    Mayor Smith called the meeting to order at 7:03 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Lay Pastor Kerry M. Dowdy, East Butler Presbyterian Church.                                                                             

    CITY COUNCIL, ACTING AS THE BOARD OF HEALTH, and under the provisions of the Pennsylvania Consolidated Statutes Title 11 Cities; Chapter 123 Public Health; Subchapter B – Public Nuisances Detrimental to Public Health; §12321 Abatement of public nuisances by designated department; finds the following subject structure detrimental to public health and orders its removal by demolition:

    Motion by Mayor Smith.  Second by CM Bonus.  All voted aye.

    Motion by Mayor Smith to approve the agenda for the regular meeting of June 10, 2021.   Second by CM Dandoy.  All voted aye.

    Motion by Mayor Smith to approve the minutes regular meeting of May 27, 2021.  Second by CM Dandoy.

    Mayor Smith made a motion to correct the motion for the introduction and first reading of City Ordinance No. 1799 as follows due to a clerical error:

    Motion for the introduction and first reading of City Ordinance No. 1799; an ordinance increasing the indebtedness of the City of Butler, Butler County, Pennsylvania by the issue of a General Obligation Note in the amount of $1,329,763.00 for the purpose of purchasing of a 2021 Pierce Arrow XT 100’ Mid-Mount Tower Ladder Truck.  Second by CM Walter.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1. Motion for the second reading and adoption of City Ordinance No. 1799; an ordinance increasing the indebtedness of the City of Butler, Butler County, Pennsylvania by the issue of a General Obligation Note in the amount of $1,329,763.00 for the purpose of purchasing of a 2021 Pierce Arrow XT 100’ Mid-Mount Tower Ladder Truck. Second by Mayor Smith. All voted aye.

    Councilman Dandoy

    1. Motion to approve Amendment A of the sales agreement with Glick Fire Equipment Company, Inc. for a 2021 Pierce Arrow XT 100’ Mid-Mount Tower Ladder. Second by Mayor Smith. All voted aye.
    2. Motion to approve Pennsylvania Heart & Lung Act benefits for Captain Kevin E. McAfee beginning on May 23, 2021, for a work-related injury he sustained on May 22, 2021. Second by Mayor Smith. All voted aye.

    1. Motion to waive all fees for construction permits (street opening and sidewalk) from the City of Butler for the Sullivan Run Flood Control Project, sponsored by Pa DEP. Second by CM Bonus. All voted aye.
    2. Motion to approve Pennsylvania Heart & Lung Act benefits for Sergeant Jeremy Walters beginning on May 10, 2021, for a work-related injury he sustained on May 5, 2021. Second by CM Dandoy. All voted aye.
    3. Motion to approve closing Main Street from Wayne Street to West Pearl Street, for the Cruise-A-Palooza event, sponsored by the Rodfathers of Butler, to be held on Sunday, August 15, 2021 from 9:00 AM until 6:00 PM. Second by CM Bonus. All voted aye.
    1. Motion to approve the License Agreement with 437 North Main Street LP for the installation of an awning along West Fulton Street. Second by CM Dandoy. All voted aye.
    2. Motion to approve the request from Butler Downtown to hold a Yoga and Brews event on the Centre City Garage roof, Saturday, July 17, 2021 beginning at 7:00 PM until 10:30 PM. Second by CM Bonus. All voted aye.

    The City Controller presented bills for payment as follows: from the general fund – $198,466.33; from the parking fund – $4,371.35; from the capital projects fund – $286.00 and from the liquid fuels tax fund – $1,234.95; for a grand total of $204,358.63.  Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.

    Mayor Smith called the meeting to order at 7:00 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Rev. Leigh Benish, Hill United Presbyterian Church.                   

    Motion by Mayor Smith with a second from CM Dandoy to approve the agenda for the regular meeting of May 27, 2021.

    Councilman Walter made a motion to add a motion to terminate the agreement with Huntington Capital Markets as underwriters for the 2015 Series-B bond refinancing.  Second by Mayor Smith.  All voted aye.

    Councilman Walter made a motion to add a motion to approve payment to the Commonwealth of Pennsylvania, in the amount of $12,232.01.  This represents overpayment of state aid with interest to be returned per the Compliance Audit Report for the period January 1, 2018 to December 31, 2019.  Second by CM Dandoy.  All voted aye.

