    Mayor Dandoy called the meeting to order at 7:01 PM.  Mayor Dandoy and Council members Reese, Shearer, Christy and Herr were present. The pledge of allegiance to the flag followed an invocation given by Father Martin Johnson, St. Anthony Orthodox Church.

    PRESENTATION:      Leanne Heaton, Logan Family Trust – K9 Fund   

    The Trust donates the interest received to charitable organizations and the K9 Fund was selected to receive 1/3 interest in the amount of $30.000.00. The trust stipulates that the funds can be used only for the purchase and training of new dogs if and when the dogs retire.

    The following actions took place at the Forum Meeting held on November 3, 2022: 

    Mayor Dandoy called the forum meeting to order at 6:30 PM.  Mayor Dandoy and Council members Reese, Shearer, Christy and Herr were present.

    Motion by CM Shearer to direct the City Clerk and the heads of all departments to obtain approval of Finance Director for any and all discretionary purchases and expenditures for a period not to exceed 90 days.  Second by CM Reese.  All voted aye.

    Motion by Mayor Dandoy with a second from CM Shearer to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    MONTHLY BOARDS AND AUTHORITIES LIAISON REPORTS

    Mayor Dandoy attended Butler Downtown’s event last night and commented on how well it was organized and the shared vision of Butler downtown. The Mayor presented proclamations and keys to the City to Brian McCafferty and Vicki Hinterberger. Also, Congressman Mike Kelly, State Representative Marci Mustello, and Senator Scott Hutchinson presented them with citations.

    Motion to accept the monthly reports from the Office of the City Clerk, the Police Department, Fire Department, Office of Business & Community Development/Code Enforcement, Department of Public Works and Parking Department for the month of October.  Motion by Mayor Dandoy. Second by CM Shearer.  All voted aye.

    1.Motion to approve bids submitted by and award the Fiscal Year 2023 contract for supply of the City’s asphalt materials to:

    Wiest Asphalt Products & Paving Inc. as follows:

    9.5MM Superpave Wearing Course FOB; $82.50 per ton and 19MM Superpave FOB; $70.50 per ton. Total Contract: $61,200.00.

    Russell Standard Corporation as follows:

    E-3 Emulsion Placed; $4.55/gallon; Total Contract: $11,375.00.

    Second by Herr. All voted aye.

    2.Motion to approve a bid submitted by and award the Fiscal Year 2023 contract for supply of the City’s limestone materials to Allegheny Mineral Corporation as follows:

    Unit Price Delivered at Job Site: #2A – $20.00 per ton; #4 – $22.50 per ton; #8 – $27.50 per ton; #57 – $22.50 per ton.     Total Contract: $92,500.00.    Second by Christie. All voted aye.

    3.Motion to accept a proposal from SEI Stephenson Equipment, Inc., in the amount of $28,549.00 for a plow, spreader and to convert hydraulics for the 2023 Ford F750 truck to be paid from the Liquid Fuels Tax Revenue Fund. (Costars #25-E22-432). Second by Shearer. All voted aye.

    4.Motion to install a “No Parking” sign on the east side of Main Street between East Penn Street and WISR Way on a 90-day trial basis. Second by Christie. All voted aye.

    5.Motion to install a “No Parking Here to Corner” sign on the west side of Main Street from West Penn Street north 100 feet on a 90-day trial basis. Second by Shearer. All voted aye.

    6.Motion for the introduction and first reading of City Ordinance No. 1812, an ordinance of the City of Butler fixing the tax rate for Fiscal Year 2023.    Second by Reese. All voted aye.

    7.Motion for the introduction and first reading of City Ordinance No. 1813, an ordinance of the City of Butler adopting the annual budget and appropriating specific sums estimated to be required for the specific purposes of the City government as set forth therein during Fiscal Year 2023.     Second by Herr. All voted aye.

    8.Motion for the introduction and first reading of City Ordinance No. 1814, an ordinance of the City of Butler fixing the wages and salaries of employees of the City in conformance with the budget for Fiscal Year 2023.     Second by Christie. All voted aye.

    9.Motion to approve payment to USBank in the amount of $327,830.75 for the bond payment due on the 2015 General Obligation Bonds as follows:

    LIN 01 472 801 Principal $230,000.00           LIN 01 472 800 Interest $97,830.75

    10.Motion to accept a proposal submitted by NexTier Bank for a 2023 Tax Revenue Anticipation Note in the amount of $1,500,000.00 at an annual interest rate of 5.81% percent per annum.  Second by Christie. All voted aye.

    11.Motion not to renew the pickleball association agreement as written for the year 2023. A new agreement may be considered provided certain criteria are met and the language can be agreed upon by both the city and the association.  Second by Shearer. All voted aye.

