    Mayor Dandoy called the meeting to order at 7:01 PM.  Mayor Dandoy and Council members Reese, Shearer, Christy and Herr were present. The pledge of allegiance to the flag followed an invocation given by Reverend David Phillips, St. Mark’s Lutheran Church.

    The following actions took place at the Forum Meeting held on August 11, 2022:

    Mayor Dandoy made a motion to extend the Confidentiality Agreement with Pennsylvania American Water Company until September 30, 2022.  Second by CM Reese.   All voted aye.

    PRESENTATIONS:

    Mayor Dandoy presented a proclamation Peter Talleri proclaiming Friday, August 26, 2022 as Major General Peter Talleri USMC Day.

    Molly Horstman, representative of State Representative Marci Mustello, presented Peter Talleri with a State House citation and flag.

    Renee Porterfield, Assistant Manager Berkshire Hathaway presented a contribution for the City of Butler K9 Fund.

    Denny Offstein presented contributions for the City of Butler K9 Fund from Thompson Miller Funeral Home.

    Bill May requested council to use the LED lights on the pickleball courts in Ritts Park to permit players to play beyond dusk.

    COUNCIL REPORTS/ACTIONS

    Councilman Reese

    1.Motion for the introduction and first reading of City Ordinance No. 1811, an ordinance of the City of Butler, Pennsylvania amending the City’s traffic control schedules contained in Chapter 245 of the codified ordinances of the City of Butler by making permanent the experimental regulations previously adopted by city council on a 90-day trial basis. Second by CM Christy.  All voted aye.

    2.Motion to direct the city clerk to advertise for a Dump Truck for use in the streets department and to be paid from the Liquid Fuels Fund. Second by CM Shearer.  All voted aye.

    3.Motion to approve a payment in the amount of $4,536.31 to Computershare Corporate Trust for an interest payment for the General Obligation Refunding Bond Series of 2005.   LIN 01 472 700.   Second by CM Reese.  All voted aye.

    Councilman Christy

    4.Motion to accept a Fiscal Year 2021 Assistance to Firefighters Grant in the amount of $27,515.00 for the purchase of two thermal imaging cameras, two automated external defibrillators, and a rapid intervention team (RIT) pack with air cylinder.  The federal share of the grant is $26,204.76, with a city match of $1,310.24. Second by CM Shearer.  All voted aye.

    5.Motion to approve Pennsylvania Heart & Lung Act benefits for Captain Michael Huey beginning on August 22, 2022, for a work-related injury he sustained on July 26, 2022.  Second by CM Herr.  All voted aye.

    6.Motion to approve an agreement with Greater Pittsburgh Community Foodbank for use of the Farmer’s Market from 2:30 pm until 7:00 pm on the 4th Tuesday of each month, July through December for the Walk-up Food Distribution Program.  Second by CM Reese.  All voted aye.

    7.Motion to approve a community skateboard competition at Father Marinaro skatepark on Sunday, September 11, 2022 starting at 1:00 PM and ending at sundown, with a “rain date” of September 25, 2022. Second by CM Reese.  All voted aye.

    8.Motion to designate Mayor Robert A. Dandoy as the City’s Voting Delegate to the 2022 Resolutions Committee and Annual Business Meetings for the 2022 Municipal Leadership Summit scheduled for October 6-9, 2022, in Pittsburgh. Second by CM Christy.  All voted aye.

    9.Motion to approve preliminary design for signs in Rotary Cultural District contingent upon engineering review and zoning approval. Second by CM Herr.  All voted aye.

    10.Motion to approve 2022 Butler Downtown Revolving Loan Fund guidelines and the Butler Downtown Revolving Loan Application.  Second by CM Reese.  All voted aye.

     

    The City Treasurer presented a Monthly Intake Report for May, June and July 2022.