    Councilman Smith made a motion to add a motion to direct the city clerk to advertise the position of Grants Coordinator with an annual wage of $55,000.  Second by Mayor Smith.  All voted aye.

    Councilman Smith made a motion to add a motion to direct the city clerk to advertise on Municibid the sale of 130 hanging baskets at a cost no less than $2,500.00 for the lot.  Second by Mayor Smith.  All voted aye.

    All voted aye.  Agenda amended.

    Motion by Mayor Smith with a second from CM Walter to approve the minutes of the regular meeting of May 6, 2021.  All voted aye.

    Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works, and Parking Department for the month of April. Motion by Mayor Smith. Second by CM Walter.  All voted aye.

    1.Motion to pass City Resolution No. 2021-05-27; authorizing Mayor Smith to sign the Reimbursement Agreement and further authorizing the mayor to sign, on behalf of City Council, all documents pertaining to the Receptacles to be mounted on the Traffic Signal Poles as part of the SR 8 Signals Project.  Second by Mayor Smith.  All voted aye.

    5.Motion to reappoint William May to the Bicycle Advisory Commission for a four-year term which expires on January 1, 2022. Second by CM Dandoy.  CM Walter, CM Bonus and CM Dandoy voted aye.  CM Smith and Mayor Smith voted no.

    6.Motion to appoint Josh Gilliland to the Bicycle Advisory Commission for a four-year term which expires on January 1, 2024. Second by CM Dandoy.  All voted aye.

    10.Motion to approve an agreement with the Butler Midget Football League for the 2021 season. Second by CM Walter.  All voted aye.

    11.Motion to approve a community event to be held at Father Marinaro Park on June 26, 2021 by the South Side Park Group and to approve the South Side Park Group’s request to host a beer garden as part of that event. Second by CM Bonus.  All voted aye.

    12.Motion to authorize the city clerk to sign Letter or Attestation and Offer Letter from First Energy for the LED Lighting Project by Hercules at the Farmer’s Market. Second by Mayor Smith.  All voted aye.

    13.Motion to add a motion to direct the city clerk to advertise the position of Grants Coordinator with an annual wage of $55,000.  Second by Mayor Smith.  CM Walter, CM Bonus and CM Dandoy voted no.  CM Smith and Mayor Smith voted aye.  Motion not passed.

    Councilman Bonus

    1. In response to a request from the Butler Area School District, motion to approve, on a 90-day trial basis, an amendment to the City’s Traffic Control Schedule by establishing Broad Street as a one-way street in a southerly direction from its intersections with West Brady Street and West New Castle Street in the vicinity of the Broad Street School with an effective date of August 1, 2021. Second by Mayor Smith. All voted aye.

    Councilman Dandoy

    16.Motion to approve the conditional hiring of four (4) part-time firefighters from the 2021 Civil Service Examinations Certified List.   Second by Mayor Smith.  All voted aye.

    17.Motion to make a prepayment in the amount of $427,282.51 to Glick Fire Equipment Company for the Chassis for the Pierce 100’ Mid Mount Tower on an Arrow XT.  Second by CM Walter.  All voted aye.

    1. Motion to accept a Fire Company and Emergency Medical Service grant in the amount of $14,015.70 from the Office of the State Fire Commissioner and execute the required grant agreement. Second by CM Walter. All voted aye.

    Mayor Smith

    19.Motion to approve closing East Diamond Street from South Main Street to South McKean Street, for the Christmas in July event, sponsored by Butler Downtown, to be held on Saturday, July 24, 2021 from 9:00 AM until 6:00 PM.  Second by CM Bonus.  All voted aye.

    20.Motion to approve the updated Reimbursement Agreement for the Receptacles to be mounted on the Traffic Signal Poles as part of the SR 8 Signals Project.  Second by CM Walter.  All voted aye.

    21.Motion to approve an agreement with County Festivals, LLC for the Butler Italian Festival to be held from 5:00 PM on August 27, 2021 through 6:00 PM on August 29, 2021. Second by CM Dandoy.  All voted aye.

    The City Treasurer presented a Monthly Intake Report for April 2021.

    The City Controller presented bills for payment as follows: from the general fund – $618,677.65; from the parking fund – $128,845.28; from the capital projects fund – $12,870.72 and from the liquid fuels tax fund – $3,510.06; for a grand total of $763,903.71.  Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented.  All voted aye.

