    October 3, 2016

    Mayor Donaldson called the meeting to order at 9:00 AM. Mayor Donaldson and Council members Walter, Kline, Bonus and Roche were present.

    COUNCIL ACTIONS

    Councilman Bonus

    1. Based on recommendation from his chain of command and satisfactory completion of his probationary period, motion to grant permanent employment status as of September 27, 2016 to Zachary Kordes. Second by Mayor Donaldson. All voted aye.

    Mayor Donaldson

    1. Motion to adopt City Ordinance No. 1733; an ordinance of the City of Butler authorizing the incurring of lease rental indebtedness by the guaranty of the debt service on a note of the Redevelopment Authority of the City of Butler in a principal amount of two million and 00/100 dollars; covenanting to pay, and pledging unlimited taxing power for the repayment of the note under the guaranty; authorizing filings of required documents with the DCED; ratifying actions of officers and redirecting actions; and making other covenants in respect of the guaranty. Second by CM Walter. All voted aye.
    2. Motion to approve an agreement with County Festivals, LLC for a festival to be held in 2017. Second by CM Bonus. All ovted aye.
    3. Motion to enter into an agreement with Green Seven Technologies for IT support in the police department. Second by CM Bonus. Mayor Donaldson voted to table the motion.  Second by CM Bonus.  All voted aye.  Motion tabled.
    4. Motion to approve a contract between the City of Butler and Amano McGann, Inc. for services related to user interface, functionality and content of the web aslan product associated with the pay station located in the Centre City Parking Garage. Second by CW Kline. All voted aye.
    5. Motion to approve a contract between the City of Butler and 3-C Payment USA Corp. to enable transactions from parking pay stations to the City’s processor of credit card payments. Second by CM Bonus. All voted aye.

    Councilwoman Kline

    1. Motion to direct the city clerk to advertise for bids for sale of surplus SCBA equipment in the fire department. Second by Mayor Donaldson. All voted aye.
    2. Motion to set the parking rates at the Centre City Parking Garage at $0.50/half hour and $1.00/hour at the kiosk pay stations and $1.00 per hour not to exceed $8.00 in a 24 hour period at the pay station located in the front of the garage. Second by CM Walter. All voted aye.

    Mayor Donaldson adjourned the meeting at 9:45 AM.

    Mayor Donaldson called the meeting to order at 7:00 PM. Mayor Donaldson and Council members Walter, Kline, Bonus and Roche were present. The pledge of allegiance to the flag followed an invocation given Pastor Kimberly van Driel, First English Lutheran Church.

    The following persons spoke at the Public to be Heard Section of the meeting. All of the speakers discussed the proposal to establish a Human Relations Commission, commenting both for and against the proposal:

    MONTHLY & ANNUAL DEPARTMENT REPORTS

    Motion by Mayor Donaldson with a second from CM Roche to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Department reports for the month of August were approved by individual, unanimous votes.

    COUNCIL REPORTS/ACTIONS

    Councilman Walter

    1. Motion to reject the bid from 911Leasing.com for a five (5) year lease to purchase one used 2013 Pelcan P Three Wheel Boom Street Sweeper. Second by CW Kline. All voted aye.
    2. Motion to accept the bid from PNC with an interest rate of 2.68% per annum to be used for a five (5) year lease to purchase one used 2013 Pelcan P Three Wheel Boom Street Sweeper. Annual payment $23,259.07. LIN 35 430 429. Second by CW Kline.  All voted aye.
    3. Motion to direct the City Clerk and the heads of all departments to discontinue all discretionary purchases and expenditures with the goal of conserving all available funds to the end of the fiscal year. Second by CW Kline. All voted aye.
    4. Motion to approve City Resolution No. 2016-09-22; a resolution of the City of Butler appointing Kenneth Bonus as an authorized representative to make requests upon and receive any and all tax information and records from Berkheimer, relative to the collection of taxes for the Taxing Authorities within the Butler County Tax Collection District, as directed and deemed necessary, to be used for official purposes only.  Second by Mayor Donaldson. All voted aye.
    5. Motion to approve the 2017 Minimum Municipal Obligations for the City’s three pension plans as follows: for the Firefighters Pension Plan – $149,190 and for the Police Pension Plan – $175,281 and the Officers and Employees Pension Plan – $28,472. Second by CW Kline. All voted aye.
    6. Motion to accept the bid from America First Enterprises, LLP in the amount of $10,001.00 for the sale of City owned real estate known as Tax Parcel 565-42-64. Second by Mayor Donaldson. All voted aye.

