    November 15, 2018

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Roche were present. The pledge of allegiance to the flag followed an invocation given by Pastor Steve Ogle, Community Life Church.      

    Motion by Mayor Smith with a second from CM Walter to approve the minutes of the regular meeting of October 25, 2018 and special meeting of November 5, 2018. All voted aye.

    Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Councilman Walter

    1. Motion for the introduction and first reading of City Ordinance No. 1771, an ordinance of the City of Butler fixing the tax rate for Fiscal Year 2019. Second by Mayor Smith. All voted aye.
    2. Motion for the introduction and first reading of City Ordinance No. 1772, an ordinance of the City of Butler adopting the annual budget and appropriating specific sums estimated to be required for the specific purposes of the City government as set forth therein during Fiscal Year 2019. Second by CM Bonus. All voted aye.
    3. Motion for the introduction and first reading of City Ordinance No. 1773, an ordinance of the City of Butler fixing the wages and salaries of employees of the City in conformance with the budget for Fiscal Year 2019. Second by CM Bonus. All voted aye.
    4. Motion to direct the City Clerk to seek proposals from financial institutions for a 2019 Tax Revenue Anticipation Note in the amount of $1,000,000.00. Second by CM             Roche.  All voted aye.

    Councilman Bonus

    1. Motion to approve payment to E C Masonry, Inc. in the amount of $31,639.95 for the masonry work on the city building per the Architect’s Certificate for Payment request. LIN 18 469 250.  Second by Mayor Smith. All voted aye.
    2. Motion to approve payment to Bauer Excavating, Inc. in the amount of $76,650.10 for the Cunningham Street Culvert Replacement Project. LIN 18 430 436. Second by Mayor Smith. All voted aye.
    3. Motion to approve payment for application #1, to Gregor Contracting, Inc. in the amount of $12,138.75 for the North Monroe Street Culvert Replacement Project. LIN 18 430 436. Second by CM Walter. All voted aye.
    4. Motion to approve City Resolution No. 2018-11-15; a resolution to call for an Amendment to the US Constitution to Abolish Corporate Personhood and the doctrine of Money as Speech. Second by CM Walter. After discussion CM Bonus withdrew the motion. No action taken.
    5. Motions to approve a bid submitted by and award the Fiscal Year 2019 contract for supply of the City’s asphalt materials to:

    Wiest Asphalt Products & Paving, Inc. as follows:

    9.5MM Superpave Wearing Course FOB; $64.00 per ton and 19MM Superpave   FOB;   $56.00 per ton. Total Contract: $96,000.00.

    Russell Standard Corporation, as follows:

    E-3 Emulsion Placed; $2.50/gallon; Total Contract: $25,000.00.  Second by Mayor Smith. All voted aye.

    1. Motion to approve a bid submitted by and award the Fiscal Year 2019 contract for supply of the City’s limestone materials to Allegheny Mineral Corporation, as follows:

    Unit Price Delivered at Job Site: #2A – 18.10 per ton; #4 – $18.80 per ton; #8 – $22.75 per ton; #57 – 19.50 per ton.     Total Contract: $79,150.00. Second by CM Roche.  All voted aye.

    Mayor Smith

    1. Motion for the second reading and adoption of City Ordinance No. 1770, provided by bond counsel, authorizing the issuance of a General Obligation Note in favor of the County of Butler in the maximum amount of $1,850,000.00 to fund capital projects through the Butler County Infrastructure Bank, all in accordance with the Local Government Unit Debt Act. Second by CM Roche. All voted aye.

    The City Treasurer presented a Monthly Intake Report for October, 2018.

    The City Controller presented bills for payment as follows: from the general fund – $574,560.46; from the parking fund – $409,771.86; from the capital projects fund – $127,293.55; and from the liquid fuels tax fund – $1,386.34; for a grand total of $1,113,012.21. Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented. All voted aye.

    November 5, 2018

    Mayor Smith called the meeting to order at 9:08 AM. Mayor Smith and Council members Walter, Smith, Bonus and Roche were present.