    May Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to please use pesticides and fertilizers sparingly on their lawns. When necessary, use these chemicals in their recommended amounts. Avoid applying chemicals if rain is in the forecast because the rain will wash all of the chemicals off the lawn area into the storm sewers and into the local streams. Don’t over-water your lawns and if you are going to water, do it during the cool times of the day and don’t let the water runoff into the streets.

    Also, check your cars, boats, lawn mowers, and other machinery and equipment for leaks and spills. Make repairs as soon as possible, and clean any spills up with an absorbent type material such as kitty litter or sand. Do not rinse any spills into the streets or storm sewers. This will go directly into local streams.

    Mayor Smith called the meeting to order at 7:02 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Rev. John C. R. Silbert, Covenant Presbyterian Church.                                       

    PRESENTATION – Vanessa Boyd, Principal, Broad Street School, spoke about the reopening of Broad Street Elementary School.  Vanessa is looking forward to being a part of the community.

    Motion by Mayor Smith to approve the agenda for the regular meeting of May 6, 2021.   Second by CM Bonus.

    Motion by Mayor Smith to add a Motion to approve the Butler Downtown Revolving Loan Committee’s request to permit the Gray’s to refinance their loan at a new rate of 2.375%. The Gray’s will be responsible for all attorney’s fees assessed and determined by the City Solicitor for document production and closing as well as a one-time loan modification fee of $250 to be paid to the Revolving Loan Funds principal account.  Second by CM Bonus.  All voted aye.

    2.Motion to write a letter of support to the Butler Rotary Club for their proposed Arts District project. Second by CM Bonus.  All voted aye.

    3.Motion to approve the agreement with the County of Butler for the County of Butler, Park Renovation Grant Program. Second by CM Dandoy.  All voted aye.

    4.Motion to approve 2021 Father Marinaro Softball Agreement for Father Marinaro Park. Second by CM Bonus.  All voted aye.

    5.Motion to install a “No Parking Here to Corner” sign on the north side of Draper Avenue at the intersection with Eola Street on a 90-day trial basis.   Second by CM Walter.  All voted aye.

    6.Motion to accept the resignation of James L. Diamond, P.E. from the Code Management Appeals Board effective immediately. Second by Mayor Smith.  All voted aye.

    7.Motion to appoint Marlene Myers, Architect, to Code Management Appeals Board for the remainder of term of James L. Diamond effective immediately and ending June, 2024. Second by Mayor Smith.  All voted aye.

    8.Motion to appoint Maggie Stock to a full term on the Zoning Hearing Board beginning July 1, 2021 and ending June, 2024. Second by Mayor Smith.  All voted aye.

    9.Motion to appoint Thomas Graham to the Civil Service Commission Board for a term ending December, 2024. Second by Mayor Smith.  All voted aye.

    10.Motion to approve Pennsylvania Heart & Lung Act benefits for Captain James Hollobaugh beginning on April 27, 2021 for a work-related injury he sustained on April 7, 2021. Second by CM Walter.  All voted aye.

    11.Motion to appoint Mike Walter as the Butler City Council of Governments voting representative. Second by CM Dandoy.  CM Walter abstained.  CM Smith, CM Bonus, CM Dandoy and Mayor Smith voted aye.

    12.Motion to appoint Bob Dandoy as the City’s liaison to the Butler Rotary Club Arts District Committee to provide a communications channel from the Committee to City Council and to facilitate their efforts. Second by CM Walter.  CM Walter, CM Smith, CM Bonus and Mayor Smith voted aye.  CM Dandoy abstained.

    13.Motion to approve the settlement agreement between the City of Butler and John J. Jackson. Second by CM Bonus.  All voted aye.

    14.Motion to approve closing Main Street from West Pearl Street to Wayne Street, for the Butler Bikes and BBQ event, sponsored by Butler County Tourism & Convention Bureau, to be held on Thursday, July 22, 2021 from 4:00 PM until 8:00 PM. Second by CM Bonus.  All voted aye.

    15.Motion to approve the Butler Downtown Revolving Loan Committee’s request to permit the Gray’s to refinance their loan at a new rate of 2.375%. The Gray’s will be responsible for all attorney’s fees assessed and determined by the City Solicitor for document production and closing as well as a one-time loan modification fee of $250 to be paid to the Revolving Loan Funds principal account. Second by CM Dandoy.  All voted aye.

    Mayor Smith called the meeting to order at 7:01 PM.  Mayor Smith and Council members Walter, Smith, and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Pastor Mary Kitchen, East Butler Presbyterian Church.                   

