    Mayor Smith called the meeting to order at 7:00PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Pastor Jake Klutinoty, North Street Christian Church.   

    Mayor Smith recessed the meeting for an executive session meeting to discuss collective bargaining. The meeting reconvened at 7:08PM.  

    Motion by Mayor Smith to approve the agenda for the regular meeting of November 9, 2021.   Second by CM Dandoy.  All voted aye.

    Motion by Mayor Smith to approve the minutes regular meeting of October 28, 2021.  Second by CM Bonus.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1.Motion to approve payment to USBank in the amount of $325,093.77 for the bond payment due on the 2015 General Obligation Bonds as follows:

    LIN 01 472 801 Principal $225,000.00           LIN 01 472 800 Interest $100,093.77

    Second by Mayor Smith.  All voted aye.

    2.Motion to approve the Tentative Agreement by and between the City and AFSCME, Local No. 757, for the duration effective January 1, 2022 and terminating on December 31, 2024.  Second by CM Dandoy.  All voted aye.

    3.Motion to approve City Resolution No. 2021-11-09, a resolution to utilize funds received from the COVID-19 ARPA Local Fiscal Recovery Funds Program, to cover a portion of lost revenue from 2020 for general government services. Second by CM Bonus.  All voted aye.

    Councilman Smith

    4.Motion for the second reading and adoption of City Ordinance No. 1802; an ordinance of the City of Butler, Pennsylvania amending Chapter 198; Playgrounds of the codified ordinance of the City of Butler. Second by CM Walter.  All voted no.  Motion failed.

    5.Motion to direct the city clerk to advertise for bids for the painting and sealing of the Ritts Park Pickleball Courts in Ritts Park.  (Ritts Park Greenways and Trails Grant). Second by Mayor Smith.  All voted aye.

    6.Motion to approve the bid of Gargiulo Landscape for the planting of 16 trees at Ritts Park for $9,058.66.  (Ritts Park Greenways and Trails Grant). Second by CM Walter.  All voted aye.

    Councilman Bonus

    7.Motion to approve bids submitted by and award the Fiscal Year 2022 contract for supply of the City’s asphalt materials to:

    Wiest Asphalt Products & Paving Inc. as follows:

    9.5MM Superpave Wearing Course FOB; $67.00 per ton and 19MM Superpave FOB; $58.00 per ton. Total Contract: $50,000.00.

    Russell Standard Corporation as follows:

    E-3 Emulsion Placed; $2.90/gallon; Total Contract: $7,250.00.

    Second by Mayor Smith.  All voted aye.

    8.Motion to approve a bid submitted by and award the Fiscal Year 2022 contract for supply of the City’s limestone materials to Allegheny Mineral Corporation as follows:

    Unit Price Delivered at Job Site: #2A – $18.50 per ton; #4 – $19.90 per ton; #8 – $25.40 per ton; #57 – $19.65 per ton.     Total Contract: $83,450.00.   Second by Mayor Smith.  All voted aye.

    9.Motion to approve the request from Butler Radio Network for the use of the Main Street Lot on November 27th for the Annual Spirit of Christmas Parade. Second by CM Dandoy.  All voted aye.

    10.Motion to accept the resignation of Patrol Officer Dakota Fennell from the Butler City Police Department effective November 12, 2021. Second by CM Walter.  All voted aye.

    11.Motion to accept the resignation of Sara Pellegrini from her temp position as of October 1, 2021. Second by CM Walter.  All voted aye.

    12.Motion to approve closing of E. Diamond Street from Main Street to McKean Street on Friday, February 11, 2022, and the closing of Main Street from Wayne Street to Cunningham Street, and Diamond St. from Washington Street to McKean Street on Saturday, February 12, 2022, for the Carved in Ice event, sponsored by Butler AM Rotary Club. Second by CM Walter.  CM Bonus abstained.  CM Walter, CM Smith, CM Dandoy and Mayor Smith voted aye.

    1. Motion to approve City Resolution No. 2021-11-09A, a resolution appointing Berkheimer as its Deputy Tax Collector of Real Estate Taxes for the City of Butler. Second by CM Walter. All voted aye.

    ANNOUNCEMENTS:

    Emily Landon will replace Emily Herndon on the Shade Tree Commission with a term ending June 2023.