    12.Motion to appoint John Morgan to the City of Butler Parks, Recreation Grounds & Facilities Authority to fill the unexpired term of Heidi Fleming which expires January 1, 2026.  Second by Shearer. All voted aye.

    APPOINTMENT:

    City Shade Tree Commission:

    Donna Smith for a 3-year term ending June 30, 2025.

    Jack Hutchinson for a 3-year term ending June 30, 2025.

    Jim Smith for a 3-year term ending June 30, 2024.

    Treasurer Aaron Bonus announced that he will resign, effective December 1, 2022.

    City Council is seeking City residents interested in filling the position of City Treasurer through the end of 2023.  In addition to being a City resident for at least one year, applicants must be 21 years of age and must be an accountant.  Send letters of interest to Mayor Dandoy’s attention, not later than noon on December 19, 2022 to the City Building at 140 West North Street, or call (724) 285 – 4124, extension 205 for more information.

    The City Treasurer, presented reports for the month of October.

    The City Controller presented bills for payment as follows: from the general fund – $667,159.74; from the parking fund – $237,559.68; from the capital projects fund – $1,460.00 and from the liquid fuels tax fund – $125,714.38; for a grand total of $1,031,893.80.  Motion by Mayor Dandoy with second from CM xr to approve payment of bills as presented.  All voted aye.

     

    November Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to ensure that local residents are aware of the two types of systems that are within Butler City and the other local municipalities. The one system is the sanitary sewer system, in which toilets, sinks and garbage disposals are all connected and flow into a treatment facility that removes all of the contaminants and then discharges clean water into a local waterway. The storm sewer system is made up of catch basins that are usually placed along curbs in streets and parking lots and direct stormwater runoff through a series of pipes directly into the local waterway. Please be aware that there is no treatment for stormwater, so do not dump anything into the storm sewer catch basins. If you are unsure about the proper disposal of any type of waste material, please contact your local municipality.

    Mayor Dandoy called the meeting to order at 7:00 PM.  Mayor Dandoy and Council members Reese, Shearer, Christy and Herr were present. The pledge of allegiance to the flag followed an invocation given by Deacon Jim Shope, All Saints Parish.

    The following actions took place at the Forum Meeting held on October 13, 2022:

    Mayor Dandoy called the forum meeting to order at 6:30 PM.  Mayor Dandoy and Council members Reese, Shearer, Christy and Herr were present.

    1. Motion to approve City Resolution No. 2022-10-13; a resolution of the City of Butler, authorizing the submission of an application to the Pennsylvania Department of Community and Economic Development for funding through the CDBG Program, as authorized under the Housing and Community Development Act [42 USC 5301 and 24 CFR Part 570], and further certifying compliance with the requirements of said program. Motion by Mayor Dandoy. Second by CM Reese. All voted aye.
    2. Motion to approve the retirement of Sergeant Cheryl L. Litz from the Butler Bureau of Police following 22 years of service, effective October 6, 2022. Motion by Mayor Dandoy. Second by CM Herr. All voted aye.
    3. Motion to ratify a revision to the City’s Civil Service Rules and Regulations governing the hiring of entry-level police officers and firefighters, as well as promotions within the respective department. (The Civil Service Commission, represented by Tom Graham, adopted the 2022 Civil Service Rules and Regulations on October 4, 2022 and copies were distributed to mayor and council on October 5, 2022). Motion by Mayor Dandoy. Second by CM Shearer.  All voted aye.

    4.Motion to approve City Resolution No. 2022-10-13A; a resolution of the City of Butler in support of the sale of the Butler Area Sewer Authority Wastewater System to the Pennsylvania American Water Company; authorizing communication of information and cooperation with Pennsylvania American Water Company; instructing special counsel to intervene in Pennsylvania Public Utility Commission proceedings regarding proposed sale in support of sale; ratifying all actions taken hereto with respect to the negotiation and preparation of the asset purchase agreement; and rescinding inconsistent resolutions. Motion by Mayor Dandoy.  Second by CM Reese.  All voted aye.

    1. Motion to approve the promotion of Patrol Officer Myles Bizub to the rank of Sergeant in the Butler Bureau of Police effective October 23, 2022. Motion by Mayor Dandoy. Second by CM Herr. All voted aye.
    2. Motion to approve closing Main Street from West Pearl Street to Wayne Street, for the Veterans Day Parade, sponsored by Butler County Veterans Committee, to be held on Thursday, November 11, 2022 from 10:15 AM until 12:15 PM. Motion by Mayor Dandoy. Second by CM Christy. All voted aye.

