    April 23, 2015

    Mayor Donaldson called the meeting to order at 7:00 PM.  Mayor Donaldson and Council members Readie, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by the Reverend Merry Hope Meloy, St. Andrews United Presbyterian Church.

    PRESENTATIONS:

     Neighborhood Pride Award:

     PERSONS TO BE HEARD:

    Debora Bicker voiced concerns about 306 Virginia Avenue becoming a halfway house for released prisoners.

    Denny Offstein voiced concerns about the metal thefts and requested security cameras in the Island Area.

    Jeff Smith said that if elected county commissioner that he would support the city.

    Motion by CW Readie with second from CM Schontz to approve the minutes of the Regular meeting of March 26, 2015. All voted aye.

     The following action took place at the City’s Forum Meeting held on April 21, 2015:

    1. City Council, acting as the Board of Health, and under the provisions of the Third Class City Code, Section XXIII, (b) Abatement of Public Nuisances, Section 2321, found the following subject structure detrimental to public health and ordered its removal by demolition:

    1. Motion to direct the City Clerk to re-advertise for bids for a general obligation loan of $375,000.00 for street paving, storm sewer repairs and demolition, payable in 2015 and 2016. Second by Mayor Donaldson. All voted aye.

    2. Motion to approve City Resolution No. 2015-04-23; a resolution of the City of Butler authorizing the filing of an Application for funds with the Department of Community and Economic Development (DCED), Commonwealth of Pennsylvania, by the Redevelopment Authority of the     City of Butler. Second by CM Schontz. All voted aye.

    3. Motion for the second reading and adoption of City Ordinance No. 1709; an ordinance of the City of Butler amending Chapter 260, the Zoning Ordinance of the City of Butler, to add a general regulation confirming the duty for businesses to obtain an occupancy permit for zoning compliance. Second by CM May. All voted aye.

    4. Motion for the second reading and adoption of City Ordinance No. 1710; an ordinance of the City of Butler, Pennsylvania amending the City’s traffic control schedule contained in Chapter 245 of the Codified Ordinance of the City of Butler by making permanent experimental regulations previously adopted by City Council on a 90-day trial basis. Second by CW Readie. All voted aye.

    5. Motion for the second reading and adoption of City Ordinance No. 1711; an ordinance to adopt the International Property Maintenance Code 2012 and appendix “A” thereof, to provide for local enforcement     thereof, and to repeal legislation inconsistent therewith. Effective June 1, 2015. Second by CW Readie. All voted     aye.

    6. Motion to award the bid to A P Wise Excavating in the amount of $5,900.00 for the demolition of 310 N.Cliff Street, based on the general specifications of the contract and the release by the City Solicitor. LIN 01 427 221. Second by CW Readie. All voted aye.

    7. Motion to accept the bid from Wiest Asphalt     Products & Paving, Inc. in the amount of       $206,842.00 for the 2015 Street Paving after review         by the municipal engineer. LIN 18 430 439. Second by       CW Readie. All voted aye.

    8. Motion to accept the bid from Joe Palmieri       Construction, Inc. in the amount of $48,220.00 for curb ramps and sidewalks after review by the               municipal engineer. LIN 18 430 439. Second by CW           Readie. All voted aye.

    9. Motion to accept the bid from Gregori Contracting, Inc. in the amount of $24,450.00 for the Jefferson Street storm sewer installation after review by the municipal engineer. $15,000.00-LIN 01 430 373$5,000.00-LIN 18 430 436; $4,450.00-LIN 18 430 439Second by CW Readie. All voted aye.

    10. Motion to accept the resignation of Kent Bowen from     the Zoning Hearing Board effective immediately. Second by CW Readie. All voted aye.

    11. Motion to direct the City Clerk to re-advertise for sale one used 2004 Ford Crown Victoria that was purchased for city code enforcement. Second by CM May. All voted aye.

    12. Motion to reappoint JoAnn Snyder to the BAMM Plan Oversight Committee for a three year term which expires on January 1, 2018. Second by CW Readie. All voted aye.

    13. Motion to purchase a mini-paver from Butler Township in the amount of $2,000.00.LIN 18 430 439. Second by CW Readie. All voted aye.