    Councilman Walter

    1. Motion for the introduction and first reading of City Ordinance No. 1770, provided by bond counsel, authorizing the issuance of a General Obligation Note in favor of the County of Butler in the maximum amount of $1,850,000.00 to fund capital projects through the Butler County Infrastructure Bank, all in accordance with the Local Government Unit Debt Act. Anthony Ditka, the City’s bond counsel, reviewed the issuance of the General Obligation Note. Second by Mayor Smith. All voted aye.
    2. Motion to approve City Resolution No. 2018-11-05; a resolution of the City of Butler appointing John Grenci, Kenneth Bonus, Jeffrey Smith, Sharon Snyder and Heather Blair as authorized representatives to make requests upon and receive any and all tax information and records from Berkheimer, relative to the collection of taxes for the Taxing Authorities within the Butler County Tax Collection District, as directed and deemed necessary, to be used for official purposes only. Second by Mayor Smith. All voted aye.
    3. CM Walter presented a draft 2019 budget. The budget worksheets were reviewed in their entirety. An updated budget will be presented at the forum meeting on November 13th.

    Mayor Smith recessed the meeting at 1:43 PM. Mayor Smith reconvened the meeting at 1:54 PM.  Mayor Smith adjourned the meeting at 1:54 PM.

    October 25, 2018

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Roche were present. The pledge of allegiance to the flag followed an invocation given by Pastor Alden Towberman, St. Mark’s Lutheran Church.

    The following actions took place at the City’s Forum Meeting held on October 23, 2018:

    1. Motion by Mayor Smith to accept a bid from Gregory Contracting, Inc. in the amount of $79,400.00 for the North Monroe Street Culvert Replacement Project. LIN 18 430 436. Second by CM Walter.  All voted aye.
    2. Motion by Mayor Smith to approve the appointment of Christopher K. Switala as the City’s Fire Chief and ex-officio Fire Marshal in accordance with the provisions of §12107 of the Pennsylvania Consolidated Statutes; Title 11 – Cities, and Chapter 33 of the City Code. Second by CM Roche. All voted aye.

    Chief Switala was sworn into office by Mayor Smith.

    Announcement:

    In accordance with the provisions of §12002 of the Pennsylvania Consolidated Statutes; Title 11 Cities, Mayor Smith announced that Robert O’Neill has been appointed as the City’s Chief of Police.

    Chief O’Neill was sworn into office by Mayor Smith.

    1. Motion to pay $19,800.00 to E C Masonry, Inc. per the Architect’s Certificate for Payment request. LIN 18 469 250. Second by CM Walter. All voted aye.
    2. Motion to reappoint Kerry Dowdy as the city’s Section 504/ADA Officer. Second by Mayor Smith. All voted aye.
    3. Motion to remove the “Limited 20 Minute Parking” signs on the south side of W. Wayne Street between Liberty and Washington Streets on a 90-day trial basis. Second by CM Walter. All voted aye.
    4. Motion to accept the bid from E C Masonry, Inc in the amount of $5,580.00 for the Streets Department Wall Repair project. LIN 01 496 100. Second by Mayor Smith. All voted aye.

    Councilman Roche

    1. Motion to accept a bid from Joshua Cox in the amount of $20,001.00 for the purchase of the 1998 American La France Aerial Fire Truck. Second by Mayor Smith. All voted aye.

    Mayor Smith

    1. Motion to approve an increase in pay in the amount of 20 cents per hour for payroll #19 through payroll #26 for the city clerk, the zoning officer, the plumbing inspector, the parking manager, and the health officer in the City of Butler. Second by CM Roche.  All voted aye.

    Appointments:

    Kate Gougen has been appointed to the Shade Tree Commission to replace Joseph R. Paulisick, Sr., whose term expires June, 2021.

    Doug Kleeman has been appointed to the Shade Tree Commission to replace Jonathon Lex, whose term expires June, 2020.

    In the absence of the City Treasurer, CM Bonus presented a Monthly Intake Report for September, 2018.

    In the absence of the City Controller, the City Clerk presented bills for payment as follows: from the general fund – $596,282.16; from the parking fund – $35,534.23; from the capital projects fund – $55,417.88; from the liquid fuels tax fund – $36,627.34; and from the 2015-Series Bonds fund – $50,000.00 for a grand total of $773,861.61. Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented. All voted aye.

    City Council Meeting

    September 27, 2018

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith and Roche were present. Councilman Bonus joined the meeting via telephone. The pledge of allegiance to the flag followed an invocation given by Pastor Steve Ogle, Community Life Church.