    Mayor Dandoy made a motion to amend the agenda to add the following two motions:

    Motion to approve the Trunk or Treat event to be held in Father Marinaro Park by St. Luke Lutheran Church and CCR on October 22, 2022 from 11:00 am until 2:30 pm.

    Motion to approve the Bundle Up Butler event to be held in Memorial Park by CCR on October 21, 2022 from 8:00 am until 4:00 pm. Second by CM Herr.  All voted aye.  Agenda amended.

    7.Motion to approve the Trunk or Treat event to be held in Father Marinaro Park by St. Luke Lutheran Church and CCR on October 22, 2022 from 11:00 am until 2:30 pm.  Motion by CM Herr.  All voted aye.

    2.Motion to approve a payment in the amount of $223,362.40 to the County of Butler for debt service for the Butler County Infrastructure Loan Payment. (Note: This payment includes principal payment of $219,000.00 plus interest payment of $4,362.40; due November 1st.)   Second by CM Reese.  All voted aye.

    3.Motion to approve distribution of 2022 State Aid for pension plans as follows:  to the Firefighters’ Pension Plan – $199,661.52, to the Police Pension Plan – $332,739.01, and to the Officers & Employees’ Pension Plan – $1,186.01 with the total amount of 2022 State Aid distributed to pension plans being $533,586.54.    Second by CM Herr.  All voted aye.

    4.Motion to pay the first installment of the 2022 small borrowing loan to NexTier Bank.  ($207,840.82; $204,800.00 principal and $3,040.82 interest). Second by CM Reese.  All voted aye.

    6.Motion to renew a five (5) year contract with Otis Elevator Company for the maintenance of the elevator in the Tier Parking Garage at a cost of $349.23 per month, payable annually in advance ($4,190.76).  Second by CM Shearer.  All voted aye.

    7.Motion to accept the bid from Pillow Street A/S for the 2008 Chevrolet Silverado 1500 in the amount of $775.00 that is surplus of the needs of the parks department.  Second by CM Shearer.  All voted aye.

    9.Motion to appoint Larry Christy as the City’s representative for the Butler County Council of Governments (COG). Second by CM Reese.  All voted aye.

    10.Motion to approve City Council’s 2023 meeting schedule, a copy of which will be published in a local newspaper to comply with the Sunshine Act and attached to the minutes of this meeting. Second by CM Christy.  All voted aye.

    11.Motion to enter into a lease agreement with the County of Butler for the use of thirty (30) parking spaces on the top level of the Tier Parking Garage. Second by CM Reese.  All voted aye.

    12.Motion to approve closing of E. Diamond Street from Main Street to McKean Street on Friday, February 10, 2023, and the closing of Main Street from Wayne Street to Cunningham Street, and Diamond St. from Washington Street to McKean Street on Saturday, February 11, 2023, for the Carved in Ice event, sponsored by Butler AM Rotary Club.     14.Motion to Terminate the Lease Agreement with Covenant United Presbyterian Church for the parking lot on East Jefferson Street effective December 31, 2022. Second by CM Shearer.  All voted aye.

    The Mayor, in absence of the City Treasurer, presented reports for the month of August and September.

    October Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly clean paint brushes in a sink, not outdoors. Properly dispose of excess paints through a household hazardous waste collection program, or donate unused paints to local organizations. Also, sweep and properly dispose of construction debris such as concrete and mortar. Always protect your hands, eyes, and ears when working and touching construction materials containing chemicals. If you are unsure how to properly dispose of construction waste, please contact your local municipality. Never dump anything into the storm sewer system.

    2.Motion to approve a block party on West Fulton Street, from 220 West Fulton Street to 229 West Fulton Street on Saturday, October 1, 2022 from 4:00 PM to 10:00 PM. Second by CM Herr.  All voted aye.

    3.Motion to approve a block party on East Brady Street, from Franklin Street to Rattigan Street on Sunday, October 16, 2022 from 1:00 PM to 6:00 PM. Second by CM Shearer.  All voted aye.

    4.Motion to direct the City Clerk to seek proposals for limestone and asphalt for Fiscal Year 2023 with such proposals due not later than 2:00 PM on November 2nd.  Second by CM Shearer.  All voted aye.

    5.Motion to approve the 2023 Municipal Benefits Services renewal. Second by CM Reese.  All voted aye.

    6.Motion to approve the 2023 Minimum Municipal Obligations for the City’s three pension plans as follows:  for the Firefighters Pension Plan – $247,270 and for the Police Pension Plan – $337,964 and the Officers and Employees Pension Plan – $-0-.  Second by CM Reese.  All voted aye.