    The City Controller presented bills for payment as follows: from the general fund – $933,751.89; from the parking fund – $47,580.39; from the capital projects fund – $1,943.50 and from the liquid fuels tax fund – $14,052.58; for a grand total of $997,328.36.  Motion by Mayor Dandoy with second from CM Shearer to approve payment of bills as presented.  All voted aye.

    August Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents that if you plan to drain your pool, only drain it when your test kit does not detect any chlorine levels. Chlorine is considered toxic to fish and aquatic organisms. Whenever possible, drain the pool or spa into the sanitary sewer system. Contact your local municipality if you have any questions regarding how to properly drain your pool or spa.

    • City Building will be closed on Monday, September 5th in observance of Labor Day and Monday, September 12th in observance of Patriots Day.

    Motion to approve an agreement between the Butler Area Sewer Authority (BASA), Butler County Community College and the City of Butler to document the terms and conditions under which BC3 can use land owned by the Butler Area Sewer Authority as a range for gun training, subject to the removal of Paragraph No. 6.  Second by CM Reese.   All voted aye.

Complete bid specifications will be available through the Bureau of Fire and the Office of the City Clerk. Second by CM Reese.  All voted aye.

    2.Motion to approve the conditional hiring of two (2) part-time firefighters from the 2022 Civil Service Examinations Certified List. Second by CM Reese.  All voted aye.

    3.Motion to approve an agreement with Breakthrough-Butler for use of Memorial Park Optimist and Deal (only after the YMCA has vacated the space) shelters on July 19, 2022, from 10:00AM until 6:00PM for a Breakthrough-Butler Event. Second by CM Reese.  All voted aye.

    4.Motion to approve a community skateboard competition at Father Marinaro skatepark on Saturday, August 6, 2022 starting at 12:00 PM and ending at 9:30 PM. Second by Shearer.  All voted aye.

    5.Motion to approve City Resolution No. 2022-07-20; a resolution authorizing the Redevelopment Authority of the City of Butler to file an application for Community Development Block Grant-Cares Act (CDBG-CV), as part of the Coronavirus Aid, Relief, and Economic Security (CARES Act) {P.L. 116-136} on behalf of the City of Butler with the Department of Community and Economic Development (DCED) Commonwealth of Pennsylvania. Second by CM Herr.  All voted aye.

    6.Motion to adopt the Community Needs Assessment attached to City Resolution No. 2022-07-20. Second by CM Shearer.  All voted aye.

    7.Motion to approve City Resolution No. 2022-07-20A; a resolution authorizing the Redevelopment Authority of the City of Butler to file an application for HOME funds for affordable housing activities on behalf of the City of Butler with the Department of Community and Economic Development (DCED) Commonwealth of Pennsylvania. Second by CM Reese.  All voted aye.

    8.Motion to accept the bid from Trinity Door Systems in the amount of $9,823.00 for the “Automated Doors” for Butler Area Public Library, to be paid by the Library with the Keystone Grant. Second by Shearer.  All voted aye.

    9.Motion to accept the bid from You Name It Contracting in the amount of $3,500.00 for the “Electrical Work and General Labor” for Butler Area Public Library, to be paid by the Library with the Keystone Grant. Second by CM Shearer.  All voted aye.

    10.Motion to accept the bid from Butler Floor & Carpet in the amount of $34,150.00 for the “Flooring” for Butler Area Public Library, to be paid by the Library with the Keystone Grant. Second by Shearer.  All voted aye.

    Announcements:

    An application for an ARLE Grant has been submitted for the purpose of replacing the antiquated signal assets at the intersection of Cunningham Street and Pillow Street.  Total project amount is estimated to be $340,000.00. City match is estimated to be $10,000.00.

    The City of Butler consented to the sale of 463 E. Jefferson St.- 0.9 AC, Butler City, Ward 2, to be sold from the Butler County Repository by the Butler County Tax Claim Bureau to Kara Sellers (tax parcel 562-25-26-0000) in the amount of $600.00.