    14. Motion to appoint Frank Cicco to the City of Butler Parks, Recreation Grounds & Facilities Authority to fill the remainder of Leonard Pintell’s term which expires on January 1, 2017. Second by CM Schontz. All voted aye.

    15. Motion to appoint John Spinetti to the City of Butler Parks, Recreation Grounds & Facilities Authority to fill the remainder of Edward Codi’s term which expires on January 1, 2017. Second by CW Readie. All voted aye.

    16. Motion to reappoint Chris Ziegler to the Bicycle Advisory Commission for a four year term which expires January 1, 2019. Second by CW Readie. All voted aye.

    17. Motion to enter into an agreement with Butler Twisters Baseball for use of Father Marinaro Park commencing on April 23, 2015 through May 31, 2015. Second by Mayor Donaldson. All voted aye.

    18. Motion to appoint Vocational & Psychological Services as the city’s Civil Service psychological examiner. Second by CW Readie.  All voted aye.

    19. Motion to appoint Nallathambi Medical Association as the city’s Civil Service physical examiner. Second by CW Readie. All voted aye.

    20. Motion to enter into a contract with the Community Development Corporation of Butler County to perform Construction Management Services for the City of Butler Tier Parking Garage/Center City Project, with Joseph Saeler to serve as the responsible party, services to be provided at an hourly rate of $75.00 per hour. Second by CM Schontz. All voted aye.

    21. Motion to approve the Residential Anti-Displacement and Relocation Assistance Plan applicable to the Community Development Block Grant program. Second by CW Readie. All voted aye.

    22. Motion to approve the Citizen Participation Plan for the City of Butler and Redevelopment Authority of the City of Butler Community Development Block Grant/Home Programs. Second by CM Schontz. All voted aye.

    The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for March, 2015.

    The City Controller presented bills for payment as follows: from the general fund – $221,676.16; from the capital projects fund – $4,652.24; and from the liquid fuels tax fund – $73,612.67 for a grand total of $299,941.07. Motion by CM May with second from Mayor Donaldson to approve payment of bills as presented. All voted aye.

    ANNOUNCEMENTS:

     Mayor Donaldson thanked Peoples TWP and Pennsylvania American Water for their generous donations for the City’s 4th of July fireworks.

    Councilman May reported that a grant was awarded to the city in the amount of $5,235.00 to renovate the Safe Zone Area at Father Marinaro Park from the application he made through the Butler County Parks Renovation Program Community Grant Program.

    March 26, 2015

    Mayor Donaldson called the meeting to order at 7:03 PM.  Mayor Donaldson and Council members Readie, Kline, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by Pastor Jeff Harris, Crossroad Community.

    PRESENTATIONS:

    George Schroth & Charlie Roche presented a check in the amount of $4,001.52 from the murder mystery fundraiser “I Loathe Lucy” that they held for the K-9 Fund.

     Paul Dunn, J S Capital, reported they received approval for the loan from NexTier for the hotel.

     Mr. Dritan Balanca, Tani’s Pizza – 100 Mercer Street

     PERSONS TO BE HEARD:

     Mark Krenitsky voiced concerns about tenants who leave garbage on and around the property they are renting.  He also showed interest in properties scheduled for demolition.

    1.  Motion to approve payment to the Butler Area Public Library in the amount of $32,603.81 that represents the proceeds from the City’s 2014 library tax. Second by CW Kline. All voted aye.

    2.  Motion to direct the City Clerk to advertise for bids for a general obligation loan of $375,000.00 for street paving, storm sewer repairs and demolition, payable in 2015 and 2016. Second by CW Kline. All voted aye.

    3.  Motion to approve City Resolution no. 2015-3-26 approving to revise the 2013 CDBG program as follows: Reduce the Acquisition of Real Property line item by $30,000 and reallocate the same amount to the Rehab: Single Unit Residential line item.

    Second by CM Schontz.  All voted aye.

    4.  Motion to designate Mr. Arthur G. Cordwell as the City’s fair housing officer for 2015. Second by Mayor Donaldson. All voted aye.