    The following action took place at the City’s Forum Meeting held on September 25, 2018:

    1. A Public Hearing for Ordinance No. 1769 amending Chapter 260, the zoning ordinance of the City of Butler to establish the Ritts Historic and Architectural District was held at the Forum Meeting on Tuesday, September 25, 2018 at 6:30 PM. Several of the residents in the area voiced their concerns to council about the proposed zoning changes. Ferrari Court Reporting recorded the public hearing.
    2. City Council, acting as the Board of Health, and under the provisions of the Third Class City Code, Section XXIII, (b) Abatement of Public Nuisances, Section 2321, found the following subject structure detrimental to public health and ordered its removal by demolition:  119 Third Avenue  Motion by Mayor Smith. Second by CM Walter.  All voted aye.

    PERSONS TO BE HEARD:

    Mark Krenitsky voiced concerns about a “historic” area, reassessments, selling houses in the city and rental properties.

    Tom Donaldson asked about the position of the police chief, vehicles for the police department, police foot patrols, retirement of police chief and deputy chief. He spoke about the trucks purchased from the township, events revenue for the city and debt from an infrastructure loan.

    Motion by Mayor Smith with a second from CM Walter to approve the minutes of the regular meeting of August 23, 2018 and the special meeting of September 8, 2018. All voted aye.

    The Civil Service Commission, represented by Dr. Henry Sinopoli, adopted revisions to the Police Civil Service Rules and Regulations.

    Motion by Mayor Smith with a second from CM Roche to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Shade Tree:   CM Smith stated that he had spent the past 9 months identifying a number of concerns with the operation of the Shade Tree Commission.   Those issues included:

    • Lack of records concerning bench donations.
    • The “missing book” of commemorative donations. Apparently there never was one despite being advertised in their flyers.
    • No plan or policies for replacing dead trees and the failure to address dead or damaged trees (West Cunningham Street is a good example)
    • Failure to follow up on violations of the City’s Shade Tree ordinance
    • Possibly creating a financial liability for the City
    • Possible Sunshine Law violations by some members

    CM Smith further stated that he had hoped these problems would have been addressed but unfortunately, a few of the Commission members seemed to be attempting to divert attention from these issues by citing personality conflicts.

    Upon CM Smith’s request and the Mayor’s support, CM Bonus will undertake the role of liaison with the Shade Tree Commission to lead the effort to focus on these issues and will regularly report back to Council on their progress.

    Councilman Smith made a motion to appoint Councilman Bonus as liaison to the City Shade Tree Commission. Second by Mayor Smith.  All voted aye.

Second by Mayor Smith. All voted aye.
    2. Motion for the second reading and adoption of City Ordinance No. 1767; an ordinance of the City of Butler amending Chapter 69; Purchasing; Article II; Rules and Regulations; §69-15.; Surplus supplies, material and equipment, of the codified ordinances of the City of Butler. Second by CM Roche. All voted aye.
    3. Motion to approve distribution of 2018 State Aid for pension plans as follows: to the Firefighters Pension Plan – $190,031.81, to the Police Pension Plan – $199,639.08 and to the Officers’ & Employees’ Pension Plan – $50,661.63, with the total amount of 2018 State Aid distributed to pension plans being $440,332.52. Second by Mayor Smith. All voted aye.
    4. Motion to approve the transfer of Marlys Frederick to the position of Finance Clerk in the Office of the City Clerk. Second by Mayor Smith. All voted aye.
    5. Motion to direct the city clerk to advertise for the hiring of one parking violation monitor. Second by Mayor Smith. All voted aye.
    6. Motion to ratify a collective bargaining agreement between the City and Local 757/Council 84 of the American Federation of State, County and Municipal Employees, AFL-CIO, for the period January 1, 2018 through December 31, 2020. Second by Mayor Smith. All voted aye.

    1. Motion to approve eliminating an email from the City’s email account used by the Shade Tree Commission. Second by CM Roche. All voted aye.

    1. Motion to remove “No Parking/Bus Loading” on the south side of East Cunningham Street from S. Main Street to S. Cedar Street on a 90-day trial basis. Second by CM Walter. All voted aye.
    2. Motion to install “No Parking/Bus Loading” on the north side of West New Castle Street from N. Washington Street to N. Jackson Street on a 90-day trial basis. Second by CM Walter. All voted aye.
    3. Motion to remove the 30-minute limited parking zone from two spaces on the north side of 120 West New Castle Street in front of Catholic Charities on a 90-day trial basis.  Second by CM Walter. All voted aye.