    Carol Means will replace Lawrence Herndon on the Shade Tree Commission with a term ending June 2023.

    The City Controller presented bills for payment as follows: from the general fund – $199,034.25; from the parking fund – $6,988.43 from the capital projects fund – $0; and from the liquid fuels tax fund – $2,233.02; for a grand total of $208,255.70.  Motion by Mayor Smith with second from CM Dandoy to approve payment of bills as presented.  All voted aye.

    Motion by Mayor Smith with a second from CM Dandoy to approve the agenda for the regular meeting of October 28, 2021.  All voted aye.

    1.Motion to direct the City Clerk to release a request for proposals for a Tax Revenue Anticipation Note in the amount of one-million dollars for Fiscal Year 2022. Second by Mayor Smith.  All voted aye.

    2.Motion to approve an agreement with the Butler Area School District to utilize the Broad Street School Playground as a City Playground. Second by Mayor Smith.  All voted aye.

    3.Motion to approve City Resolution No. 2021-10-28; a DCNR Grant Resolution Page for the Broad Street School Playground project. Second by CM Walter.  All voted aye.

    4.Motion for the introduction and first reading of City Ordinance No. 1803; an ordinance of the City of Butler amending Chapter 232; Streets and Sidewalks; Article VII, street use permits for parades and special events of the codified ordinances of the City of Butler. Second by CM Walter.  All voted aye.

    5.Motion for the introduction and first reading of City Ordinance No. 1804; An ordinance of the City of Butler, Pennsylvania to repeal Chapter 198; Playgrounds and replace Chapter 198 with Butler City Parks and Playgrounds of the codified ordinances of the City of Butler.     6.Motion to purchase a seven-station outdoor fitness equipment package from Sports and Recreation Associates not to exceed $7,150.00 as part of the Ritts Park Greenways and Trails Grant. Second by Mayor Smith.  All voted aye.

    7.Motion to purchase security cameras for Memorial Park for $5,895 from Secure Technical Solutions. Second by Mayor Smith.  All voted aye.

    8.Motion to install a “No Parking Here to Corner” sign on the south side of Negley Avenue at the intersection of South Chestnut Street on a 90-day trial basis.  Second by CM Walter.  All voted aye.

    9.Motion to approve a block party on West Pearl Street, from North Church Street to North Washington Street on Saturday, October 30, 2021, from 6:00 PM to 11:00 PM. Second by CM Dandoy.  All voted aye.

    10.Motion to install a “Handicapped Parking Only” sign at 318 South Main Street on a 90-day trial basis. Second by CM Walter.  All voted aye.

    11.Motion to approve the City’s participation with the Butler Area Public Library and give authorization to Mindy Gall, City Clerk for the submission of the Keystone Grant on behalf of the City of Butler. Second by Mayor Smith.  All voted aye.

    12.Motion to appoint Nicolas Landon to the Planning & Zoning Commission for a four-year term which expires June 30, 2025. Second by CM Bonus.  CM Walter and CM Dandoy voted no.  CM Smith, CM Bonus and Mayor Smith voted aye.  Motion approved.

    13.Motion to grant the appeal and approve the temporary closing of N. Washington Street, W. Penn Street, Miller Avenue into Memorial Park, Wick Street and Memorial Park Drive, for the Turkey Trot, sponsored by Butler YMCA, to be held on Saturday, November 16, 2021, from 8:00 AM until 11:30 AM. Second by CM Bonus.  All voted aye.

    14.Motion to permit Butler Downtown to reserve the North Main Parking lot on the following Fridays in 2022; May 20th, June 17th, July 15th, and August 19th for the Foodie Friday events. Second by CM Bonus.  All voted aye.

    The City Treasurer presented a Monthly Intake Report for September 2021.

    The City Controller presented bills for payment as follows: from the general fund – $210,197.03; from the parking fund – $32,071.04; from the capital projects fund – $37,178.95 and from the liquid fuels tax fund – $1,358.17; for a grand total of $280,805.19.  Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented.  All voted aye.

    October Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly clean paint brushes in a sink, not outdoors. Properly dispose of excess paints through a household hazardous waste collection program, or donate unused paints to local organizations. Also, sweep and properly dispose of construction debris such as concrete and mortar. Always protect your hands, eyes, and ears when working and touching construction materials containing chemicals. If you are unsure how to properly dispose of construction waste, please contact your local municipality. Never dump anything into the storm sewer system.