    10.  Motion to approve a lease agreement between the City of Butler and the Butler Area Baseball Association (BABA) for use of facilities in Father Marinaro Park, and to designate the City’s Director of Parks, Recreation & Public Property as its agent for enforcing the terms of said agreement. Second by CW Readie. All voted aye.

    11.  Motion to appoint Diane Downs to the City of Butler Parks, Recreation and Grounds Authority to replace Jack Cohen, whose term ends January 1, 2016. Second by CW Readie. All voted aye.

    12.  Motion to direct the City Solicitor to research the deed to the City for the bathhouse and pool area in Memorial Park to determine if the title includes any reservation which would limit the marketability of the title. Second by CW Readie. All voted aye.

    13.  Motion to enter into a Reimbursement Agreement between the City of Butler and the Parking Authority calling for the Parking Authority to pay engineering fees to Gateway Engineering for the design of the new Tier Parking Garage to be constructed on South McKean Street in an amount not to exceed $165,000, subject to the City’s duty to reimburse the Parking Authority when the Parking Authority Debt is restructured in 2015, either through a bond issue, or through conventional financing, to be undertaken by the City on or before December 1, 2015.  Second by CM May.  All voted aye.

    14.  Motion to approve the Revolving Loan Committee Fund as proposed by the Economic Restructuring Committee of Butler Downtown. The five members are: Brian McCafferty (Kenmac), Joe Gray (JG Consulting), Ron Germani (NexTier Bank), Darcy Chasse (PNC Bank) and Tom Graham (FRAMES & PIXELS, Butler Downtown Board). Second by CM Schontz.  All voted aye.

    15.  Motion to approve a three-year extension of the cooperation agreement between the City and the Redevelopment Authority of the City of Butler for administration of the City’s Community Development Block Grant Program Funds, HOME Program funds and other State and Federal funds with such extension running through October 1, 2017. Second by CW Readie. All voted aye.

    The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for February, 2015.

    In the absence of the City Controller, the City Clerk presented bills for payment as follows: from the general fund – $263,930.05; from the capital projects fund – $29,479.72; and from the liquid fuels tax fund – $170,468.50 for a grand total of $463,878.27. Motion by CW Readie with second from CM May to approve payment of bills as presented.  All voted aye.

    February 26, 2015

     Mayor Donaldson called the meeting to order at 7:00 PM.  Mayor Donaldson and Council members Readie, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by the Reverend Dan Ledford, Westminster Presbyterian Church.

     PERSONS TO BE HEARD:

     Mark Krenitsky spoke about Allegheny County sending letters to the tax-exempt properties requesting confirmation of their tax exempt status.  Mr. Krenitsky also felt that the County should lease the parking spaces in the Quarry Street lot.  Also discussed was the need for the city fire department to rely on the township fire department more often.

    Motion by CM Schontz with second from CM May to approve the minutes of the Regular meeting of January 22, 2015 and the minutes of the special meeting of January 29, 2015.

    7. Motion to approve payment in the amount of $1,600.00 to A P Wise Excavating for the emergency demolition of the garage at the rear of 215 Howard Street upon final inspection. LIN 01 427 221 Second by CW Readie.  All voted aye.

    8. Motion to approve City Resolution No. 2015-02-26; the City of Butler agrees to comply with the requirements of the Butler County Parks Renovation Program for the purpose of obtaining grant funds for the renovation of Father Marinaro Park. Second by CM Schontz. All voted aye.

    9. Motion to award the contract to Wiest Asphalt Products and Paving, Inc., to install an asphalt basketball court at Rotary Park at a cost of $5,250.00 to be paid with the Spray Park Funds. (LIN 01 489 010) Second by CW Readie. All voted aye.

    10.  Motion to approve purchase of playground equipment and installation of playground equipment by Jeffrey Associates through the Keystone Purchasing Network (KPN) of Playworld #FUN1493 play unit, Playworld #SWING-SP8 w/2 seats for a total cost of $23,742.00. Purchase is contingent on the release of funds ($20,000.00) by the Butler County Housing Authority per agreement. Balance to be paid with the Spray Park Funds (LIN 01 489 010).  Second by CW Readie.  All voted aye.