    PRESENTATION:    

    Leslie Osche, Butler PM Rotary presented to a proposal to create the Arts and Cultural District.  The proposed district would extend from Jefferson Street to East Fulton Street, and Washington Street to McKean Street.  Art banners, to designate the district, would be placed on electric poles.

    Motion by Mayor Smith with a second from CM Walter to approve the agenda for the regular meeting of April 22, 2021.

    Mayor Smith stated that all appointments to boards and authorities would be motions made by him.  Council agreed to table any motions until the next council meeting on May 6, 2021. All voted aye.  Agenda approved.

    Motion by Mayor Smith with a second from CM Dandoy to approve the minutes of the regular meeting of April 8, 2021.  All voted aye.

    1. Motion to approve an Easement Agreement along the pedestrian walkway adjacent to Weber Way for the installation of utility lines. Second by Mayor Smith. All voted aye.

    1. Motion to accept the bid from Davis Demolition and Excavating in the amount of $6,687.20 for the 2021 Curb Ramp Replacement Project. LIN 35 430 439. Second by Mayor Smith.  All voted aye.

    Councilman Dandoy

    1. Motion by Councilman Dandoy to table the following motions. Second by Mayor Smith. All voted aye.  Motions tabled.

    Motion to accept the resignation of James L. Diamond, P.E. from the Code Management Appeals Board effective immediately.

    The City Controller presented bills for payment as follows: from the general fund – $71,097.48; from the parking fund – $25,884.60; from the capital projects fund – $4,802.01 and from the liquid fuels tax fund – $3,842.74; for a grand total of $105,626.83.  Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.

    April Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents that when walking your pet, remember to pick up the waste and dispose of it properly. Flushing pet waste is the best disposal method. Leaving the waste on the ground increases public health risks by allowing harmful bacteria and nutrients to wash into storm drains and eventually into the local streams. Also, if you plan on washing your vehicle, use a commercial car wash if possible. Car washes are setup to treat or recycle the wastewater. If you want to wash your vehicle, pull the car onto a lawn area to wash it. This way, all of the soap and water will infiltrate into the ground. Try not to wash the car on a paved surface as all the runoff will flow onto the street and into a nearby storm sewer. Soaps, wax and other chemicals used to clean cars are toxic to fish and aquatic organisms.

    Mayor Smith called the meeting to order at 7:00 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Rev. Dan Ledford, Westminster Presbyterian Church.                                       

    PRESENTATION – Cory Johnson, Zelenkofske Axelrod LLC spoke to council about services to guide municipalities with the American Rescue Plan Act funding.  Mr. Johnson stated that the fees would be $30,000.  These would be paid from the Act’s funds and would cover the period through December 31, 2024.

    Motion by Mayor Smith to approve the agenda for the regular meeting of April 8, 2021.   Second by CM Dandoy.

    CM Smith made a motion to remove the motion to hire One Cat Too Many LLC to provide a temporary employee, Lawrence Herndon, to perform spreadsheet, data analysis and data entry work to maintain the City’s rental and business records in the City at a rate of $15.00 per hour for 16 – 20 hours per week with a total cost not to exceed $4,000.  Second by Mayor Smith.  All voted aye.

    CM Smith made a motion to add the motion to approve sending a letter of support for Butler Township’s DCNR grant application. Second by Mayor Smith.  All voted aye.

    All voted aye.  Agenda amended.

    Motion by Mayor Smith to approve the minutes regular meeting of March 25, 2021.  Second by CM Bonus.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Smith

    1.Motion to approve sending a letter of support for Butler Township’s DCNR grant application.  Second by CM Bonus.  All voted aye.

    1. Motion to approve the Department of Conservation and Natural Resources Resolution Page and the submission of an application for a DCNR Park Rehabilitation and Development for improvements to Father Marinaro Park. Second by CM Bonus. All voted aye.

    Councilman Bonus

    1. Motion to approve a proposal from and award a contract in the amount of $51,975.00 to Wiest Asphalt Products & Paving, Inc., for the 2021 Monroe Street Paving Project. LIN 35 430 439.  Second by Mayor Smith.  All voted aye.

    Councilman Dandoy

    1. Motion to approve agreement with Butler Downtown to operate the Farmers Market at the Farmers Market facility from May 8, 2021 until October 31, 2021. Second by CM Bonus. All voted aye.

Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.