    In the absence of the City Controller, the City Clerk presented bills for payment as follows: from the general fund – $701,760.58; from the parking fund – $43,310.49; from the capital projects fund – $1,287.00 and from the liquid fuels tax fund – $19,312.45; for a grand total of $765,670.52.  Motion by CM Shearer with second from CM Reese to approve payment of bills as presented.  All voted aye.

     July Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to collect rainwater from rooftops in mosquito proof rain barrels. The water can then be used later to water lawns and garden areas. Do not brush/sweep dirt, leaves, etc. into any storm drain. The purpose of the storm sewers are to direct stormwater runoff to the local streams. If the system is clogged, then localized flooding may occur during a large rainfall event.

    PERSONS TO BE HEARD:

    Ken Clowes discussed the importance of how Father Marinaro Skatepark helps the youth and presented his vision for the future of the skatepark.

    Cindy Parker discussed the need for upgrades in Father Marinaro Skatepark and told council the updates that the Southside Park Group has done to date.

    Mayor Dandoy will meet with both Ken and Cindy, as well as Councilman Herr to discuss the skatepark.

    Mayor Dandoy adjourned the meeting at 8:32 PM.

    Mayor Dandoy called the meeting to order at 7:00 PM.  Mayor Dandoy and Council members Shearer, Christy and Herr were present. The pledge of allegiance to the flag followed an invocation given by Pastor David Janz, First United Methodist Church.

    PRESENTATION:

    Lynn McKinnis presented the Remote Area Medical Clinic (RAM) sponsored by Concordia Lutheran Ministries.

    There were two friendly amendments to the agenda.

    1. Mayor Dandoy requested adding the motion to extend the confidentiality agreement with PA American Water for a period of 30 days.
    2. CM Herr requested removing the motion to Discussion of the proposal from Viasat to lease the property at Rotary Park for a satellite dish. The lease agreement would be for three years in the amount of $600.00 per month.

    2.Motion to approve a payment in the amount of $1,010,015.66 to NexTier Bank for the 2022 Tax Revenue Anticipation Note.  $1,000,000.00 Principal (LIN 01 472 601)   &   $10,015.66 Interest (LIN 01 472 600) – Payoff Date is June 30, 2022 – maturity date is July 31, 2022.   Second by CM Reese.  All voted aye.

    3.Motion to approve an addendum by Maher Duessel Certified Public Accountants for creating the special-purpose debt statement and borrowing base certificate required as outlined in their engagement letter of June 14, 2022, and to authorize the City Clerk to sign said letter on behalf of City Council.  Second by CM Christy.  All voted aye.

    4.Motion to reappoint Thomas Graham to the Zoning Hearing Board for a three-year term ending June 30, 2025.  Second by Mayor Dandoy.  All voted aye.

    Mayoral Announcements:

    Jay Fennell will be appointed to the Redevelopment Authority of the City of Butler effective July 1, 2022 for a 5-year term ending June, 2027.

     

    On June 14, 2022, the Mayor and Councilman Christy met with legal counsel and/or the other parties regarding the potential sale of the BASA system.

    The City Controller presented bills for payment as follows: from the general fund – $1,557,601.12; from the parking fund – $49,176.56; and from the liquid fuels tax fund – $26,171.38; for a grand total of $1,632,949.06.  Motion by Mayor Dandoy with second from CM Shearer to approve payment of bills as presented.  All voted aye.

    June Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to properly store pool and spa chemicals, as well as other household and vehicle chemicals to prevent leaks and spills. Please make sure they are in sealed containers that will not rust or leak and try to keep them in a dry place, preferably in covered areas to avoid exposure to stormwater.

    Mayor Dandoy called the meeting to order at 7:00 PM. Mayor Dandoy and Council members Reese, Shearer, Christy, and Herr were present. The pledge of allegiance to the flag followed an invocation given by Kerry M. Dowdy – Elder at East Butler Presbyterian Church. Mayor Dandoy had a moment of silence in remembrance of the children and lives lost from the recent Texas school shooting.

