    Mayor Smith called the meeting to order at 9:32 AM.  Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present.

    The purpose of this meeting was to review and discuss the City of Butler’s 2021 Budget. Each department reviewed their budget and requested any adjustments they felt necessary.  After a long discussion, the budget will be adjusted and re-distributed to council prior to the evening’s council meeting.

    Mayor Smith adjourned the meeting at 11:03 AM.

    Mayor Smith called the meeting to order at 7:01 PM. Mayor Smith and Council members Walter, Smith, and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Rev. Dan Ledford, Westminster Presbyterian Church in America.

    Motion by Mayor Smith to approve the agenda for the regular meeting of November 5, 2020. Second by CM Walter.

    Motion by CM Dandoy to amend the agenda to add a Motion to direct the City Clerk to submit a request for proposals in the amount of $1,329,763.00 for a 10-year or a 15-year General Obligation multi-draw, term loan for the purchase of a 2021 Pierce Arrow XT 100′ Mid-Mount Tower Ladder.   Multi-draw to be over a period of 12 months.   Second by Mayor Smith. All voted aye.

     All voted aye. Agenda amended.

    Motion by Mayor Smith with a second from CM Walter to approve the minutes of the regular meeting of October 20, 2020.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1. Motion to accept a proposal submitted by NexTier Bank for a 2021 Tax Revenue Anticipation Note in the amount of $1,000,000.00 at an annual interest rate of 2.1% percent per annum. Second by Mayor Smith. All voted aye.
    2. Motion to approve bids submitted by and award the Fiscal Year 2021 contract for supply of the City’s asphalt materials to:

    Wiest Asphalt Products & Paving Inc. as follows:

    9.5MM Superpave Wearing Course FOB; $62.00 per ton and 19MM Superpave FOB; $54.00 per ton. Total Contract: $46,400.00

    Russell Standard Corporation as follows:

    E-3 Emulsion Placed; $2.80/gallon; Total Contract: $7,000.00.  Second by Mayor Smith. All voted aye.

    1. Motion to approve a bid submitted by and award the Fiscal Year 2021 contract for supply of the City’s limestone materials to Allegheny Mineral Corporation as follows:

    Unit Price Delivered at Job Site: #2A – $18.40 per ton; #4 – $19.65 per ton; #8 – $25.40 per ton; #57 – $19.40 per ton.     Total Contract: $82,850.00.  Second by Mayor Smith.  All voted aye.

    Councilman Dandoy

    1. Motion to accept a proposal from NexTier Bank at an interest rate of 3.07% for the financing of the 2021 Pierce Arrow XT 100’ Mid-Mount Tower Ladder at a cost of $1,298,814.00. Second by Mayor Smith. All voted no. Motion not approved.
    2. Motion to direct the City Clerk to submit a request for proposals in the amount of $1,329,763.00 for a 10-year or a 15-year General Obligation multi-draw, term loan for the purchase of a 2021 Pierce Arrow XT 100′ Mid-Mount Tower Ladder.   Multi-draw to be over a period of 12 months.     Mayor Smith

    1. Motion for the adoption and second reading of City Ordinance No. 1792; An ordinance of the City of Butler, Pennsylvania, amending Chapter 232, Article VII; Street Use Permit for Parades and Special Events, of the codified ordinance of the City of Butler. Second by CM Dandoy. All voted aye.
    2. Motion to approve closing a portion of Main Street for the Carved in Ice event, sponsored by Butler AM Rotary, to be held on Friday, February 19, 2021 and Saturday, February 20, 2021. Second by CM Walter. All voted aye.

    The City Controller presented bills for payment as follows: from the general fund – $103,498.22; from the parking fund – $11,142.51; and from the liquid fuels tax fund – $296,343.31; for a grand total of $410,984.04. Motion by Mayor Smith with second from CM Dandoy to approve payment of bills as presented.  All voted aye.

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Reverend Kimberly van Driel, First English Lutheran Church.

    Meeting recessed at 7:05 PM for an executive session to discuss legal issues, real estate and personnel.

    Meeting reconvened at 8:06 PM

    Motion by Mayor Smith with a second from CM Walter to approve the agenda for the regular meeting of October 20, 2020.

    Motion by Mayor Smith to add a motion to approve the request from John Cyprian, County of Butler Veteran’s Services, for the annual Veteran’s Day Parade to be held on November 11, 2020. Second by CM Walter.  All voted aye.  All voted aye. Agenda amended.

    Motion by Mayor Smith with a second from CM Walter to approve the minutes of the regular meeting of October 6, 2020. All voted aye.

    Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    MONTHLY & ANNUAL DEPARTMENT REPORTS

    Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works and Parking Department for the month of September. Motion by Mayor Smith. Second by CM Walter. All voted aye.

    COUNCIL REPORTS/ACTIONS

    Councilman Smith

    1. Motion for the second reading and adoption of City Ordinance No. 1791; an ordinance of the City of Butler amending Chapter 220; Shade Tree; of the codified ordinances of the City of Butler. Second by Mayor Smith. CM Walter, CM Smith, CM Bonus and Mayor Smith voted aye. CM Dandoy voted no.  Motion passed.