    11. Motion to approve the purchase, delivery, and installation of load engineered wood fiber surface (60 yards) from Jeffrey Associates for the purpose of providing safe zone fall area material at Rotary Park for a total cost of $1,134.00 to be paid with the Spray Park Funds (LIN 01 489 010). Second by CW Readie. All voted aye.

    12. Motion to approve a cooperation agreement with the Butler Downtown for their events to be held in the West New Castle Street Plaza. Second by CW Readie. All voted aye.

    13. Motion for the second reading and adoption of City Ordinance No. 1706; an ordinance of the City of Butler, Butler County, Pennsylvania, establishing a residential parking program; establishing a residential parking area in which commuter parking is prohibited and prescribing penalties for violation of the ordinance.  Second by CW Readie. All voted aye.

    14. The City Treasurer presented Council with the Account Balance Report and the Monthly Intake Report for January, 2015.  Treasurer Smith thanked Nicole Boldy for her work for the city and wished her good luck in the future.

    15. The City Controller, presented bills for payment as follows: from the general fund – $583,502.45; from the capital projects fund – $78,354.75; and from the liquid fuels tax fund – $2,521.00 for a grand total of $664,378.20. Motion by Mayor Donaldson with second from CW Readie to approve payment of bills as presented.  All voted aye.

    January 29, 2015

     Mayor Donaldson called the meeting to order at 6:30 PM.  Mayor Donaldson and Council members Kline, Schontz and May were present.

    Gateway Engineers presented an agreement and timeline for the design of the parking garage for the Center City Project.

    Tom Graham discussed the reorganization of the Butler Downtown Group.

    Councilman Schontz

    1. Motion for the introduction and first reading of City Ordinance No. 1708, an ordinance of the City of Butler vacating a portion of Birch Street from South Cedar Street to South McKean Street. Second by CW Kline. All voted aye.

    2. Motion to enter into an agreement with XTO Energy, Inc. for the repair of streets damaged by XTO Energy, Inc. on ARMCO Drive. Second by CW Kline. All voted aye.

    3. Motion to transfer the duty to receive emergency calls and to dispatch police personnel from the Bureau of Police to the Butler County 911 Center, to be effective when the County notifies the City that the 911 Center is ready to assume this responsibility. Second by CM Schontz. All voted aye.

    4. Motion to enter into an agreement with Gateway Engineers for the design of the parking garage for the Center City Project. Second by CM May. All voted aye.

    5. Motion to approve City Resolution No. 2015-01-29 obligating $22,601.00 of City revenues to the Butler Transit Authority for fiscal year 2015/2016. Second by CM Schontz.  All voted aye.

    6. Motion to authorize the Mayor and the Chief of Police to purchase a used police cruiser at a cost not to exceed $3,800.00. Second by CM Schontz. All voted aye.

    January 22, 2015

     Mayor Donaldson called the meeting to order at 7:00 PM.  Mayor Donaldson and Council members Readie, Kline, Schontz and May were present. The pledge of allegiance to the flag followed an invocation given by the Reverend Dan Ledford, Westminster Presbyterian Church.

     PERSONS TO BE HEARD:

    Mark Krenitsky – would like to be able to call the day prior to council meetings to be on the agenda.  Mr. Krenitsky was pleased with the ease of the tenant reporting for the treasurer’s office.  He is concerned about the city going into debt.

     Brian Helfer – voiced his concerns about the refuse collection contract and asked that it be revised.

     Motion by CM Schontz with second from CM May to approve the minutes of the Regular meeting of December 18, 2014.  All voted aye.

     MONTHLY & ANNUAL DEPARTMENT REPORTS

    Department reports for the month of December and 2014 year-end reports were approved by individual, unanimous votes.

    The monthly and annual reports to be presented by the Treasurer and the City Clerk will be distributed once the monthly audit has been completed.

    The following actions took place at the Forum Meeting held on January 20, 2015:

    Mayor Donaldson made a motion to enter into an agreement with the Parking Authority of the City of Butler and the Butler Hotel Properties, LP. Second by CM May.  All voted aye.