    Councilman Bonus

    1. Motion to direct the City Clerk to seek proposals for limestone, asphalt and petroleum products for Fiscal Year 2017 with such proposals due not later than 2:00 PM on November 14th. Second by CW Kline. All voted aye.
    2. Motion to accept the bid from Bauer Excavating, Inc. in the amount of $10,400.00 for the 2016 Sullivan Run Stream Cleaning project. LIN 18 427 305. Second by Mayor Donaldson. All voted aye.

    Councilman Roche

    1. Motion to dedicate the shelter at the Institute Hill Playground as “The Victor T. Rikal, Sr. Memorial Shelter.” Second by CW Kline. All voted aye.

    3. Motion to approve payment to Merrit Electrical Group, Inc. in the amount of $22,459.93 for the construction of the Centre City Parking Garage. LIN 43 463 020.  Second by CM Roche. All voted aye.
    4. Motion to approve payment to Reno Bros., Inc. in the amount of $3,726.94 for the construction of the Centre City Parking Garage. LIN 43 463 020. Second by CM Roche.  All voted aye.
    5. Motion for the second reading and adoption of City Ordinance No. 1732, an ordinance of the City of Butler, Pennsylvania to amend Chapter 6; Authorities; Municipal and Chapter 87; Traffic Violations Bureau of the codified ordinances of the City of Butler to remove references of the Parking Authority. Second by CM Roche. All voted aye.
    6. Based on recommendation from his chain of command and satisfactory completion of his probationary period, motion to grant permanent employment status as of September 14, 2016 to Patrol Officer Eric C. Klopfer. Second by CW Kline. All voted aye.
    7. Motion to accept the bid from Nathan Contracting in the amount of $14,529.00 for the McKean Street Parking Garage Rehabilitation. LIN 05 448 240. Second by CM Roche.  All voted aye.
    8. Motion to offer the employees an Employee Assistance Program (EAP) in connection with the city’s group insurance from The Standard at no cost to the City. Second by CW Kline. All voted aye.

    In absence of the City Treasurer, the City Controller presented a Monthly Intake Report for August, 2016.

    The City Controller presented bills for payment as follows: from the general fund – $215,448.94; from the parking fund – $21,575.64; from the capital projects fund – $91,227.60; from the liquid fuels tax fund – $3,664.78; and from the 2015-Series Bond Proceeds – $394,698.78 for a grand total of $726,615.74. Motion by Mayor Donaldson with second from CW Kline to approve payment of bills as presented.  All voted aye.

    Mayor Donaldson called the meeting to order at 9:01 AM.  Mayor Donaldson and Council members Kline, Bonus and Roche were present.

    COUNCIL DISCUSSION

    Mayor and Council discussed the unfunded debt loan and procedures to file application.  Cash projection will be distributed to all departments for their best estimate for the remainder of 2016.

    Mayor recessed the meeting at 9:03 AM for executive session to discuss a personnel issue.  The meeting was reconvened at 9:08 AM.

    COUNCIL ACTIONS

    1. Motion to approve a Last Chance Agreement between the City of Butler and Jason Gueck. Second by CW Kline. All voted aye.

    Mayor Donaldson adjourned the meeting at 9:09 AM.

    August 25, 2016

    Mayor Donaldson called the meeting to order at 7:00 PM.  Mayor Donaldson and Council members Walter and Kline were present. The pledge of allegiance to the flag followed an invocation given Pastor Steve Ogle, Community Life Church.

    Mayor Donaldson recessed the city council meeting at 7:05 PM.