    1.Motion to approve distribution of 2021 State Aid for pension plans as follows:  to the Firefighters Pension Plan – $248,691.13, to the Police Pension Plan – $181,337.28 and to the Officers’ & Employees’ Pension Plan – $88,078.11, with the total amount of 2021 State Aid distributed to pension plans being $518,106.52.   Second by Mayor Smith.  All voted aye.

    2.Motion to approve payment from the General Fund for pension plans as follows: to the Firefighters Pension Plan – $91,379.87; to the Police Pension Plan – $190,873.72; and to the Officers’ & Employees’ Pension Plan – $6,882.89, with the total amount being $289,136.48 to satisfy the 2021 MMOs.  Second by Mayor Smith.  All voted aye.

    3.Motion to approve the 2022 Municipal Benefits Services renewal. Second by Mayor Smith.  All voted aye.

    4.Motion to approve a payment in the amount of $214,592.82 to the County of Butler for debt service for the Butler County Infrastructure Loan Payment. (Note: This payment includes principal payment of $218,000.00 less “Amount on Hand” $8,379.98; due November 1st.)  Second by Mayor Smith.  All voted aye.

    5.Motion for the second reading and adoption of City Ordinance No. 1801; an ordinance of the City of Butler, Pennsylvania amending chapter 192; Peace and Good Order of the codified ordinances of the City of Butler by adding Article IX, Disorderly Conduct and/or Disruptive Activities, Parks and Recreational Grounds.     7.Motion for the second reading and adoption of City Ordinance No. 1800, an ordinance of the City of Butler, Pennsylvania amending the City’s traffic control schedules contained in Chapter 245 of the codified ordinances of the City of Butler by making permanent the experimental regulations previously adopted by city council on a 90-day trial basis.  Second by Mayor Smith.  All voted aye.

    8.Motion to approve a block party on West Fulton Street, from 219 West Fulton Street to 229 West Fulton Street on Friday, October 29, 2021 from 4:00 PM to 10:00 PM. Second by Mayor Smith.  All voted aye. 

    9.Motion to accept a proposal and award a contract to Bruce-Merrilees Electric Company, New Castle, Pennsylvania, for traffic signal repairs for 2022 and 2023.   Second by Mayor Smith.  All voted aye.

    10.Motion to make the final payment in the amount of $491,920.98 to Glick Fire Equipment Company for the 2021 Pierce 100’ Mid Mount Tower mounted on an Arrow XT chassis (VIN: 4P1BCAGF2MA023402).  (Final loan disbursement $468,370.51.   $23,550.47 to be paid from general fund using various donations, grants, etc.) Second by Mayor Smith.  All voted aye.

    12.Motion to approve closing Main Street from Brady Street to Cunningham Street, for the American Bantam Austin Conference, sponsored by Butler County Tourism & Convention Bureau, to be held on Wednesday, June 29, 2022 from 4:00 PM until 8:00 PM.  Second by CM Dandoy.  All voted aye.

    13.Motion to grant the appeal and approve closing Main Street from West Pearl Street to Wayne Street, for the Veterans Day Parade, sponsored by Butler County Veterans Committee, to be held on Thursday, November 11, 2021 from 10:15 AM until 12:15 PM.  Second by CM Dandoy.  All voted aye.

    16.Motion to approve, and authorize the Mayor and City Clerk to sign, a Subordination of Mortgage agreement related to Evolution Properties, AG, LLC and its loan with the City of Butler’s Revolving Loan fund.  (The original mortgage is recorded at Instrument No. 201104200009590, dated April 20, 2011.  This mortgage is subordinate to a mortgage with First Commonwealth Bank via a Subordination of Mortgage agreement approved by the City and records at Instrument No. 201112300032616, dated December 30, 2011, so the City’s position will not change.) Second by CM Dandoy.  All voted aye.

    1.Motion to approve the 2022 Minimum Municipal Obligations for the City’s three pension plans as follows:  for the Firefighters Pension Plan – $344,100 and for the Police Pension Plan – $400,190 and the Officers and Employees Pension Plan – $97,541.  Second by Mayor Smith.  All voted aye.

