City Council Meeting
City of Butler, Pennsylvania
November 19, 2009
Mayor Stock called the meeting to order at 7:00 PM. Mayor Stock and Council members Reese, Bratkovich, and Kline were present. The pledge of allegiance to the flag followed the invocation given by Mr. Jeffrey Riggs, Chaplain of the American Legion Riders.
PRESENTATIONS:
· Kelly Dreher presented a 2010 Calendar spotlighting schools in the area.
· John Schon from the Butler Area Sewer Authority gave an update on Act 537 Sewage Facilities Planning.
PERSONS TO BE HEARD:
· Mike English presented his concerns about decisions being made by the Butler Area Sewer Authority.
Motion by CM Reese with second from CW Kline to approve the minutes of the regular City Council meeting of October 22, 2009.
At its Forum Meeting on November 17, 2009 City Council, acting the Board of Health, and under the provisions of the Third Class City Code, Section XXIII, (b) Abatement of Public Nuisances, Section 2321, found the following subject structures detrimental to public health and order their removal by demolition:
315-317 E. Jefferson Street
305 W Brady Street
715 Center Avenue (garage)

MONTHLY DEPARTMENT REPORTS
(Note: Department Reports Distributed to Council at Tuesday’s Forum Meeting for Review)
All department reports for the month of October, 2009 were approved by individual, unanimous votes.
COUNCIL REPORTS/ACTIONS
Councilman Kelly
1. Motion for the introduction and first reading of City Ordinance No. 1619, an ordinance of the City of Butler fixing the tax rate for Fiscal Year 2010.
Second by CM Bratkovich. All voted aye.
2. Motion for the introduction and first reading of City Ordinance No. 1620, an ordinance of the City of Butler adopting the annual budget and appropriating specific sums estimated to be required for the specific purposes of the City government as set forth therein during Fiscal Year 2010.
Second by CM Reese. All voted aye.
3. Motion for the introduction and first reading of City Ordinance No. 1621, an ordinance of the City of Butler fixing the wages and salaries of employees of the City in conformance with the budget for Fiscal Year 2010.
Second by CM Reese. All voted aye.
4. Motion to direct the City Clerk to prepare and release a request for proposals for a Tax Revenue Anticipation Note (TRAN) in the amount of six-hundred thousand dollars for Fiscal Year 2010.
Second by CW Kline. All voted aye.
5. Motion to approve City Resolution 2009-11-19 – authorizing the filing of an Application for HOME funds with the Department of Community and Economic Development (DCED).
Second by CW Kline. All voted aye.
Councilwoman Kline
6. Motion to approve the bid from Day Fleet Sales in the amount of $42,736.00 for a 2010 truck for the Parks Department.
Second by CM Bratkovich. All voted aye.
7. Motion to authorize the city clerk to advertise for bids for sale of the 1998 Parks Department truck.
Second by CM Reese. All voted aye.
8. Motion to approve a bid, contingent upon receiving grant money or upon the vendor and the City entering into a satisfactory payment plan, from Industry LED in the amount of $28,594.00 for the purchase of LED replacement bulbs.
Second by Mayor Stock. All voted aye.
CW Kline extended gratitude to the Shade Tree Commission for all its hard work in the City of Butler.

9. Motion to change the west curb of South Monroe Street, from the bridge southward 90 feet, to “No Parking Anytime” on a 90-day trial basis.
Second by Mayor Stock. All voted aye.
10. Motion to change “Loading Zone” in front of Bergbiglers on Center Avenue, to “No Parking This Block” on a 90-day trial basis. (no parking on north curb of Center Avenue from Spring Street westward to Wayne Street Bridge).
Second by CW Kline. All voted aye.
11. Motion to change Sandy Street to be “One-Way” northbound beginning at Center Avenue to Maple Avenue on a 90-day trial basis.
Second by CM Reese. All voted aye.
12. Motion to approve a bid submitted by and award the Fiscal Year 2010 contract for supply of the City’s asphalt materials to Wiest Asphalt Products & Paving as follows: 9.5MM Superpave Wearing Course FOB $68.50 per ton; 19MM Superpave FOB $57.00 per ton
Second by CW Kline. All voted aye.
13. Motion to approve a bid submitted by and award the Fiscal Year 2010 contract for supply of E-3 Emulsion to TDF Services as follows: E-3 Emulsion Placed – 2.197 per gallon
Second by CW Kline. All voted aye.
14. Motion to approve a bid submitted by and award the Fiscal Year 2010 contract for supply of the City’s limestone materials to Allegheny Mineral Corporation as follows: #2A – 16.00 per ton; #4 – 17.00 per ton; #8 – 17.00 per ton; #57 – 16.00 per ton
Second by CM Reese. All voted aye.
15. Motion to approve a bid submitted by and award the Fiscal Year 2010 contract for supply of the City’s petroleum products to Triangle Gasoline Company of Butler as follows: Unleaded $2.1045 per gallon; Diesel $2.0455 per gallon.

16. Motion for the introduction and first reading of City Ordinance No. 1622, an ordinance of the City of Butler providing for temporary tax exemption for certain improvements to deteriorated industrial, commercial and other business property and new construction in deteriorated areas, pursuant to the Act of December 1, 1997, P. L. 327, and defining deteriorated areas, establishing the amount of the exemption, providing an exemption schedule, and a procedure for securing an exemption.
Second by CM Bratkovich. All voted aye.
17. Motion to approve City Council’s 2010 meeting schedule, a copy of which will be published in a local newspaper to comply with the Sunshine Act and attached to the minutes of this meeting.
Second by CW Kline. All voted aye.
The City Controller presented bills for payment as follows: from the general fund – $586,342.46 ; and, from the capital projects fund – $3,106.38 , and from the liquid fuels tax fund – $10,949.14 for a grand total of $600,397.98. Motion by CM Bratkovich with second from CW Kline to approve payment of bills as presented. All voted aye.