    The following actions took place at the Forum Meeting held on May 5, 2022:

    Councilman Frederick W. Reese at the Forum Meeting held on May 5, 2022.

    Motion to approve the purchase of a replacement backup unit from Perfection Services, Inc. in the amount of $2,989.00 and monthly backup services for all three servers in the city building in the amount of $729.00 for 3TB.  Second by CM Shearer.  All voted aye.

    PRESENTATIONS:

    Pamala Taylor, co-chairwoman of Shade Tree Commission presented an update and Shade Tree members explained the importance of tree selection and tree care for the City of Butler Streetscape project so that the trees will last a lifetime rather than a few years.

    Mayor Dandoy recessed the meeting for an executive session to discuss legal issues.  Mayor Dandoy reconvened the meeting.

    Motion by Mayor Dandoy with a second from CM Christy to approve the agenda for the regular meeting of May 26, 2022.

    Councilman Shearer made a motion to strike motion number 3. Motion to approve the recommendation of our consultant (BidURenergy) and enter into the contract with AEP Energy to be the City’s electrical supplier for a period of 36 months beginning November, 2022 through December, 2025 at a contract rate of $0.07722. (current rate is $0.04936)  (alternate 12 month contract at $0.09680).

    Second by CM Christy.  All voted aye.

    The Redevelopment Authority of the City of Butler (RACB) had an audit via telephone for CDBG 2015-2019 and Home Program 2017-2019.  He reported there were no issues with the audits.

    1.Motion for the adoption of City Ordinance No. 1810; an ordinance increasing the indebtedness of the City of Butler, Butler County, Pennsylvania by the issue of a General Obligation Note in the amount of $409,600.00 for the purpose of streets department garage repairs, paving, and 2022 police and parks department vehicles. Second by CM Reese. All voted aye.

    2.Motion to approve payment to USBank in the amount of $97,843.04 for interest due on the General Obligation Bonds Series B-2015.  LIN 01 472 800.  Second by CM Herr. All voted aye.

    3.Motion to accept the bid from Penn Power Group in the amount of $47,208.62 to replace the in-line 6 cyl. 9L engine on a 2011 Spartan Metro Star chassis (Engine 1-2, as operated by the Bureau of Fire) with an ENG ISL 8.9 07B 280@2200. Second by CM Shearer. All voted aye.

    1. Motion to approve active military leave by Joshua Abbott effective June 5, 2022, until February 24, 2023. Second by CM Shearer. All voted aye.

    5.Motion to not renew the agreement with Johnson Controls Fire Protection LP (formerly Tyco Simplex Grinnell) for the security system in the Tier Parking Garage – current agreement expires May 31, 2022. Second by CM Reese. All voted aye.

    6.Motion to accept the quote from 2Krew Security & Surveillance in the amount of an initial cost of $1,069.00 and annual cost of $1,209.40 for the security system in the Tier Parking Garage and offices. Second by CM Shearer. All voted aye.

    7.Motion to accept the bid from Fuller Building Group for the Base Bid of $105,975.00 and the Alternate Bid of $108,060.00 for a total of $214,035.00 for the Street Department Garage Roof Replacement Project.  (Capital Projects LIN 18 409 610). Second by CM Reese. All voted aye.

    1. Motion to approve the agreement between the City of Butler and Grace Youth and Family Foundation for the Summer Recreation Program for 2022. (LIN 1.452.380). Second by CM Shearer. All voted aye.

    The pickleball courts are waiting to be painted, signs are being made, and we have the nets.  They should be ready by the middle to end of June.

    The City Controller presented bills for payment as follows: from the general fund – $785,691.91; from the parking fund – $149,458.65; from the capital projects fund – $4,505.10 and from the liquid fuels tax fund – $19,682.85; for a grand total of $959,338.51.  Motion by Mayor Dandoy with second from CM Reese to approve payment of bills as presented.  All voted aye.