    2.Motion to approve payment to the Shade Tree Commission in the amount of $3,452.48 that represents the proceeds from the City’s 2021 shade tree tax.    LIN 01 459 540.  Second by Mayor Smith.  All voted aye.

    3.Motion to approve an agreement with the 2024 CAN-AM POLICE-FIRE GAMES, GAMES ORGANIZING COMMITTEE.  Second by CM Walter.  All voted aye.

    4.Motion to direct the Board of the Butler Area Sewer Authority (BASA) to explore options for the potential purchase of the BASA system and assets to a third party, and to cooperate fully with requests incidental to the same. Second by CM Dandoy.  All voted aye.

    5.Motion to direct the solicitor to work with the Chief of Police and the Safety Committee as described in Section 232-45 of the Butler City Code to update and revise Article VII of the Butler City Code to make it more understandable and responsive to community needs. Second by Mayor Smith.  All voted aye.

    Councilman Dandoy

    6.Motion to exempt the Sullivan Run Flood Control Project contractors from the noise ordinance from 6:00 am to 6:00 pm until the completion of the project.  Second by Mayor Smith.  All voted aye.

    7.Motion to approve the promotion of part-time Firefighter David Greco to the position of full-time Firefighter within the Butler Bureau of Fire as part of the Staffing for Adequate Fire and Emergency Response (SAFER) Grant program, effective September 26, 2021.  Second by Mayor Smith.  All voted aye.

    8.Motion to approve the promotion of part-time Firefighter Joshua Abbott to the position of full-time Firefighter within the Butler Bureau of Fire as part of the Staffing for Adequate Fire and Emergency Response (SAFER) Grant program, effective October 10, 2021. Second by Mayor Smith.  All voted aye.

    9.Motion to approve Pennsylvania Heart & Lung Act benefits for Patrol Officer Marc Howard beginning on September 13, 2021, for a work-related injury he sustained on August 23, 2021. Second by CM Dandoy.  All voted aye.

    September Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly dispose the leaves on your property and not brush/sweep dirt, leaves, etc. into any storm drain or onto any street. Either place the leaves and dirt on a compost pile, or contact your local municipality for “leaf collection” days or to see what programs your municipality offers for the disposal of yard waste. Remember, the purpose of the storm sewers is to direct stormwater runoff to the local streams. If the system is clogged from garbage, yard waste and dirt, then flooding may occur during a large rainfall event.

    7.Motion to accept the bid from Stephen Yarina in the amount of $8,900.00 for one 2003 Mobile Concepts by Scotty 35′ trailer, model SA-35BleacherFH  (VIN 1SSTT35T4311SS759).  Second by Mayor Smith.  All voted aye.

    8.Motion to approve the retirement of Lieutenant James A. Reeder, from the Butler Bureau of Fire, following 15 years of service, effective September 11, 2021.  Second by Mayor Smith.  All voted aye.

    9.Motion to approve the retirement of Captain Scott A. Marshall, from the Butler Bureau of Fire, following 30 years of service, effective September 11, 2021.  Second by Mayor Smith.  All voted aye.

    10.Motion to accept the bid from David J. Veneziano in the amount of $3,507.00 for one used 2010 Dodge Dakota Crew Cab ST 4×4 from the City’s Bureau of Police that is surplus to the needs of the Police Department. Second by CM Bonus.  All voted aye.

    In the absence of the City Controller, the City Clerk presented bills for payment as follows: from the general fund – $197,882.99; from the parking fund – $4,563.66; from the capital projects fund – $2,645.12; and from the liquid fuels tax fund – $26,127.17; for a grand total of $231,218.94.  Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented.  All voted aye.

    September 25th – Butler Downtown will meet with volunteers at 8:00 AM for the annual Main Street clean-up day.

    Duane Stiefel voiced concerns about the appearance of the City, due to high grass and rubbish at residents’ homes.

    Pete Zura voiced concerns over the noise from motor bikes on Mercer street, as well as disturbances from a rooster.

    Mark Krenitsky voiced concerns over his dislike of Zoom meeting and rubbish.  He suggested metered parking on Main Street.  Mr. Krenitsky is concerned about ‘bad’ houses that need to be torn down and flood control.  He feels the City should promote Covid vaccinations.

    Denny Offstein was thankful for the opportunity to purchase the truck.
