant program. Second by CM Shearer.  All voted aye.

    12.Motion to reapprove the Citizen Participation Plan and Grievance Form; the Citizen Complaint/Grievance Process; and the Minority and Women’s Business Enterprise Action Plan for the City of Butler and Redevelopment Authority of the City of Butler Community Development Block Grant/Home Programs. Second by CM Christy.  All voted aye.

    13.Motion to designate Veronica Walker as the City’s Fair Housing Officer for 2022.  Second by CM Shearer.  All voted aye.

    14.Motion to approve closing Main Street from Diamond Park to Penn Street and W. Penn Street from Main Street to the flagpole in Alameda Park, for the Butler Road Race event, sponsored by Butler County Family YMCA, to be held on Saturday, September 3, 2022, from 8:15 AM until 10:45 AM. Second by CM Christy.  All voted aye.

    15.Motion to approve the temporary closing of N. Washington Street, W. Penn Street, Miller Avenue into Memorial Park, Wick Street and Memorial Park Drive, for the Turkey Trot, sponsored by Butler YMCA, to be held on Saturday, November 5, 2022, from 8:00 AM until 11:30 AM. Second by CM Shearer.  All voted aye.

    1. Motion to approve the General Release and Settlement Agreement between the City of Butler and Ronald J. Brown, as presented by Insurance Counsel. Second by CM Christy. All voted aye.

    17.Motion to approve agreement with Butler Downtown to operate the Farmers’ Market at the Farmers’ Market facility from May 7, 2022, until October 31, 2022. Second by CM Shearer.  All voted aye.

    18.Motion to approve recording of Environmental Covenant for properties with County Parcel Identification numbers.: 561-37-8B-0000, 561-39-1AC-0000, 561-39-1A-0000 as reviewed by the solicitor. Second by Christy.  All voted aye.

    19.Motion to approve recording of Environmental Covenant for properties with County Parcel Identification number 561-37-1AA-0000 as reviewed by the solicitor. Second by CM Christy.  All voted aye.

    20.Motion to approve agreement with CGI Communications, Inc. for the Community Video Tour Book. Second by CM Shearer.  All voted aye.

    1. Motion to hire a temporary supervisor through Specialized Staffing for three to six hours per week to oversee and review the daily activities in the treasurer’s office and to address employee questions. Second by CM Shearer. All voted aye.
    2. Motion to enter into an agreement with Zambelli Fireworks Manufacturing Co. the fireworks display for July 4, 2022 (not to exceed $18,500) contingent upon review by the city solicitor. Second by CM Christy. All voted aye.

    The City Treasurer presented a Monthly Intake Report for February 2022.

    The City Controller presented bills for payment as follows: from the general fund – $374,499.57; from the parking fund – $44,274.93; from the capital projects fund – $4,037.60 and from the liquid fuels tax fund – $43,392.48; for a grand total of $701,731.58.  Motion by Mayor Dandoy with second from CM Christy to approve payment of bills as presented.  All voted aye.

    March Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly clean paint brushes in a sink, not outdoors. Properly dispose of excess paints through a household hazardous waste collection program, or donate unused paints to local organizations. Also, sweep and properly dispose of construction debris such as concrete and mortar. Always protect your hands, eyes, and ears when working and touching construction materials containing chemicals. If you are unsure how to properly dispose of construction waste, please contact your local municipality. Never dump anything into the storm sewer system.

    1.Motion to approve a payment in the amount of $229,074.95 to Computershare Trust Company, N. A. for debt service for the City’s 2005 general obligation bonds. (Note: This payment includes principal of $220,000.00 and interest of $9,074.95; due March 1st.)   Second by CM Herr.  All voted aye.

    2.Motion to accept the proposal from NexTier Bank for a general obligation loan of $409,600.00 for 2022 Police and Parks Department vehicle, paving and streets department garage improvements with an interest rate of 3.22% per annum. Second by CM Herr.  All voted aye.

    3.Motion to approve a proposal submitted by Caruso & Spencer, PC, Certified Public Accountants for monthly auditing services for Fiscal Year 2022 as outlined in their engagement letter of January 20, 2022 and to authorize the City Clerk to sign said letter on behalf of City Council.  Second by CM Walter.  All voted aye.

    4.Motion to approve payment to the Butler Area Public Library in the amount of $31,826.46 that represents the proceeds from the City’s 2021 library tax.

    5.Motion to approve payment to the Shade Tree Commission in the amount of $149.34 that represents the remaining proceeds from the City’s 2021 shade tree tax.    LIN 01 455 540.  Second by CM Christy.  All voted aye.

    6.Motion to approve City Resolution No. 2022-02-24A; a resolution of the City of Butler authorizing the destruction of records maintained by the Office of the City Treasurer pursuant to the Municipal Records Manual of the Commonwealth of Pennsylvania.

