    Mayor Donaldson called the meeting to order at 7:00 PM. Mayor Donaldson and Council members Kline, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by Todd Wentworth, First Baptist Church.

    PERSONS TO BE HEARD:

    Mark Krenitsky – would like the spay/neuter/return program to begin again.

    Motion by CM Schontz with second from CW Kline to approve the minutes of the Regular meeting of August 28, 2014. All voted aye.

    MONTHLY & ANNUAL DEPARTMENT REPORTS

    1. Motion for the second reading and adoption of City Ordinance No. 1696; authorizing the acquisition of a temporary construction easements and permanent rights of way for the reconstruction of the West New Castle Street Bridge. Second by CW Kline. All voted aye.

    2. Motion to direct the City Clerk to seek proposals for limestone, asphalt and petroleum products for Fiscal Year 2015 with such proposals due not later than 2:00 PM on November 17th. Second by CM May. All voted aye.

    3. Motion to approve payment to Joe Palmieri Construction, Inc. for the Main Street and W. New Castle Street sidewalk and curb replacement in the amount of $18,600.00 after final review by the city municipal engineer.

    4. (A copy of the fee schedule shall be attached to the minutes of this meeting.) Second by CW Kline. All voted aye.

    5. Motion to install two “No Parking Between Signs” in the alley directly behind 109 Sumner Avenue on a 90-day trial basis. Second by CW Kline. All voted aye.

    Councilman May

    6. Motion to enter into an agreement with the Butler Boys Scholastic Lacrosse Association to lease the Memorial Park Field to use as a lacrosse field for four months commencing March 16, 2015 through June 15, 2015. Second by CW Kline. All voted aye.

    7. Motion for the second reading and adoption of City Ordinance No. 1694; an ordinance of the City of Butler, Pennsylvania, amending Chapter 104; Animals; to add Article IV; Wild or Exotic Animals. Second by CW Kline. All voted aye.

    8. Motion for the second reading and adoption of City Ordinance No. 1695; an ordinance of the City of Butler, Pennsylvania, amending Chapter 60; Personnel Policies; to establish a Social Media Policy. Second by CW Kline. All voted aye.

    9. Motion to enter in an agreement with Direct Energy Business, LLC to reduce the price of kilowatt per hour for the City’s electricity costs. Second by CW Kline. All voted aye.

    10. Motion to approve City Resolution No. 2014-09-25; revising the 2012 CDBG Program as follows; Reduce the Parks, Recreation Facilities – Rotary Park line item by $8,383 and reallocate the same amount to the Street Improvement – Reconstruction line item. Second by CM Schontz. All voted aye.

    11. Motion to direct the City Clerk to advertise for proposals for collections of the parking meters. Second by CW Kline. All voted aye.

    The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for August, 2014.

    The City Controller presented bills for payment as follows: from the general fund – $255,974.58; from the capital projects fund – $21,728.12; and from the liquid fuels tax fund – $2,747.00 for a grand total of $280,449.70. Motion by CM May with second from CM Schontz to approve payment of bills as presented.

    August 28, 2014

     Mayor Donaldson called the meeting to order at 7:00 PM.  Mayor Donaldson and Council members Readie, Kline, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by Deacon Mitch Natali, St. Paul’s Catholic Church.

    PERSONS TO BE HEARD:

     Alexander Howes shared concerns over the parking for residents who live in the business district and the safety of vehicles parked in the Tier Parking Garage. He suggested closed circuit monitoring of the garage. Mr. Howes also requested that the City reduce the volume of the crossing tones keeping in regulations required from ADA.

     David Gould voiced his frustration with the Code Office and the current procedures for code enforcement.

    COUNCIL REPORTS/ACTIONS

     

    Councilwoman Kline

     1. Motion to authorize Michael A. Palombo, Esq., the arbitrator appointed by the City of Butler for Act 111 Interest Arbitration with the I.A.F.F., to dissent from the Award dated August 9, 2014 issued by Arbitrator Michael E. Zobrak and Arbitrator Richard G. Poulson, Esq.  Second by CM Schontz.  All voted aye.