    7:05 PM PUBLIC HEARING   Art Cordwell, of the Redevelopment Authority of the City of Butler – to brief Council and the public on the 2016 Community Development Block Grant (CDBG) application.

    Mayor Donaldson reconvened the city council meeting at 7:10 PM.

    In accordance with the provisions of Section 10801 of the Pennsylvania Consolidated Statutes – Title 11, motion by Mayor Donaldson to appoint Kenny Bonus to the position of City Council to fill the vacancy created by the resignation of  Richard J. Schontz, Jr. for a term to expire on the first Monday in January, 2018.   Second by CW Kline.     All voted aye.  Following the vote, Mayor Donaldson administered the Oath of Office to Councilman Kenny Bonus.

    (Note:  The next municipal election is in November 2017, and the term of office for the person elected to the position of City Council at that time shall run from January 2018 to January 2022.)  

    Mayor Donaldson recessed the meeting at 7:12 PM. 

    The meeting was moved to the fire station and reconvened at 7:15PM.

    1. Motion to authorize the City Clerk to advertise for the sale of City owned real estate known as Tax Parcel 565-42-64. The terms of the sale shall permit all bidders to make their offer contingent upon the successful bidder obtaining all local, state and federal permits require to use the property for their intended use.     1. Motion to accept the proposal from Software Systems, Inc. for Integrated Financial Management and Access System (IFM) accounting system in the amount of $27,500.00 with a down payment of $10,000.00 paid in 2016 and the balance paid in 2017. Second by Mayor Donaldson. All voted aye.

Motion by Mayor Donaldson with second from CW Kline to approve payment of bills as presented.  All voted aye.

    July 28, 2016

    Mayor Donaldson called the meeting to order at 7:00 PM. Mayor Donaldson and Council members Walter, Kline, Schontz and Roche were present. Mayor Donaldson recessed the meeting at 7:01 PM.  The meeting was moved to the fire station and reconvened at 7:06 PM. The pledge of allegiance to the flag followed an invocation given by Pastor Jeff Harris, Crossroad Community.

    Mayor Donaldson presented keys to the city and a proclamation to former Mayor Richard Schontz and Councilman Richard Schontz, Jr. and thanked them for their years of service to the city of Butler.

    4. Motion to impose a hiring freeze until city finances stabilize and/or need arises. Second by CW Kline. All voted aye.

    1. Motion to appoint Corey Roche to the City of Butler Parks, Recreation Grounds & Facilities Authority to fill the remainder of John Grenci’s term which expires on January 1, 2018. Second by Mayor Donaldson. CM Walter, CW Kline, CM Schontz and Mayor Donaldson voted aye. CM Roche abstained.

    2. Motion to approve the retirement of Captain Ronald D. Fierst from the Bureau of Police following 37 years of service, effective July 31, 2016. Second by CM Roche. All voted aye.
    3. Motion to approve payment to Gateway Engineers in the amount of $4,261.00 for the engineering of the Centre City Parking Garage. LIN 43 463 010.   Second by CM Roche. All voted aye.
    4. Motion to approve payment to Thomas Construction, Inc. in the amount of $436,519.78 for the construction of the Centre City Parking Garage. LIN 43 463 020.

    1. Motion to approve blocking the streets between Jefferson to Wayne and between Washington to McKean on August 20th for the filming of “Mindhunter”. Second by CW Kline. All voted aye.
    2. Motion to enter into an agreement with the production crew of “Mindhunter” to permit their use of a combination of the Diamond Street Lot, the McKean Street Deck and the Tier Garage on August 20th for the extras, the crew, and production vehicles, after review by the city solicitor. Second by CW Kline.  All voted aye.

     

    The City Treasurer presented a Monthly Intake Report for June, 2016.

    The City Controller presented bills for payment as follows: from the general fund – $255,204.73; from the parking fund – $26,437.67; from the capital projects fund – $206,949.08; from the liquid fuels tax fund – $4,081.21; and from the 2015-Series Bond Proceeds – $440,780.78 for a grand total of $933,453.47. Motion by Mayor Donaldson with second from CW Kline to approve payment of bills as presented.  All voted aye.
