    Mayor Smith called the meeting to order at 7:02 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Rt. Rev. David L. Hicks, St. Peter’s Anglican Church.   

    PRESENTATION:

    Mark Schuster from turnKey Taxes requested assistance to gather data.  He requested that council hire a temporary employee designated to data collection.

    Mark Vergenes, parking consultant reviewed the updated term sheet from PFS VIII LLC.

    PERSONS TO BE HEARD: 

    Tom Donaldson shared concerns about selling the City’s parking.  His recommendation would be to lease the parking assets.

    Motion by Mayor Smith with a second from CM Dandoy to approve the agenda for the regular meeting of March 25, 2021.

    Mayor Smith made a motion to add a motion to create a temporary position for data collection in the treasurer’s office, to work up to 3 months at a cost not to exceed $4,000.00.  Second by CM Smith.  All voted aye.

    All voted aye.  Agenda amended.

    Motion by Mayor Smith with a second from CM Bonus to approve the minutes of the regular meeting of March 11, 2021.  All voted aye.

    Motion by Mayor Smith with a second from CM Dandoy to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    MONTHLY & ANNUAL DEPARTMENT REPORTS

    (Note:  Department Reports Distributed to Council electronically)

    Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works and Parking Department for the month of February. Motion by Mayor Smith. Second by CM Dandoy.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1. Motion to approve the recommendation of the City’s consultant (BidURenergy) and enter into the contract with MidAmerican to be the City’s electrical supplier for a period of 36 months beginning December, 2022 through December, 2024 at a contract rate of $0.04620. (estimated savings over the 36-month term is $5,892.77). Second by Mayor Smith. All voted no. Motion failed.

    Councilman Smith

    1. Motion to enter into an agreement with the Butler Fastpitch Association to lease the T-Ball Field in Memorial Park commencing April 1, 2021 through October 31, 2021. Second by Mayor Smith. All voted aye.
    2. Motion to approve the agreement with Grace Family and Youth to provide staffing and programming for the City of Butler Summer Parks program. Second by CM Bonus. All voted aye.

    Mayor Smith

    1. Motion to hire a temp employee for up to three months at a cost of not more than $4000 to update City rental records and local business records. Second by CM Bonus. All voted aye.
    1. Motion for the second reading and adoption of City Ordinance No. 1797; an ordinance of the City of Butler amending Chapter 260, the zoning ordinance of the City of Butler, to add duplexes as permitted uses in the C-2 zoning district. Second by CM Bonus. All voted aye.
    2. Motion to approve closing Main Street from Pearl Street to Wayne Street for the Memorial Day Parade, sponsored by Veterans Services, to be held on Monday, May 31, 2021 from 9:00 AM until 11:00 AM. Second by CM Walter. All voted aye.
    3. Motion to appoint Jeffrey Smith as the City’s representative for the Butler County Council of Governments (COG). Second by CM Bonus. All voted aye.
    4. Motion to permit Butler Downtown to reserve the North Main Parking lot on the following Fridays; May 21st, June 25th, July 30th, August 20th, and September 24th for Foodie Fridays. Second by CM Walter. All voted aye.
    5. Motion to approve the updated term sheet from PFS VIII LLC for the purchase of the Tier Garage; and assignment by City of a management interest in City’s other Assigned Parking Assets. Second by CM Smith. CM Walter, CM Bonus and CM Dandoy voted no. CM Smith and Mayor Smith voted yes.  Motion failed.

    ANNOUNCEMENT:

    Cindy McKnight has been appointment to the Redevelopment Authority of the City of Butler for a term of 5 years will expire on June 30, 2024.

    The City Treasurer presented a Monthly Intake Report for February 2021.

    The City Controller presented bills for payment as follows: from the general fund – $69,120.31; from the parking fund – $25,777.41; from the capital projects fund – $4.59 and from the liquid fuels tax fund – $40,385.34; for a grand total of $135,287.65.  Motion by CM Walter with second from Mayor Smith to approve payment of bills as presented.  All voted aye.

    March Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly clean paint brushes in a sink, not outdoors. Properly dispose of excess paints through a household hazardous waste collection program, or donate unused paints to local organizations. Also, sweep and properly dispose of construction debris such as concrete and mortar. Always protect your hands, eyes, and ears when working and touching construction materials containing chemicals. If you are unsure how to properly dispose of construction waste, please contact your local municipality. Never dump anything into the storm sewer system.

    • First Responder Light Up Night – Saturday, March 27th
    • City Building will be closed on Friday, April 1st in observance of Good Friday.
    • The City’s spring leaf disposal program will begin April 3rd through the end of April

    Mayor Smith called the meeting to order at 7:00 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Mayor Smith.