    2. Motion to authorize the City Solicitor to appeal the Act 111 Interest Arbitration Award entered on August 8, 2014 to the Court of Common Pleas of Butler County, Pennsylvania for the limited purpose of challenging the legality of the Arbitrators failure to eliminate the terms in the Collective Bargaining Agreement which require the City to maintain a Minimum Complement of 18 full time firefighters.  Second by CW Readie.  All voted aye.

    3. Motion for the second reading and adoption of City Ordinance No. 1692; an ordinance of the City of Butler amending Chapter 260, the zoning ordinance of the City of Butler, to add medical and dental clinics in the M-1 and M-2 Zoning District as permitted uses. Second CW Kline.  All voted aye.

     

    4. Motion to appoint Norm George as the City of Butler’s Sewage Enforcement Officer.

    Second by CW Kline.  All voted aye.

    5. Motion to approve the contract with Cargill, Inc. for the purchase of road salt at $79.29/ton for the period from August 28, 2014 to June 30, 2015. (SHACOG Purchasing Alliance) Second by CW Kline. All voted aye.

    6. Motion to amend the Motion adopted at a Special Meeting held July 8, 2014 to approve the Conditional Use request for A&R Health Services located at 128 West New Castle Street with the following conditions:

    1. A&R Health Services must establish staggered appointment times for clients as necessary to avoid parking and congestion problems.

    2. The Maximum number of occupants shall be determined by the Fire Marshall per UCC calculations, but occupancy cannot exceed 12 people.

    3. A&R Health Services shall prevent loitering and prohibit smoking within 25 feet of the building.

    4. Hours of operation shall be 9:00 AM through 6:30 PM Monday through Saturday.

    5. A&R Health Services must provide the City with a parking plan calling for off-street parking for the staff.

    6. A&R Health Services is not licensed by the Commonwealth and therefore cannot provide counseling or therapy services.

    7. Any violation of these conditions shall result in the revocation of the occupancy permit. Further, a finding by the City of a legal nuisance will be a violation of A & R’s occupancy permit and grounds for the occupancy permit to be revoked. Second by CW Kline.  All voted aye.

    7. Motion to award the contract for the Mercer Street Bridge railing repairs to Troy Jay Construction, Inc. in the amount of $2,100.00. LIN 18-430-436.  Second by CW Kline.  All voted aye.

    8. Motion to authorize the Mayor and City Clerk to execute and deliver an Agreement for Temporary Right of Way with James and Susan Dankovich calling for payment to the Owner of $500 and reimbursement for counsel fees incurred by the Owner for the West New Castle Street Project.  Second by CW Kline.  All voted aye.

    9. Motion to install two “Watch Children” signs on the west and east end of Cleveland Street on a 90-day trial basis. Second by CW Readie.  All voted aye.

    10. Motion to install a “Private Drive” sign at 309 Hickory Street (new driveway) on a 90-day trial basis. Second by CW Kline.  All voted aye.

    11. Motion to install two blinking “Watch Pedestrians” signs on South Cliff Street near the intersection of East Jefferson and East Cunningham Streets on a 90-day trial basis. Second by CW Kline.  All voted aye.

    12. Motion to install two “No Parking on Sidewalk” signs on the north side of Zeigler Avenue above the playground on a 90-day trial basis. Second by CW Readie.  All voted aye.

    13. Motion to change Wyle Avenue to be “One-Way” southbound beginning at West New Castle Street on a 90-day trial basis.  Second by CW Kline.  All voted aye.

    14. Motion to create a “No Parking” zone on the west side of Sixth Avenue from West New Castle Street to the parking lot on a 90-day trial basis. Second by CW Kline.  All voted aye.

    15. Motion to purchase a 2008 Crown Victoria from Penn Township, in the amount of $800 for use by the Code Officer. Second by CW Readie.  All voted aye.

    16. Motion for the introduction and first reading of City Ordinance No. 1696; authorizing the acquisition of a temporary construction easements and permanent rights of way for the reconstruction of the West New Castle Street Bridge.  Second by CW Readie.  All voted aye.

    19. Motion to award the contract for providing a Phase 1 Environmental Site Assessment to Ecotune Environmental Consultants in the amount of $2,800.00 for the property at the corner of Zeigler Avenue and Short Street.  LIN 01-427-120.  Second by CW Readie.  All voted aye.

