    City Council Meeting
    City of Butler, Pennsylvania
    February 25, 2020

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Deacon Mitch Natali, St. Paul’s Catholic Church.

    Mayor recessed the meeting at 7:04 PM for a brief executive session to discuss a personnel issue. Meeting reconvened at 7:19 PM.

    Motion by Mayor Smith with a second from CM Walter to approve the agenda for the regular meeting of February 25, 2020. Motion by Mayor Smith to amend the agenda as follows:

    CM Dandoy made a motion to table item #9; a motion to approve the promotion of            Firefighter Richard Walters Jr. to the rank of Lieutenant within the Butler Bureau       of Fire effective March 1, 2020. Second by Mayor Smith.  All voted aye.

    CM Smith made a motion to add a motion to direct the city clerk to request bids for           the following items:  4 ton HVAC unit, 7.5 ton HVAC unit and an 8.5 ton HVAC unit        on the public safety building and to replace the heat exchanger on the remaining       unit.  Second by CM Dandoy.  All voted aye.

    CM Smith made a motion to add a motion to approve an agreement with the         Butler YMCA to provide summer food and recreation at Christie Park.  Second by    Mayor Smith.  All voted aye.

    Mayor Smith made a motion to add a motion to approve the Pension Board’s        recommendation to engage AndCo Consulting to provide pension investment      consulting services to the City of Butler’s Municipal Pension System.  Second by   CM Smith.  All voted aye.

    Mayor Smith made a motion to add a motion based on recommendation from his             chain of command and satisfactory completion of his probationary period, motion         to grant permanent employment status as of February 25, 2020 to Patrol Officer   Jacob D. May. Second by CM Smith.  All voted aye.

    Second by CM Walter. All voted aye.  Agenda amended.

    Motion by Mayor Smith with a second from CM Bonus to approve the minutes of the regular meeting held on February 4, 2020. All voted aye.

    Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Councilman Walter

    1. Motion for the second reading and adoption of City Ordinance No. 1784, an ordinance of the City of Butler amending Ordinance No. 1781; fixing the wages and salaries of employees of the City in conformance with the budget for Fiscal Year 2020.  Second by Mayor Smith. All voted aye.
    2. Motion to direct the City Clerk to advertise a RFP for a small borrowing loan of $280,000.00 for the 2020 Storm Sewer Project. The loan is to be payable over a term of two (2) years. Second by CM Bonus. All voted aye.
    3. Motion to approve a proposal submitted by Caruso & Spencer, PC, Certified Public Accountants for monthly auditing services for Fiscal Year 2020 as outlined in their engagement letter of January 1, 2020 and to authorize the City Clerk to sign said letter on behalf of City Council. Second by CM Bonus. All voted aye.

    Councilman Smith

    1. Motion to approve an agreement to allow JMac Cycling LLC to utilize Memorial Park Drive in Memorial Park for bicycle races on April 26th and June 21st of 2020. Second by       CM Bonus.  All voted aye.
    2. Motion to approve agreement with Grace Youth and Family Foundation to operate the City of Butler Summer Recreation Program at Rotary Park, Institute Hill Playground, Memorial Park, and Father Marinaro Park including the Summer Pool Program for a fee of $9,000. Second by Mayor Smith. All voted aye.
    3. Motion to approve the purchase of security cameras from Secure Technical Solutions, Inc. in the amount of $11,110.00 to be installed at Father Marinaro Park. (This will be paid from donations received). Second by Mayor Smith. All voted aye.
    4. Motion to approve final payment to Fuller Home Building, Inc. in the amount of $30,829.50 for the Roof Replacement Project. LIN 18 469 463.  Second by Mayor Smith.  All voted aye.
    5. Motion to approve the lease with the Musical Theatre Guild for the facility in Memorial Park. Second by CM Dandoy.  All voted aye.

    1. Motion to accept a Fire Company and Emergency Medical Service grant in the amount of $14,248.03 from the Office of the State Fire Commissioner, and execute the required grant agreement. Second by Mayor Smith. All voted aye.

    Mayor Smith

    1. Motion to readopt the Residential Anti-Displacement, Acquisition, Demolition and Relocation Assistance Plan applicable to the Community Development Block Grant program. Second by CM Bonus. All voted aye.
    2. Motion to reapprove the Citizen Participation Plan and Form; the Citizen Complaint/Grievance Process; and the Minority and Women’s Business Enterprise Action Plan for the City of Butler and Redevelopment Authority of the City of Butler Community Development Block Grant/Home Programs. Second by CM Bonus. All voted aye.
    3. Motion to reapprove the updated City of Butler Section 504 Grievance Procedure and forms. Second by CM Dandoy. All voted aye.