    Councilman Roche

    1. Motion to approve Pennsylvania Heart & Lung Act benefits for Firefighter Jeffrey L. Scott beginning on September 10, 2018 for a work-related injury he sustained on August 3, 2018. Second by CM Walter. All voted aye.
    2. Motion to hire John Sly Grant Writing Services in the amount of $2,500.00 to apply for the 2018 Assistance to Firefighters Grant (AFG) for the procurement of Rescue Equipment to be used in the department. The City share is 5% of the costs. Second by CM Smith. All voted aye.

    Mayor Smith

    1. Motion for the second reading and adoption of City Ordinance No. 1769; an ordinance of the City of Butler amending Chapter 260, the zoning ordinance, to establish the Ritts Historic and Architectural District. Second by CM Smith. CM Walter voted no.  CM Smith, CM Bonus, CM Roche and Mayor Smith voted aye.
    2. Motion to approve the retirement of Lieutenant John Johnson from the Butler City Police Department following over 19 years of service, effective September 29, 2018. Second by CM Walter. All voted aye.
    3. Motion to approve the promotion of Sergeant Benjamin Spangler to the rank of Lieutenant in the Butler Bureau of Police effective September 30, 2018. Second by CM Walter. All voted aye.
    4. Motion to approve the conditional hiring of Benjamin P. Rogers for patrol officer to fill a vacancy in the Butler City Police Department created by the retirement of Lieutenant John Johnson. Second by CM Walter. All voted aye.
    5. Motion to approve City Resolution No. 2018-9-27; a resolution authorizing the Redevelopment Authority of the City of Butler to file an application for HOME funds for affordable housing activities on behalf of the City with the Department of Community and Economic Development (DCED) Commonwealth of Pennsylvania. Second by CM Walter. All voted aye.
    6. Motion to ratify a revision to the City’s Civil Service Rules and Regulations governing the promotions of police officers as adopted by the Civil Service Commission. Second by CM Walter. All voted aye.

    Appointments:

    Pamela Taylor has been appointed to the Shade Tree Commission for a term of 3 years which will expire June 30, 2020. (She is filling a term that expired June 30, 2017.)

    Jon Lex and Joseph Paulisick, Sr. resigned from the Shade Tree Commission effective immediately.

    August 23, 2018

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Bonus, and Roche were present. The pledge of allegiance to the flag followed an invocation given by Lay pastor Kerry M. Dowdy, East Butler Presbyterian Church.

    The following action took place at the City’s Forum Meeting held on August 21, 2018:

    Motion to send a letter from Butler City Council to the Butler County Assessment Office opposing all property reassessments in the City with one exception to be owner-occupied homes.

    Motion by CM Smith. Second by Mayor.  CM Walter abstained.  CM Smith, CM Bonus, CM Roche and Mayor Smith voted aye.

    NEIGHBORHOOD PRIDE AWARD:

    Stephen L. Gressly, 433 North Chestnut Street

    PERSONS TO BE HEARD:

    Mark Krenitsky was thankful for the dumpster in Rotary Park. He is against permitting searches in rentals.  The fire department grant is not good for the City and he has several Waste Management issues.

    Brian Helfer spoke about information given to the Butler Eagle being incorrect. He believes the policy that is being introduced is unconstitutional and boarders socialism.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1. Motion for the second reading and adoption of City Ordinance No. 1766, an ordinance of the City of Butler amending Part Two, Chapter 57 (Police Pension Plan) of the codified ordinances of the City of Butler to incorporate plan changes resulting from collective bargaining negotiations during fiscal year 2018. Second by Mayor Smith. All voted aye.
    2. Motion for the introduction and first reading of City Ordinance No. 1768, an ordinance of the City of Butler amending Part Two, Chapter 57 (Police Pension Plan) of the codified ordinances of the City of Butler to incorporate plan changes resulting from collective bargaining negotiations during fiscal year 2018. Second by Mayor Smith. All voted aye.
    3. Motion to approve the transfer of Sharon Snyder to the position of Clerk Bookkeeper based on a recommendation from the City Treasurer. Second by CM Bonus.  All voted aye.
    4. Motion to approve the updated job description for the Clerk Tax Bookkeeper in the Office of the City Treasurer. Second by CM Roche. All voted aye.
    5. Motion to approve the transfer of Heather Blair to the position of Clerk Tax    Bookkeeper based on a recommendation from the City Treasurer. Second by CM    Roche.  All voted aye.
    6. Motion to approve the 2019 Minimum Municipal Obligations for the City’s three pension plans as follows: for the Firefighters Pension Plan – $282,080 and for the Police Pension Plan – $257,504 and the Officers and Employees Pension Plan – $56,433.  Second by CM Bonus.  All voted aye.
    7. Motion for the introduction and first reading of City Ordinance No. 1767; an ordinance of the City of Butler amending Chapter 69; Purchasing; Article II; Rules and Regulations; §69-15.; Surplus supplies, material and equipment, of the codified ordinances of the City of Butler. Second by Mayor Smith. All voted aye.