    20. Motion to enter into an agreement with the Butler Area Softball League to lease the Pony League Field and concession stand in Father Marinaro Park for two months commencing September 1, 2014 through October 31, 2014. Second by CW Kline.  All voted aye.

    21. Motion to approve the Conditional Use request of the Butler Area Sewer Authority to construct a new pump station as presented, including the use of barbed wire on the fence, and with the condition that:

    1.  The Authority use a landscaping plan that includes a combination of panel weave in a black fence and planting mature shrubs on the property, as filed with the City.

    Second by CM May.  All voted aye.

    22. Motion for the introduction and first reading of City Ordinance No. 1694; an ordinance of the City of Butler, Pennsylvania, amending Chapter 104; Animals; to add Article IV; Wild or Exotic Animals.  Second by CW Kline.  All voted aye.

    24. Motion to appoint Mark Wilson to serve on the Civil Service Board to replace Jonathan Dreher whose term ends on December 31, 2017.  Second by CM Schontz.  All voted aye.

     

    25. Motion to mail letters from the Mayor and City Council to the City’s Boards and Authorities requesting they meet 5:30 PM or later therefore giving more city residents the opportunity to attend the meetings. Second by CW Readie.  All voted aye.

    July 24, 2014

    Mayor Donaldson called the meeting to order at 7:00 PM. Mayor Donaldson and Council members Kline and May were present. The pledge of allegiance to the flag followed an invocation given by Associate Pastor Tim Goodman, First United Methodist Church.

    PERSONS TO BE HEARD:

    Gena Kopnicky and Brittany Rohr from Cyclewarehouse: Presented a request for use of the West New Castle Street Plaza on August 9th.

    Ed Schnur – Rodfathers – concerns about increasing special event costs.

    Dan Cunningham – Rodfathers – concerned increase in special event costs may prohibit the groups’ ability to hold the annual Cruise-a-palooza in the city.

    Cheri Hershberger; Fall Festival – increase in special event costs will cause a hardship for their event.

    Mark Krenitsky – pleased to see progress in selling the Penn Theater and glad to see the City Code concerning alcohol on city property is being enforced.

    At a Public Hearing held on July 8, 2014 at 7:00 PM, Mayor Donaldson made a motion to approve the Conditional Use request for A & R Health Services located at 128 West New Castle Street with the following conditions:

    1. Use staggered appointment times for clients.
    2. Maximum number of occupants in group sessions to be determined per UCC calculations by the Fire Marshall, and not to exceed 12 people.
    3. No loitering and no smoking within a 25 foot perimeter of the building.
    4. Hours of operation shall be 9:00 AM to 6:30 PM Monday through Saturday.
    5. A finding by the City of being a nuisance property will be a violation of A & R’s occupancy permit and grounds for the occupancy permit to be revoked.
    *6. The City will require a copy of the facility’s State Health License or absolute proof that the License is not required before issuing an occupancy permit. The City will require a copy of any other State or Federal License that is required to operate this type of facility before issuing an occupancy permit.
    7. A & R must provide the City with a parking plan for off-street parking for the staff.

    *A & R must comply with item #6 no later than 15-August-2014.

    Second by CW Kline. CW Readie, CW Kline and CM Schontz voted aye. CM May and Mayor Donaldson voted no. Motion passed.

    The following actions took place at the Public Hearing held on July 22, 2014:

    CM Schontz made a motion to approve the Conditional Use request for Accessible Dreams to construct a two unit townhouse at 316 S. Chestnut Street under Codified Ordinance §260-22H, in accordance with the plans submitted to Council. Second by CM May. All voted aye.

    COUNCIL REPORTS/ACTIONS

    1. Motion to approve the 2015 Minimum Municipal Obligations for the City’s three pension plans as follows: for the Firefighters Pension Plan – $168,064 and for the Police Pension Plan – $222,266 and the Officers and Employees Pension Plan – $22,728.
    Second by CM May. All voted aye.

    2. Motion to approve City Resolution no. 2014-07-24 approving to revise the 2013 CDBG program as follows: Reduce the Rehab: Single Unit Residential by $22,400 and reallocate the same amount to the Code Enforcement line item and utilize the remaining balance in the Rehab: Single Unit Residential towards the HOME Owner Occupied Housing Rehabilitation program. Second by CW Kline. All voted aye.