    The City Controller presented bills for payment as follows: from the general fund – $172,313.37; from the parking fund – $39,007.92; from the capital projects fund – $3,129.80; and from the liquid fuels tax fund – $46,641.64; for a grand total of $261,092.73.  Motion by Mayor Smith with second from CM Bonus to approve payment of bills as presented.  All voted aye.

    • ANNOUNCEMENTS

    February Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to ensure that local residents are aware of the two types of systems that are within Butler City and the other local municipalities. The one system is the sanitary sewer system, in which toilets, sinks and garbage disposals are all connected and flow into a treatment facility that removes all of the contaminants and then discharges clean water into a local waterway. The storm sewer system is made up of catch basins that are usually placed along curbs in streets and parking lots and direct stormwater runoff through a series of pipes directly into the local waterway. Please be aware that there is no treatment for stormwater, so do not dump anything into the storm sewer catch basins. If you are unsure about the proper disposal of any type of waste material, please contact your local municipality.

    Cindy Parker spoke about a non-profit created called Southside Park Group and presented council with a list of proposed projects.

    Natalie Coyne, a college student from Chatam and an intern with the Borgen Project, requested support from council for the Borgen Project to help end global poverty.

    February 4, 2020

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Reverend Kimberly van Driel, First English Lutheran Church.

    Lieutenant Grooms introduced Chooch, one of the City’s new K9 officers.

    OATH OF OFFICE – Mayor Smith administered the Oath of Office to Barbara E. Hall, City Controller

    Motion by Mayor Smith with a second from CM Walter to approve the agenda for the regular meeting of February 4, 2020. All voted aye.

    Motion by Mayor Smith with a second from CM Bonus to approve the minutes of the regular meeting of January 23, 2020. All voted aye.

     Councilman Walter

    1. Motion to approve a payment in the amount of $217,378.36 to Wells Fargo Bank for debt service for the City’s 2005 general obligation bonds. (Note: This payment includes principal of $200,000.00 and interest of $17,378.36; due March 1st.) Second by Mayor Smith. All voted aye.

    Councilman Smith

    1. Motion to approve City Resolution No. 2020-02-04A; the City of Butler agrees to comply with the requirements of the Butler County Parks Renovation Program for the purpose of obtaining grant funds for the renovation of Butler Ritts Park. Second by Mayor Smith. All voted aye.

    Councilman Bonus

    1. Motion to install a “Loading Zone” sign on W. Brush Street 40 feet east of S. Washington Street on a 90-day trial basis. Second by CM Walter. All voted aye.
    2. Motion to install a “No Parking Between Signs” sign on the south side of W. Brush Street between S. Washington and S. Main Street on a 90-day trial basis. Second by Mayor Smith. CM Smith abstained. CM Walter, CM Bonus, CM Dandoy and Mayor Smith voted aye.
    3. Motion to award the demolition of 515 Carbon St. to Pat McGrady in the amount of $9,750.00 based upon the general specifications of the contract and the release by the City Solicitor. (To be paid from Fire Escrow) Second by Mayor Smith. All voted aye.

    1. Motion to designate Veronica Walker as the City’s Fair Housing Officer for 2020. Second by CM Walter. All voted aye.
    2. Motion to approve City Resolution No. 2020-02-04; the City of Butler’s Fair Housing Resolution. Second by CM Walter. All voted aye.

    The City Controller presented bills for payment as follows: from the general fund – $336,600.67; from the parking fund – $10,573.84; from the capital projects fund – $27,824.99; and from the liquid fuels tax fund – $15,631.24; for a grand total of $390,849.26. Motion by Mayor Smith with second from CM Walter to approve payment of bills as presented.  All voted aye.

    January 23, 2020

    Mayor Smith called the meeting to order at 7:00 PM. Mayor Smith and Council members Walter, Smith, Bonus and Dandoy were present. The pledge of allegiance to the flag followed an invocation given by Pastor Steve Ogle, Community Life Church.

    Mayor Smith requested a moment of silence in remembrance and honor of Dale Pinkerton.

    PRESENTATIONS:

    Kailyn Golding requested council to approve a tobacco-free policy for the City’s playgrounds and parks.

    Eric Lamb, Hercules LED, LLC, presented a proposal to replace all the lights with LED fixtures in the public safety building and the city building.

    Motion by Mayor Smith with a second from CM Bonus to approve the minutes of the reorganization meeting of January 6, 2020 with the following correction to a clerical error – Remove Butler Township-City Joint Municipal Transit Authority from No. 3; City Council Liaison Appointments, as the Authority no longer exists. All voted aye.

    Motion by Mayor Smith with a second from CM Walter to acknowledge receipt of the monthly minutes from RACB, including the CDBG/HOME Program activities. All voted aye.