    A public meeting was held to discuss amending the zoning ordinance to add duplexes as permitted uses in C-2 zoning district.  There was no public comment.

    Richard Goldinger, candidate for Common Please Judge, introduced himself and gave a brief history of his qualifications.

    Mayor Smith recessed at 7:10 PM for an executive session to discuss personnel and legal issues.  The council meeting reconvened at 7:57 PM.

    Motion by Mayor Smith to approve the agenda for the regular meeting of March 11, 2021.   Second by CM Dandoy.

    Mayor Smith made a motion to add the motion to accept the recommendation to terminate the employment of Heather Blair immediately and to notify her of her rights under the collective bargaining agreement.  Second by CM Bonus.  All voted aye.

    All voted aye.  Agenda amended.

    Motion by Mayor Smith to approve the minutes regular meeting of February 25, 2021.  Second by CM Walter.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Smith

    1. Motion to approve the updated term sheet from PFS VIII LLC for the purchase of the Tier Garage and the two (2) surface parking lots located at 124 W. North Street and 126 W. North Street; and assignment by City of a management interest in City’s other Assigned Parking Assets. Second by Mayor Smith. CM Walter, CM Bonus and CM Dandoy voted no. CM Smith and Mayor Smith voted aye.  Motion not approved.
    2. Motion to install a commemorative bench at the Farmer’s Market. Second by CM Dandoy. All voted aye.

    Mayor Smith

    1. Motion to approve closing Main Street from Diamond Park to Penn Street and W. Penn Street from Main Street to the flagpole in Alameda Park, for the Butler Road Race event, sponsored by Butler County Family YMCA, to be held on Saturday, June 19, 2021 from 8:15 AM until 12:00 PM. Second by CM Bonus. All voted aye.
    2. Motion to accept the recommendation to terminate the employment of Heather Blair immediately and to notify her of her rights under the collective bargaining agreement. Second by CM Walter.  All voted aye.

    The City Controller presented bills for payment as follows: from the general fund – $118,299.51; from the parking fund – $5,622.89; from the capital projects fund – $1,098.31 and from the liquid fuels tax fund – $1,897.98; for a grand total of $126,918.69.     February Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to follow the manufacturer’s recommendations for salting driveways and sidewalks. If too much salt is applied, it will runoff into the storm sewer system and impact our local waterways. Please keep the de-icing materials away from landscaping and keep it isolated to the walkway or driveway.

    Also, if you change the fluids in your automobile, please recycle the used oil and other automotive fluids at participating service stations. Do not dump these chemicals down the storm drains or dispose of them in the trash. If you want to temporarily store any of these chemicals on your property, just make sure that they are in sealed containers that will not rust or leak and try to keep them in a dry place.

    Mayor Smith called the meeting to order at 7:01 PM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Rev. Leigh Benish, Hill United Presbyterian Church.

    Councilman Walter

    1. Motion to approve a payment in the amount of $223,406.15 to Wells Fargo Bank for debt service for the City’s 2005 general obligation bonds. (Note: This payment includes principal of $210,000.00 and interest of $13,406.15; due March 1st.) Second by Mayor Smith. All voted aye.
    2. Motion to approve payment to the Butler Area Public Library in the amount of $30,610.91 that represents the proceeds from the City’s 2020 library tax.

    LIN 01 456 540.  Second by CM Dandoy.  CM Walter, CM Smith, CM Dandoy and Mayor Smith voted aye.  CM Bonus abstained.

    Councilman Smith

    1. Motion to approve City Resolution No. 2021-02-11; the City of Butler agrees to comply with the requirements of the Butler County Parks Renovation Program for the purpose of obtaining grant funds for the renovation of Butler Ritts and Father Marinaro Parks. Second by Mayor Smith. All voted aye.
    2. Motion to waive shelter fees for the Miller, Rotary and Deal shelters for the Butler Area Street Machine Assoc. on July 4th. Second by CM Bonus. All voted aye.
    3. Motion to approve an agreement with the Butler Youth Lacrosse Association to utilize Memorial Park and Father Marinaro Park during April and May for their Spring Youth Lacrosse Season. Second by Mayor Smith. All voted aye.
    4. Motion for the introduction and first reading of City Ordinance No. 1798; an ordinance of the City of Butler amending Chapter 52, Officers and Employees, taking office on or after January 1, 2022. Second by Mayor Smith. All voted aye.