    Councilman Dandoy

    1. Motion to approve an agreement with Glick Fire Equipment Company, Inc. for a 2021 Pierce Arrow XT 100’ Mid-Mount Tower Ladder at a cost of $1,293,814.00 through COSTARS (Contract #013-055). Second by CM Walter. All voted aye.
    2. Motion to accept a proposal from NexTier Bank at an interest rate of 3.07% for the financing of the 2021 Pierce Arrow XT 100’ Mid-Mount Tower Ladder at a cost of $1,298,814.00. Second by CM Walter. CM Dandoy made a motion to table. Second by Mayor Smith. All voted aye.  Motion tabled.
    3. Motion to amend previous motion #2 to reflect a cost of $1,346,226.00 less any applicable discounts. Second by Mayor Smith. All voted aye.

    1. Motion to accept a proposal from and award a contract to Vogel Disposal, Inc. for the collection of residential solid wastes and recyclable materials for the period January 1, 2021 through December 31, 2023. (A copy of the fee schedule shall be attached to the minutes of this meeting.) Second by CM Bonus. All voted aye.
      1. Fee Schedule: Vogel Disposal Service Inc_
    2. Motion to accept the optional proposal from and award a contract to Vogel Disposal, Inc. for the collection of residential solid wastes and recyclable materials for the period January 1, 2024 through December 31, 2025. (A copy of the fee schedule shall be attached to the minutes of this meeting.) Second by CM Bonus. All voted aye.

    3. Motion to approve the promotion of Police Officer Cheryl Litz to the rank of Sergeant in the Butler Bureau of Police effective October 25, 2020. Second by CM Walter. All voted aye.
    4. Motion to approve City Resolution No. 2020-10-20, a resolution approving the City’s Community Development Block Grant Application for FY 2020. Second by CM Dandoy. All voted aye.
    5. Motion to approve the request from John Cyprian, County of Butler Veteran’s Services, for the annual Veteran’s Day Parade to be held on November 11, 2020. Second by CM Dandoy. All voted aye.

    The City Treasurer presented a Monthly Intake Report for September, 2020.

    The City Controller presented bills for payment as follows: from the general fund – $388,477.14; from the parking fund – $34,833.75; from the capital projects fund – $347.50; and from the liquid fuels tax fund – $29,048.95; for a grand total of $452,707.34.  Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.

    October Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly clean paint brushes in a sink, not outdoors. Properly dispose of excess paints through a household hazardous waste collection program, or donate unused paints to local organizations. Also, sweep and properly dispose of construction debris such as concrete and mortar. Always protect your hands, eyes, and ears when working and touching construction materials containing chemicals. If you are unsure how to properly dispose of construction waste, please contact your local municipality. Never dump anything into the storm sewer system.

    ANNOUNCEMENTS

    • Trick or Treat will be held on Saturday, October 31st from 6PM until 7PM. Rain Date will be November 1st from 6PM until 7PM and will be announced on Code Red.   Parents or guardians are encouraged to follow the CDC recommendations and to be certain their children trick or treat responsibly and maintain social distancing. Residents who would like to participate are encouraged to turn on porch lights or outside lights to signal that trick or treaters are welcome to approach.
    • First Responder Light Up Night – Saturday, October 24th
    • Leaf Dump will be open October 17 through the first week of December.
    • CM Dandoy referenced an article in the Butler Eagle about safe trick or treating during these difficult times with the pandemic. The article is attached to these minutes.

    Motion by Mayor Smith to approve the agenda for the regular meeting of October 6, 2020. Second by CM Walter.

    Motion by Mayor Smith to amend to agenda to add the motion for the first reading and introduction of City Ordinance No. 1792; An ordinance of the City of Butler, Pennsylvania, amending Chapter 232, Article VII; Street Use Permit for Parades and Special Events, of the codified ordinance of the City of Butler.  Second by CM Dandoy.  All voted aye.  Agenda amended.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1. Motion to approve distribution of 2020 State Aid for pension plans as follows: to the Firefighters Pension Plan – $245,797.76, to the Police Pension Plan – $179,227.53 and to the Officers’ & Employees’ Pension Plan – $87,053.37, with the total amount of 2020 State Aid distributed to pension plans being $512,078.66. Second by Mayor Smith. All voted aye.
    2. Motion to approve payment from the General Fund for pension plans as follows: to the Firefighters Pension Plan – $88,535.24; to the Police Pension Plan – $180,631.47; and to the Officers’ & Employees’ Pension Plan – $5,718.63, with the total amount being $274,885.34 to satisfy the 2020 MMOs. Second by Mayor Smith. All voted aye.
    3. Motion to direct the City Clerk to release a request for proposals for a Tax Revenue Anticipation Note in the amount of one-million dollars for Fiscal Year 2021. Second by Mayor Smith. All voted aye.
    4. Motion to approve the 2021 Municipal Benefits Services renewal. Second by CM Bonus. All voted aye.

    Councilman Smith

    1. Motion to sell parcel 561-37-1-0000 known as the Southside Playground to the Berean Bible Chapel for a sum of $50,000 and an agreement to make 10 annual payments of $2,500 to the City. The initial sum and subsequent payments are to be used to enhance Father Marinaro Park for the benefit of the residents on the South Side.  Second by Mayor Smith. All voted aye.