    COUNCIL REPORTS/ACTIONS

    1. Motion for the second reading and adoption of City Ordinance No. 1705, an ordinance of the City of Butler authorizing and directing the incurrence of non-electoral debt in an amount not to exceed seven million dollars ($7,000,000) through issuance of a series of general obligation bonds for the purpose of refinancing the Parking Authority’s 2003-series and 2005-series general obligation bonds and for the purpose of constructing a parking deck on South McKean Street and East Cunningham Street and for other purposes stated therein. Second by CW Kline. All voted aye.

    2. Motion to move the Capital Projects Fund into First Commonwealth Bank’s “Public Funds Money Market” and “Free Public Checking” accounts. Second by CM Schontz. All voted aye.

    3. Motion for the introduction and first reading of City Ordinance No. 1707, an ordinance of the City of Butler, Pennsylvania amending the definition of “New Business” found in Chapter 235, section 235-67 of the codified ordinances. Second by CW Kline. All voted aye.

    4. Motion to approve extending the hiring of Nicole Boldy as a temporary employee through February, 2015 in the Office of the City Treasurer to be paid $12.00 per hour.

    5. Motion to appoint Richard J. Schontz, Jr. to serve as the City’s Emergency Management Coordinator.  Second by CW Readie.  All voted aye.

    6. Motion to appoint Maggie Stock to the Butler Transit Authority for a 5 year term ending December 31, 2019. Second by Mayor Donaldson. All voted aye.

    7. Motion to install two “No Parking From Here To Corner” signs on N. Church Street at the intersection of W. Fulton Street on a 90-day trial basis. Second by CW Kline. All voted aye.

    8. Motion to authorize Councilman May to prepare application for the City of Butler to place the City Building on the National Register of Historic Places by submitting said application to the Bureau for Historic Preservations (BHP), acting as the PA State Historic Preservations Officer (SHPO), which manages the National Register of Historic Places for the National Park Service. Second by CW Kline. All voted aye.

    9. Motion to appoint Don Paul to the City of Butler Parks, Recreation Grounds & Facilities Authority for a five year term which expires on January 1, 2020. Second by Mayor Donaldson. All voted aye.

     CM May extended an official thank you, from the City of Butler, to the Butler Area School District for their recent decision to keep Emily Brittain School and the Junior High School open in the school district restructuring plan.

    10. Motion for the second reading and adoption of City Ordinance No. 1704; an ordinance of the City of Butler amending Chapter 195; Peddling and Soliciting; Article IV; Peddlers of the Codified Ordinances of the City of Butler. Second by CW Readie. All voted aye.

    11. Motion for the introduction and first reading of City Ordinance No. 1706; an ordinance of the City of Butler, Butler County, Pennsylvania, establishing a residential parking permit program; establishing a residential parking permit zone; setting forth criteria for issuance of a permit and temporary permit; establishing responsibilities for a permit holder and prescribing penalties for violation of the ordinance. Second by CM Schontz. All voted aye.

    14.  Motion to approve the retirement of Lieutenant Michael Dalcamo from the Bureau of Police following 24 years of service, effective December 31, 2014. Second by CW Readie. All voted aye.

    15. Motion to make written application to the Civil Service Board for a certified list of candidates to fill the vacancy created by the retirement of Lt. Dalcamo. Second by CM May. All voted aye.

     16. Motion to approve the retirement of Lieutenant Stephen Evanko from the Bureau of Police following 24 years of service, effective February 27, 2015. Second by CW Readie.  All voted aye.

    17. Motion to make written application to the Civil Service Board for a certified list of candidates to fill the vacancy created by the retirement of Lt. Evanko. Second by CM May. All voted aye.

    The City Treasurer, presented Council with an overview of taxes received from 2011 through 2014.

    The City Controller, presented bills for payment as follows: from the general fund – $250,089.59; from the capital projects fund – $556.96; and from the liquid fuels tax fund – $2,521.00 for a grand total of $253,167.55. Motion by CW Kline with second from CM Schontz to approve payment of bills as presented. All voted aye.