    Councilman Bonus

    1. Motion to approve the purchase of a SADS 304 SS Hydraulic Spreader from SEI Stephenson Equipment, Inc., in the amount of $4,300.00. COSTARS #025-021. LIN 35 430 429. Second by Mayor Smith.  All voted aye.
    2. Motion to approve the purchase and installation of a garage door for the streets department in the amount of $3,675.00 from James L. Abbott, General Contractor LLC. LIN 01 455 255. Second by Mayor Smith. All voted aye.

    Councilman Dandoy

Motion to reapprove the Citizen Participation Plan and Grievance Form; the Citizen Complaint/Grievance Process; and the Minority and Women’s Business Enterprise Action Plan for the City of Butler and Redevelopment Authority of the City of Butler Community Development Block Grant/Home Programs. Second by CM Walter. All voted aye.
    3. Motion to approve City Resolution No. 2021-02-11A; To revise the 2019 CDBG program by reducing the Kaufman Drive/Slagle Avenue line item by $2,784.90 and reallocate the same amount to the Street Improvement – Southside – CT 9025, BG 2 line item. Second by CM Bonus. All voted aye.
    4. Motion to appoint Steve Braden to the Butler Area Sewer Authority for a term of 5 years, with such term to expire on December 31, 2025 (replacing Cindy McKnight’s seat on the authority which expired December 31, 2020). Second by CM Walter. All voted aye.

    The City Controller presented bills for payment as follows: from the general fund – $441,971.67; from the parking fund – $5,124.58; from the capital projects fund – $465,535.74 and from the liquid fuels tax fund – $14,705.06; for a grand total of $927,337.05. Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented.  All voted aye.

    ANNOUNCEMENT:

    Lance Calvert’s appointment to the Butler Area Sewer Authority for a term of 5 years will expire on December 31, 2023 (not 2024).

    Councilman Walter

    1.Motion for the second reading and adoption of City Ordinance No. 1796, an ordinance of the City of Butler, Butler County, Pennsylvania, amending City Ordinance No. 1793, fixing the tax rate for Fiscal Year 2021.  Second by CM Bonus.  All voted aye.

    2.Motion to approve a proposal submitted by Caruso & Spencer, PC, Certified Public Accountants for monthly auditing services for Fiscal Year 2021 as outlined in their engagement letter of January 8, 2021 and to authorize the City Clerk to sign said letter on behalf of City Council.  Second by Mayor Smith.  All voted aye.

    3.Motion to approve the Tentative Agreement by and between the City and AFSCME, Local No. 757, for the duration effective January 1, 2021 and terminating on December 31, 2021. Second by CM Walter.  All voted aye.

    4.Motion to approve an agreement with the YMCA for use of the Rotary, Miller and Firehouse shelters in Memorial Park commencing June 7, 2021 through August 20, 2021. Second by Mayor Smith.  All voted aye.

    5.Motion to recommend to amend the City’s Codified Ordinances Chapter 260 Zoning, Article X, Section 260-56; Permitted Uses, to add duplexes as a permitted use in the C-2 zoning district, limited to locations that do not abut Main Street.  Second by CM Bonus.  All voted aye.

    6.Motion to appoint Mavrik Goepfert to the Butler Area Sewer Authority for a term of 5 years, with such term to expire on December 31, 2022 (replacing Edgar Hassler’s seat on the authority). Second by CM Bonus.  All voted aye.

    The City Treasurer presented a Monthly Intake Report for December, 2020.

    The City Controller presented bills for payment as follows: from the general fund – $163,680.24; from the parking fund – $27,896.79; and from the liquid fuels tax fund – $65,894.58; for a grand total of $257,471.61.  Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.

    January Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to ensure that local residents are aware of the two types of systems that are within Butler City and the other local municipalities. The one system is the sanitary sewer system, in which toilets, sinks and garbage disposals are all connected and flow into a treatment facility that removes all of the contaminants and then discharges clean water into a local waterway. The storm sewer system is made up of catch basins that are usually placed along curbs in streets and parking lots and direct stormwater runoff through a series of pipes directly into the local waterway. Please be aware that there is no treatment for stormwater, so do not dump anything into the storm sewer catch basins. If you are unsure about the proper disposal of any type of waste material, please contact your local municipality.

    PERSONS TO BE HEARD:

    Dane Winkler shared his concerns about the City selling the Tier Parking Garage.  His first point is an increase in parking rates.  A private company would increase parking rates that will hurt Butler downtown businesses.  His second point is about the poverty level in the City of Butler.  He said that selling the Tier Parking Garage is not providing for the general welfare of the residents of the City.

    Mayor Smith adjourned the meeting at 7:24 PM.