    3. Motion to approve City Resolution No. 2014-07-24A; the City of Butler’s Fair Housing Resolution. Second by May. All voted aye.

Second by CM May. All voted aye.

    5. Motion for the introduction and first reading of City Ordinance No. 1692; an ordinance of the City of Butler amending Chapter 260, the zoning ordinance of the City of Butler, to add medical and dental clinics in the M-1 and M-2 Zoning District as permitted uses.     6. Motion to approve a block party on Broad Street from West North Street to West Brady Street on Sunday, July 27, 2014 from 4:00 PM to 7:00 PM. Second by CM May. All voted aye.

    7. Motion to approve the purchase of Freedom System software in the amount of $22,480.00. ($22,400 to be reimbursed with 2013 CDBG Funds. Any excess costs to be paid from LIN 18 427 221.) Second by CM May. All voted aye.

    8. Motion to install two “No Parking Between Signs” on S. Elm Street from the alley to East Jefferson Street on a 90-day trial basis. Second by CW Kline. All voted aye.

    12. Motion to accept the bid from and approve payment to Bauer Excavating, Inc. in the amount of $9,105.00 for the Sullivan Run cleanup project after review and approval by the municipal engineer. Second by CW Kline. All voted aye.

    13. Motion to enter into an agreement with the Butler Area School District to acquire temporary and permanent easements for the West New Castle Street bridge project.

    14. Motion to approve the Supplemental-B; Non-Federal-Aid Project Reimbursement Agreement with PennDot for the West New Castle Street Bridge project. (Agreement No.: 102682-B) Second by CW Kline. All voted aye.

    15. Motion to pass City Resolution no. 2014-07-24B; authorizing Mayor Donaldson to sign an Agreement between the City of Butler and PennDOT for the Supplemental-B agreement for the West New Castle Street Bridge project. Second by CM May. All voted aye.

    16. Motion to transfer funds from Line item 01-430-373 “Contract Services” to Line item 18-430-439 “Capital Projects” for the purpose of re-allocating funds to the 2014 Paving Projects. Second by CW Kline. All voted aye.

    17. Motion to accept the bid from Peter J. Caruso & Sons in the amount of $147,238.50 for the 2014 Street Paving after review by the municipal engineer. Second by CW Kline. All voted aye.

    18. Motion to authorize Butler County to pave that portion of South Jackson Street lying between West Diamond Street and Vogely Street following the construction of the new Addition to the Butler County Government Center, subject to the following conditions:

    1. That portion of South Jackson Street lying within 12 feet of the northerly line of W. Diamond Street shall remain as a brick street.
    2. The County shall cause all bricks to be removed and delivered to the City of Butler at a location in Butler to be specified by the Streets Department.
    3. The County shall cause South Jackson Street to be reconstructed in accordance with PennDot specifications and acceptable to the City Engineer.

    19. Motion to approve an agreement with the Butler Midget Football League for the 2014 season. Second by CW Kline. All voted aye.

    20. Motion to enter into a Settlement and Release Agreement with the Housing Authority of the County of Butler concerning the Island Playground. Second by CW Kline. All voted aye.

    21. Motion to approve the “Bike Show” to be held on August 9, 2014, beginning at 9 AM at the West New Castle Street Plaza; sponsored by Cyclewarehouse. Second by CW Kline. All voted aye.

    22. Motion for the introduction and first reading of City Ordinance No. 1693; an ordinance of the City of Butler, Pennsylvania, amending Chapter 232; Article VII; Street use permit for parades and special events, of the codified ordinances of the City of Butler. Second by CW Kline.

    June 26, 2014

    Mayor Donaldson called the meeting to order at 7:01 PM.  Mayor Donaldson and Council members Readie, Kline,and Schontz were present. The pledge of allegiance to the flag followed an invocation given by Reverend James W. Dollhopf, First English Lutheran Church.

    PERSONS TO BE HEARD:

     Lois J. Keith – voiced concerns over snakes being at the city’s events.

    Justin Ellis – presented his Eagle Scout project at the Rotary Park. The plans are to hold a dedication on August 13th.

    Steven King – lead singer, Trigger Happy; shared his views about permitting alcohol in the West New Castle Street Plaza and thanked Council for the opportunity to perform for the city of Butler.