    Second by CM Walter.  All voted aye.

    7.Motion to extend the expiration date of the firefighter Lieutenant Certified List from February 6, 2022 to February 27, 2022, as approved by the Civil Service Commission.   Second by CM Herr.  All voted aye.

    1. Motion to approve the promotion of Firefighter Floyd Lohr III to the rank of Lieutenant within the Butler Bureau of Fire, effective February 27, 2022. Second by CM Walter. All voted aye.

    9.Motion to approve the promotion of Firefighter Jeffrey Scott to the rank of Lieutenant within the Butler Bureau of Fire, effective February 27, 2022. Second by CM Walter.  CM Walter, CM Christy, CM Herr and Mayor Dandoy voted aye.  CM Shearer voted no.  Motion passed.

    10.Motion to approve the promotion of Lieutenant Michael Huey to the rank of Captain within the Butler Bureau of Fire, effective February 27, 2022. Second by CM Walter.  All voted aye.

    11.Motion to accept a Fire Company and Emergency Medical Service grant in the amount of $15,000.00 from the Office of the State Fire Commissioner and execute the required grant agreement. Second by CM Herr.  All voted aye.

    12.Motion to approve City Resolution No. 2022-02-24; the City of Butler agrees to comply with the requirements of the Butler County Parks Renovation Program for the purpose of obtaining grant funds for the renovation of Father Marinaro Park. Second by CM Shearer.  All voted aye.

    13.Motion to approve an agreement with the Butler Youth Lacrosse Association to utilize Memorial Park and Father Marinaro Park beginning March 1st and ending June 14th for their Spring Youth Lacrosse Season contingent upon execution of the lease agreement and the receipt of proof of insurance. Second by CM Shearer.  All voted aye.

    14.Motion to approve an agreement between the City of Butler and the County of Butler to provide administration services for the Community Conservation Partnership Program. Second by CM Shearer.  All voted aye.

    16.Motion to approve City Council’s updated 2022 meeting schedule, a copy of which will be published in a local newspaper to comply with the Sunshine Act and attached to the minutes of this meeting.    Second by CM Christy.  All voted aye.

    17.Motion to approve an extension of the 2002 Cooperation Agreement between the City and the Redevelopment Authority of the City of Butler for administration of the City’s Community Development Block Grant Program Funds, HOME Program funds and other State and Federal funds with such extension running through October 1, 2023. Second by CM Walter.  All voted aye.

    18.Motion to approve the grievance settlement and general release agreement subject to the solicitor and city clerk’s approval of final calculations and terms. Second by CM Walter.  All voted aye.

    The City Treasurer presented a Monthly Intake Report for January 2022.

    Berkheimer Tax Innovations will be collecting the 2022 City of Butler Real Estate and Per Capita Tax bills this year.  There will be a few changes with Berkheimer as the Deputy Tax Collector.  The City Per Capita Tax is no longer included on the same bill as the Real Estate.  If you have received a combined  Real Estate and Per Capita Tax Bill in the past, you will receive two (2) bills starting in 2022.  Checks may be payable to HAB-MISC or you may pay your taxes online at WWW.HAB-INC.COM using a credit card. You may also pay by credit card or bank draft by using our Berk APP or by phone at 866-225-8451.  Berkheimer also has an office at 103 S Duffy Road, please check the website at WWW.HAB-INC.COM for office hours.  Berkheimer does not accept cash.  If you have any questions, the Berkheimer Customer Care Department can be reached at 610-599-3143.

    February Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, the Department of Environmental Protection would like to remind local residents to use pesticides, fertilizers, and herbicides properly and efficiently.  Please follow the directions listed on the product.  If not used properly, the fertilizer will wash into a storm sewer, which leads into a waterway without being treated.  The fertilizer then causes algae to grow that uses up oxygen that fish need to survive.

    The purpose of this meeting is to appoint the councilperson to replace the seat vacated by Robert A. Dandoy and other such business as Council members may deem appropriate.

    Mayor Dandoy called the meeting to order at 5:00 PM. Mayor Dandoy and Council members Shearer and Christy were present.

    1.In accordance with the provisions of Section 10801 of the Pennsylvania Consolidated Statutes – Title 11, motion to appoint Daniel G. Herr to the position of City Council to fill the vacancy created by the resignation of Robert A. Dandoy for a term to expire on the first Monday in January 2024.  Second by CM Shearer.  All voted aye.

    (Note:  The next municipal election is in November 2023, and the term of office for the person elected to the position of City Council at that time shall run from January 2024 to January 2028.)  

    2.City Council met immediately after the swearing-in for its reorganization meeting. Mayor Dandoy, Councilman Shearer, Councilman Christy, and Councilman Herr were present.