    7.Motion to approve City Resolution no. 2022-09-22 revising the 2020 CDBG program as follows:  1. Decrease the Street Improvements – South Main – BG 2 line by $24,308.19 and reallocate to a Street Improvements – Kaufman Drive line item. 2. Decrease the Planning line item by $20,000 and reallocate the same amount to the Administration line item. Second by CM Christy.  All voted aye.

    11.Motion to extend the use until 9:00 PM and light the tennis courts in Memorial Park, the pickleball courts in Ritts Park and the skate park in Father Marinaro Park on a trial basis until October 31, 2022.  Second by CM Reese.  All voted aye.

    12.Motion to approve the quote from Shults Ford-Lincoln in the amount of $45,439.00 for a 2022 Ford Truck F150 for use in the Parks Department.  (Costar Contract #346888). Second by CM Shearer.  All voted aye.

    13.Motion to direct the City Clerk to advertise for sale one used 2008 Chevrolet Silverado 1500 Truck from the City’s Parks Department. Second by CM Reese.  All voted aye.

    14.Motion to approve the use of the Farmer’s Market by the Community Cat Network for a Spay and Neutering Cat Clinic to be held on Monday, October 3, 2022. Second by CM Shearer.  All voted aye.

    15.Motion to authorize the City Clerk to sign the updated Engagement/Fee agreement letter of September 7, 2022 for legal representation by the firm of Campbell Durrant, P.C. in all areas of labor and employment matters, including but not limited to collective bargaining, contract administration issues, grievances and arbitration hearing defense.  Second by CM Christy.  All voted aye.

    16.Motion to approve the inspector for the Streetscape project. The inspector will be Thomas Peacock of A&A Consultants, Inc. and his rate has increased from $29.85 to $31.50 per hour.  Second by CM Shearer.  All voted aye.

    17.Motion to authorize Mike Ogin from Gateway Engineers to approve this inspector within the ECMS system. Second by CM Shearer.  All voted aye.

    18.Motion to approve leasing All Saints Parish/ St Peter’s Church Hall for a public meeting to be held on September 27, 2022.  Second by CM Reese.  All voted aye.

    19.Motion to approve letters of support for the Butler Technologies, Inc. Manufacturing Facility Expansion, Butler County Redevelopment Assistance Capital Program as requested by Butler County CDC. Second by CM Herr.  All voted aye.

    Mayor Dandoy made the following statement concerning the Butler Area Sewer Authority:

    “As many of you know, the Butler Area Sewer Authority Board of Directors has received a formal offer from the Pennsylvania American Water Company to acquire our wastewater system for $231.5 million.

    As the sole owners of BASA, the City of Butler and Butler Township would receive the proceeds from this proposed sale, after the system’s $49 million in debt is paid off.

    We have been engaged in serious negotiations on this issue for several months, and we have been working hard to ensure any proposal puts customers, BASA employees, and communities first.

    Now that we have a proposal in place, we want to hear from you.

    There is a lot of information in this proposal, so I encourage you over the next few weeks to find time to study the issues to learn about the benefits of this potential transaction.  Your feedback is very important to us.

    We want to hear what you think about the plan, but also how we could use this funding to support essential services for residents, meet future financial obligations, and invest in various other community improvements.

    Additionally, we are putting together several open houses where you can come and talk directly to representatives from BASA, the City of Butler, Butler Township, and Pennsylvania American Water Company, which already provides drinking water services to many local municipalities.

    The first two open houses will be held at 10 a.m. and 6 p.m. Tuesday, September 27th at St Peter’s Social Hall at 127 Franklin Street.

    The second two open houses will be held at 10 a.m. and 6 p.m. Thursday, September 29th at the Butler Township Municipal Building at 290 South Duffy Road.

    I encourage you to attend one of these open houses to learn more about the plan and have your questions answered, and to share your thoughts about the proposed sale.”

    The City Controller presented bills for payment as follows: from the general fund – $1,303,631.62; from the parking fund – $42,438.28; and from the liquid fuels tax fund – $15,058.47; for a grand total of $1,361,128.37.  Motion by Mayor Dandoy with second from CM Shearer to approve payment of bills as presented.  All voted aye.

    September Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly dispose the leaves on your property and not brush/sweep dirt, leaves, etc. into any storm drain or onto any street. Either place the leaves and dirt on a compost pile, or contact your local municipality for “leaf collection” days or to see what programs your municipality offers for the disposal of yard waste. Remember, the purpose of the storm sewers is to direct stormwater runoff to the local streams. If the system is clogged from garbage, yard waste and dirt, then flooding may occur during a large rainfall event.