    Kirk Bergbigler – Butler County Bears; asked Council to permit the Bears to play their final home game on July 10th; He suspended the 6 players that were unruly at the last game played.

    At its Forum Meeting on June 24, 2014, Mayor Donaldson made a motion to approve the “Downtown Domination” fundraising event that will be held on August 16, 2014 in the West New Castle Street Plaza.  Second by CM Schontz. All voted aye.

     CW Readie distributed budget preparation materials for Fiscal Year 2015 at Council’s Forum meeting on June 24th.  All elected officials and department heads received copies. Revenue projections are due August 26th, and budget requests from departments are due September 1st.  A draft 2015 budget will be presented to Council on September 23rd.

    1.Motion to pay the second and final installment of the 2013 small borrowing loan to NexTier Bank in the amount of $104,089.88.

    4.  Motion to reappoint Anne Thomson to the Planning & Zoning Commission for a 4 year term ending June, 2018.  Second by CW Readie. All voted aye.

Motion for the introduction and first reading of City Ordinance No. 1691; an ordinance of the City of Butler, Pennsylvania amending the City’s traffic control schedule contained in Chapter 245 of the Codified Ordinance of the City of Butler by making permanent experimental regulations previously adopted by City Council on a 90-day trial basis.    Second by CW Kline. All voted aye.

    12.  Motion to approve the County’s request to pave West Vogely Street and South Jackson Street instead of placing the bricks back onto the streets.  Second by CW Kline.  There was discussion concerning the maintenance that will be needed over the years for paved streets. All voted no.

    13.  Motion to install a “Loading Zone 6 AM – 5 PM” sign at the southwest corner of S. Main Street and W. Wayne Street on a 90-day trial basis. Second by CW Readie.  All voted aye.

    14. Motion to approve a request from Regis Green for a 20-foot residential curb cut at 427 West New Castle Street for their off-street parking.  Second by CW Kline.  All voted aye.

    15.  Motion to approve the conditional use request for the Sons of Italy Club located at 338 South Main Street conditioned upon the Fire Marshall calculating the occupant load of the building.  The SOI must post the Occupant Load Placard issued by the Fire Marshall.  Second by CW Readie.  All voted aye.

    16. Motion to approve the purchase of hardware and software for the Office of Business and Community Development in the amount of $4,500.00 from Perfection Services.

     20. Per recommendation from the Civil Service Board, motion to permit two civil service applicants reschedule their oral exams to be held the first week of July, due to their military deployment during the regularly scheduled oral examination period.  Second by CM Schontz.  All voted aye.

    Motion to approve the Butler Downtown “Up on the Roof” fundraising event to be held on July 19, 2014.  Second by CW Kline.  All voted aye.

Motion by CW Readie with second from CW Kline to approve payment of bills as presented. All voted aye.

    May 22, 2014

     Mayor Donaldson called the meeting to order at 7:00 PM.  Mayor Donaldson and Council members Readie, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by Pastor Steve Ogle, Community Life Church.

Motion for the adoption of City Ordinance No. 1690; an ordinance increasing the indebtedness of the City of Butler, Butler County, Pennsylvania by the issue of a General Obligation Note in the amount of $205,000.00 for the purpose of the street paving, storm sewer repairs, and bridge repairs. Second by CM Schontz.  All voted aye.

    2. Motion to approve a payment in the amount of $604,504.50 to NexTier Bank for the 2014 Tax Revenue Anticipation Note.  $600,000.00 Principal (LIN 01 472 601)   &   $4,504.50 Interest (LIN 01 472 600) – payoff date is May 23, 2014.  Second by CM May.  All voted aye.

Motion for the second reading and adoption of City Ordinance No. 1689, an ordinance of the City of Butler, adding, as Chapter 135 of the Codified Ordinances; Emergency Services; Article I; Cost Recovery; relating to the recovery of costs associated with the provision of emergency services by the City; establishing fees for specialty rescue, training and inspection services; and providing for payment of fees for costs associated with unlocking or attempting to unlock doors for private property owners or tenants. Second by CM Schontz.  All voted aye.

    4. Motion to approve Pennsylvania Heart & Lung Act benefits for Firefighter Richard Walters, Jr. beginning on May 8, 2014 for a work-related injury he sustained on March 24, 2014.  Second by CW Readie.  All voted aye.