    May Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to please use pesticides and fertilizers sparingly on their lawns. When necessary, use these chemicals in their recommended amounts. Avoid applying chemicals if rain is in the forecast because the rain will wash all of the chemicals off the lawn area into the storm sewers and into the local streams. Don’t over-water your lawns and if you are going to water, do it during the cool times of the day and don’t let the water runoff into the streets.

    Also, check your cars, boats, lawn mowers, and other machinery and equipment for leaks and spills. Make repairs as soon as possible, and clean any spills up with an absorbent type material such as kitty litter or sand. Do not rinse any spills into the streets or storm sewers. This will go directly into local streams.

    Mayor Dandoy called the meeting to order at 7:00 PM.  Mayor Dandoy and Council members Shearer, Christy and Herr were present. The pledge of allegiance to the flag followed an invocation given by Fr. David Hicks, St. Peter’s Anglican Church.

    PRESENTATIONS:

    Mayor Dandoy read a Proclamation presented to the Benevolent and Protective Order of Elks to designate May 1-7, 2022, as “Elks National Youth Week”.

    Motion by Mayor Dandoy with a second from CM Shearer to approve the agenda for the regular meeting of April 21, 2022.

    Councilman Shearer made a motion to strike motion number 2. Motion to approve the recommendation of our consultant (BidURenergy) and enter into the contract with AEP Energy to be the City’s electrical supplier for a period of 36 months beginning November, 2022 through December, 2025 at a contract rate of $0.07185. (current rate is $0.04936)  (alternate 12 month contract at $0.08589).

    Second by CM Christy.  All voted aye.

    With above motion stricken, all voted aye to approve the agenda.

    Motion by Mayor Dandoy with a second from CM Shearer to approve the minutes of the regular meeting of March 24, 2022.  All voted aye.

    In accordance with the provisions of Section 10801 of the Pennsylvania Consolidated Statutes – Title 11, motion to appoint Frederick W. Reese to the position of City Council to fill the vacancy created by the death of Michael E. Walter for a term to expire on the first Monday in January 2024.  Motion by Councilman Herr.  Second by Mayor Dandoy. All voted aye.

    13.Motion to consent to the sale of 112 Kittanning Street.- 0.04 AC, Butler City, Ward 2, to be sold from the Butler County Repository by the Butler County Tax Claim Bureau to Mark Harvey (tax parcel 562-25-23-0000) in the amount of $600.00. Second by CM Christy.  All voted aye.

    14.Motion to authorize the city clerk to approve all tax parcel sale requests from the Butler County Repository by the Butler County Tax Claim Bureau. Second by CM Christy.  All voted aye.

    15.Motion to install two “No Parking Here to Corner” signs on the south side of West New Castle St. at the intersection of Wagner Ave. on a 90-day trial basis. Second by CM Shearer.  All voted aye.

    16.Motion to approve Pennsylvania Heart & Lung Act benefits for Sergeant Jeremy Walters beginning on July 8, 2021, for a work-related injury he sustained on December 14, 2018. Second by CM Shearer.  All voted aye.

    April Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents that when walking your pet, remember to pick up the waste and dispose of it properly. Flushing pet waste is the best disposal method. Leaving the waste on the ground increases public health risks by allowing harmful bacteria and nutrients to wash into storm drains and eventually into the local streams.

    Also, if you plan on washing your vehicle, use a commercial car wash if possible. Car washes are setup to treat or recycle the wastewater. If you want to wash your vehicle, pull the car onto a lawn area to wash it. This way, all of the soap and water will infiltrate into the ground. Try not to wash the car on a paved surface as all the runoff will flow onto the street and into a nearby storm sewer. Soaps, wax, and other chemicals used to clean cars are toxic to fish and aquatic organisms.