    Councilman Bonus

    1. Motion for the second reading and adoption of City Ordinance No. 1790, an ordinance of the City of Butler, Pennsylvania amending the City’s traffic control schedules contained in Chapter 245 of the codified ordinances of the City of Butler by making permanent the experimental regulations previously adopted by city council on a 90-day trial basis. Second by Mayor Smith. All voted aye.
    2. Motion to approve a block party on West Fulton Street, from 221 West Fulton Street to 229 West Fulton Street on Saturday, October 31, 2020 from 3:00 PM to 10:00 PM. Second by CM Walter. All voted aye.

    1. Motion to approve the amended City Resolution 2020 – 09 – 24A, to include the City’s match of $316,530; actual grant request of $738,570 from the DCED Multimodal Transportation Fund. Total project scope is $1,055,100. Second by CM Bonus.  All voted aye.
    2. Motion for the first reading and introduction of City Ordinance No. 1792; An ordinance of the City of Butler, Pennsylvania, amending Chapter 232, Article VII; Street Use Permit for Parades and Special Events, of the codified ordinance of the City of Butler.     Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Pastor Mary Kitchen, East/North Butler Presbyterian Church.

    NEIGHBORHOOD PRIDE AWARD was presented to Dylan and Stephanie Robinson, 200 Thirteenth Avenue.

    Mayor Smith presented a proclamation to Penn Street Pizza in honor of Penn Street Pizza Day, September 25th to celebrate 40 years in business.

    Motion by Mayor Smith with a second from CM Walter to approve the agenda for the regular meeting of September 24, 2020. All voted aye.

    Motion by Mayor Smith with a second from CM Dandoy to approve the minutes of the regular meeting of September 8, 2020 and special meeting of September 17, 2020.  All voted aye.

    Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    1. Motion to approve the 2021 Minimum Municipal Obligations for the City’s three pension plans as follows: for the Firefighters Pension Plan – $367,071 and for the Police Pension Plan – $372,211 and the Officers and Employees Pension Plan – $94,961.   Second by Mayor Smith. All voted aye.

    Councilman Smith

    1. Motion for the introduction and first reading of City Ordinance No. 1791; an ordinance of the City of Butler amending Chapter 220; Shade Tree; of the codified ordinances of the City of Butler. Second by Mayor Smith. All voted aye.

    Councilman Bonus

    1. Motion to request authorization from PennDOT Engineering District 10 to enact engine-brake retarder prohibition. Second by CM Dandoy. All voted aye.

    Councilman Bonus thanked the American Legion Post 117 for their donation towards the streets department seasonal help.

    Councilman Dandoy

    1. Motion to approve the additions of a navy blue winter chore coat and a navy blue ¼ zip hooded sweatshirt with collar to the list of approved uniform items, in accordance with Article XVIII Section 3 of the Collective Bargaining Agreement with IAFF #114. Second by Mayor Smith. All voted aye.

    Mayor Smith

    1. Motion to approve Resolution 2020-09-24; appointing voting delegates to the tax collection committee. Second by CM Bonus. All voted aye.
    2. Motion to approve payment in the amount of $100.00 to the Commonwealth of Pennsylvania for the Multimodal Transportation Fund Grant application to be used for the City of Butler Pedestrian Accessibility and Safety Improvements Project.

    LIN 01 499 807. Second by CM Bonus. CM Walter voted no.  CM Smith, CM Bonus, CM Dandoy and Mayor Smith voted aye.

    1. Motion to approve City Resolution 2020-09-24A; a resolution of the City of Butler to request a Multimodal Transportation Fund Grant of $1,150,000 from the Pennsylvania Department of Community and Economic Development to be used for the City of Butler Pedestrian Accessibility and Safety Improvements Project. Second by CM Bonus.

    Mayor Smith made a motion to amend the motion by changing the project cost to $1,055,100.  There was discussion that detailed that the grant would provide $738,570 with a City match of $316,530.  Second by CM Bonus.  CM Walter voted no.  CM Smith, CM Bonus, CM Dandoy and Mayor Smith voted aye.  Motion amended.

    September Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly dispose the leaves on your property and not brush/sweep dirt, leaves, etc. into any storm drain or onto any street. Either place the leaves and dirt on a compost pile, or contact your local municipality for “leaf collection” days or to see what programs your municipality offers for the disposal of yard waste. Remember, the purpose of the storm sewers is to direct stormwater runoff to the local streams. If the system is clogged from garbage, yard waste and dirt, then flooding may occur during a large rainfall event.

Rain Date will be November 1st from 6PM until 7PM and will be announced on Code Red.  Parents or guardians are encouraged to follow the CDC recommendations and to be certain their children trick or treat responsibly and maintain social distancing. Residents who would like to participate are encouraged to turn on porch lights or outside lights to signal that trick or treaters are welcome to approach.
    • Councilman Smith thanked the Joseph T. Black Post No. 249 V.F.W. for their donation towards the repairs to the cannon in Doughboy Park.