    Councilman Bonus

    1. Motion to institute a procedure for the reporting of disorderly houses and notifying landlords of the process. Second by Mayor Smith. After discussion, council felt there needed to be review and support from the DA and Magistrate.

    Mayor Smith made the motion to table. Second by CM Bonus.  All voted aye.  Motion tabled.

    Councilman Smith joined the meeting via cellphone.

    1. Motion to approve payment to Gargiulo Landscape in the amount of $15,180.62 for the brick reconstruction on a portion Oak Street. LIN 18 430 439. Second by Mayor Smith. All voted aye.
    2. Motion to install a “No Parking Here to Corner” on Heim Avenue at the intersection of Marvin Street on a 90-day trial basis. Second by Mayor Smith. All voted aye.
    3. Motion to install a “No Parking Here to Corner” on Heim Avenue at the intersection of Maple Street on a 90-day trial basis. Second by CM Roche. All voted aye.

    Councilman Roche

    1. Motion to approve the updated job description for the Fire Chief, City of Butler/Butler Township. Second by Mayor Smith. All voted aye.
    2. Motion to ratify a revision to the City’s Civil Service Rules and Regulations governing the hiring of entry-level part-time firefighters, as well as promotions within the respective department. Second by Mayor Smith. All voted aye.
    3. Motion to approve the promotion of part-time Firefighter Sean Sokolowski to the position of full-time Firefighter within the Bureau of Fire to fill the opening created by the retirement of Theodore Codipsot. Second by Mayor Smith. All voted aye.

    Council discussed the SAFER Grant in the fire department.  Prior to making any commitment, council will need to gather more information.

    Mayor Smith

    1. Motion to approve the retirement of Chief Ronald J. Brown from the Butler City Police Department following 27 years of service, effective July 31, 2018. Second by    CM Bonus.  All voted aye.
    2. Motion to amend City Resolution 2018 – 07 – 26, to increase the Multimodal Transportation Fund grant request from $1,474,669 to $2,103,090; and, to revise the          Grant application accordingly. Second by CM Bonus.  All voted aye.
    3. Motion to update the City of Butler’s Open Records Policy Statement. Second by CM Roche.  All voted aye.
    4. Motion to accept the resignation of Patrol Officer Corey Wendel from the Butler City Police Department effective August 27, 2018. Second by CM Bonus.  All voted aye.
    5. Motion to approve the conditional hiring of Michael E. Sulerud, Jr. for patrol officer             to fill a vacancy in the Butler City Police Department created by the resignation of Patrol        Officer Corey Wendel. Second by CM Bonus.  All voted aye.
    6. Motion for the introduction and first reading of City Ordinance No. 1769; an ordinance of the City of Butler amending Chapter 260, the zoning ordinance, to establish    the Ritts Historic and Architectural District.  Second by CM Roche.  All voted aye.
    7. Motion to honor the agreement made between Mayor Maggie Stock and Butler Downtown to allocate all funds generated from interest on the repayments of loans made      by the Revolving Loan Fund Committee to Butler Downtown for their use in new loans and operational expenses.  Second by CM Roche.  All voted aye.
    8. Motion to approve the retirement of Deputy Chief Dave Adam from the Butler City Police Department following 27 years of service, effective August 24, 2018.  Second by           CM Walter.  All voted aye.

    Appointments:

    Brian K. McCafferty has been reappointed to the Redevelopment Authority of the City of Butler for a 5 (five) year term which expires June, 2023.

    In the absence of the City Treasurer, CM Bonus presented a Monthly Intake Report for July, 2018.

    The City Controller presented bills for payment as follows: from the general fund – $341,450.96; from the parking fund – $31,963.51; from the capital projects fund – $18,812.12; and from the liquid fuels tax fund – $7,291.46; for a grand total of $399,518.05. Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented.  All voted aye.