    Councilman Smith

    1. Motion to approve City Resolution No. 2020-01-23, a resolution adopting a Tobacco and Nicotine-Free Policy for the City of Butler Parks and Playgrounds. Second by CM Bonus. CM Walter, Smith, Dandoy and Bonus voted aye. Mayor Smith voted no.
    2. Motion to accept the Hercules LED proposal for retrofitting the lights at the City Building and the Public Safety Building contingent upon Hercules LED and the city solicitor developing a final agreement. Second by CM Bonus.  All voted aye.

    Councilman Bonus

    1. Motion to approve the retirement of Joseph Neigh, Plumbing Inspector, effective April 5, 2020, after 16 years of service. Second by Mayor Smith. All voted aye.

    Councilman Dandoy

    1. Motion for the second reading and adoption of City Ordinance No. 1783, an ordinance of the City of Butler amending Part Three, Chapter 57 (Firefighter Pension Plan) of the codified ordinances of the City of Butler to incorporate plan changes resulting from collective bargaining negotiations during the fiscal year 2019. Second by Mayor Smith. All voted aye.
    2. Motion to approve the implementation of Agenda Guidelines, effective January 23, 2020, as follows:
    3. Meeting agendas will be disseminated to Council and posted no later than         72 hours before each meeting, except for Special Meetings.  Special meeting       agendas will be disseminated to Council and posted as soon as reasonable     under the circumstances.
    4. The first order of business will be the approval of the meeting agenda.
    5. Once the meeting agenda is approved, it can only be amended upon motion     and unanimous approval of Council.

    Mayor Smith

    1. Motion to accept the bid from Tri-Star Motors in the amount of $33,235.00 for the purchase of (1) one 2020 Ford Interceptor SUV to be used in the police department.

    1. Motion to accept the bid from Ibis Tek, Inc. in the amount of $2,327.00 for the upfitting of the 2020 Ford Interceptor SUV to be used in the police department. Second by CM Walter.  All voted aye.
    2. In accordance with the provisions of §10802 of the Pennsylvania Consolidated Statutes, Title 11, motion to appoint Barbara E. Hall to the position of City Controller and to a term of office that shall run through January 2022. (Note: The next municipal election is in November 2021, and the term of office for the person elected to the position of City Controller at that time shall run from January 2022 to January 2026.)   Second by CM Walter. All voted aye.

    January Public Announcement – Municipal Separate Storm Sewer System (MS4)

    As part of an ongoing education plan, we would like to remind local residents to follow the manufacturer’s recommendations for salting driveways and sidewalks. If too much salt is applied, it will runoff into the storm sewer system and impact our local waterways. Please keep the de-icing materials away from landscaping and keep it isolated to the walkway or driveway. Also, if you change the fluids in your automobile, please recycle the used oil and other automotive fluids at participating service stations. Do not dump these chemicals down the storm drains or dispose of them in the trash. If you want to temporarily store any of these chemicals on your property, just make sure that they are in sealed containers that will not rust or leak and try to keep them in a dry place.

    Everett Roy and Ryan Fichter spoke about the non-profit organization that has been established in honor of Mr. Mac Miller and Mr. Nip$ey Hu$$le, called “Butler PA Hip Hop and Rap Community”.  Their goal is to give back to the greater Butler community.  Concerts are held at the Arts Center (AABC) on S. Main Street.

    Mayor Smith recessed the meeting at 8:17 PM to have an executive session to discuss personnel issues.

    January 6, 2020

    Mayor Smith opened the meeting at 10:00 AM. Chief O’Neill led in the pledge of allegiance after the invocation was given by Father Kevin Fazio, Butler Catholic Churches.

    Mayor Smith requested a moment of silence in remembrance and honor of City Controller, Gretchen Ehlman.

    1. At 10:00 AM, January 6, 2020, the following named individuals who won election on November 5, 2019 took their oaths of office administered by Mayor Benjamin A. Smith: Councilman Michael E. Walter, Councilman Robert A. Dandoy, and Treasurer Aaron F. Bonus. Their term of office is from January 2020 through January 2024.
    2. City Council met immediately after the swearing-in for its reorganization meeting. Mayor Smith, Councilman Walter, Councilman Smith, Councilman Bonus and Councilman Dandoy were present.

    Emmalee Herndon has been appointed to the Butler City Parks, Recreation Grounds & Facilities Authority to fill the term of Phillip Lefevre whose term expires January 1, 2021.

    City Council is looking for someone interested in filling the seat of City Controller for a period of two years until the next municipal election.

    1. Motion to ratify the Tentative Agreement by and between the City and the International Association of Firefighters, Local 114, for the duration effective as of January 1, 2020 and terminating on December 31, 2024. Second by Mayor Smith. All voted aye.
    2. Do not dump these chemicals down the storm drains or dispose of them in the trash. If you want to temporarily store any of these chemicals on your property, just make sure that they are in sealed containers that will not rust or leak and try to keep them in a dry place.