    2.Motion to direct the City Clerk to advertise an RFP for a small borrowing loan of $409,600.00 for a police vehicle, a parks department truck, repairs to the streets department garage and street paving. The loan is to be payable over a term of two (2) years. Second by CM Shearer.  All voted aye.

    3.Motion for the second reading and adoption of City Ordinance No. 1808, an ordinance of the City of Butler amending Ordinance No. 1641, to add PA Skill Games.  Second by Mayor Dandoy.  All voted aye.

    4.Motion for the second reading and adoption of City Ordinance No. 1809, an ordinance of the City of Butler amending Chapter 232; streets and sidewalks; Article VII; Street use permits for parades and special events; Section 232-45. Second by Mayor Dandoy.  All voted aye.

    5.Motion to award the construction inspection staffing to A & A Consultants at an hourly rate of $29.85 per hour, for the Butler Main Street Streetscape Phase 3 (SMART Grant).   Second by Mayor Dandoy.  All voted aye.

    6.Motion to reappoint Michael Preston to the Butler Code Management Appeals Board for a 5-year term expiring June 2026. Second by CM Walter.  All voted aye.

    7.Motion to appoint Joe Caparosa to the Planning & Zoning Commission for a 4-year term expiring June 2025. Second by CM Shearer.  All voted aye.

    8.Motion to appoint Jill Kraus to the Planning & Zoning Commission for a 4-year term which expires June 2025. Second by Mayor Dandoy.  All voted aye.

    9.Motion to accept the resignation of Larry Christy from the Butler Code Management Appeals Board. Second by CM Shearer.  CM Walter, CM Shearer and Mayor Dandoy voted aye.  CM Christy abstained.  Motion passed.

    10.Motion to approve City Resolution No. 2022-01-27; a resolution of the City of Butler appointing Aaron Bonus and Sharon Snyder as authorized representatives to make requests upon and receive any and all tax information and records from Berkheimer, relative to the collection of taxes for the Taxing Authorities within the Butler County Tax Collection District, as directed and deemed necessary, to be used for official purposes only.  Second by CM Shearer.  All voted aye.

    11.Motion to enter into an agreement with Berkheimer for the collection of “Per Capita Tax” for the period beginning January 1, 2022 and ending December 31, 2024. Second by CM Shearer.  All voted aye.

    12.Motion to approve City Resolution No. 2022-01-27A; a resolution of the governing board of the City of Butler, Butler County, Pennsylvania, authorizing, empowering and directing the proper officers of the governing board to appoint Berkheimer as its Tax Hearing Officer under and pursuant to the local taxpayers bill of rights for the express purpose of adjudicating appeals thereunder. Second by CM Walter.  All voted aye.

    13.Motion to approve City Resolution No. 2022-01-27B; a resolution of the governing board of City of Butler, Butler County, Pennsylvania, authorizing and empowering its local tax collector, Berkheimer, to impose and retain costs of collection on delinquent taxes.  Second by CM Shearer.  All voted aye.

    14.Motion to approve the agreement with County Festivals, LLC to close Main Street from Brady Street to Diamond Street for the Butler Italian Festival event, sponsored by County Festivals, beginning at 5:00 PM, August 26, 2022, and ending at 6:00 PM, August 28, 2022. Second by CM Christy.  All voted aye.

    15.Motion to approve the Confidentially Agreement between the City of Butler, Butler Township, the Butler Area Sewer Authority and Pennsylvania-American Water Company, as submitted by the Solicitor.  Second by CM Shearer.  All voted aye.

    The City Treasurer presented a Monthly Intake Report for December 2021.

    The City Controller presented bills for payment as follows: from the general fund – $509,177.36; from the parking fund – $47,565.02; from capital projects fund – $2,770.75 and from the liquid fuels tax fund – $15,294.77; for a grand total of $810,334.90.  Motion by Mayor Dandoy with second from CM Shearer to approve payment of bills as presented.  All voted aye.

    January Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to ensure that local residents are aware of the two types of systems that are within Butler City and the other local municipalities. The one system is the sanitary sewer system, in which toilets, sinks and garbage disposals are all connected and flow into a treatment facility that removes all of the contaminants and then discharges clean water into a local waterway. The storm sewer system is made up of catch basins that are usually placed along curbs in streets and parking lots and direct stormwater runoff through a series of pipes directly into the local waterway. Please be aware that there is no treatment for stormwater, so do not dump anything into the storm sewer catch basins. If you are unsure about the proper disposal of any type of waste material, please contact your local municipality.

    • Businesses are reminded that the sidewalks are the property owner’s responsibility. Please keep them shoveled and also please try to keep the street meters cleared of snow.
    • City Council is looking for someone interested in filling the seat of City Council for a period of two years until the next municipal election. Preference is a candidate with a financial background. All letters of interest should be addressed to the attention of Mayor Dandoy and either mailed or delivered to the city building by noon on February 1, 2022.
